Resolution 2019-30853 RESOLUTION NO. 2019-30853 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE BUDGET ADVISORY COMMITTEE AT ITS MAY 7, 2019 MEETING TO RETAIN AN INDEPENDENT CONSULTANT TO EVALUATE THE PROPOSED PUBLIC BENEFITS BEING OFFERED TO THE CITY, INCLUDING AN EVALUATION OF THE VALUE CONFERRED ON THE DEVELOPER, IN CONNECTION WITH ANY DEVELOPMENT AGREEMENTS, AND/OR THE PROPOSED SALE, VACATION, OR OTHER CONVEYANCE OF CITY PROPERTY. WHEREAS, on May 7, 2019, the Budget Advisory Committee ("BAC"), unanimously passed a motion, recommending that the City of Miami Beach (the "City"), retain an independent consultant to evaluate the proposed public benefits being offered to the City, including an evaluation of the value conferred on the developer, in connection with any development agreements, and/or the proposed sale, vacation, or other conveyance of City property; and WHEREAS, this would serve as a basis to evaluate the value of a proposed transaction between the City and a private developer, with the purpose of determining the amount of public benefits to be provided by the developer, either in the form of a contribution to the City's funds for capital improvements and/or in the form of other intangible benefits expected from a proposed development project that involves the participation of the City in one of the aforestated ways; and WHEREAS, the BAC also recommended that, in each of these cases, the fee for the independent consultant should be paid by the developer prior to commencement of the analysis; and WHEREAS, the proposed retention of an independent consultant is intended to provide the City Commission with better understanding of a proposed transaction between the City and a private developer, as well as equip the City Commission with better ability to formulate the public benefits that the City Commission would require as consideration for the proposed transaction; and WHEREAS, however, should the City Manager determine that a development agreement, and/or the proposed sale, vacation, or other conveyance of City property would provide little to no material economic benefit to the City, then retention of an independent consult will not be required. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Budget Advisory Committee at its May 7, 2019 meeting to retain an independent consultant to evaluate the proposed public benefits being offered to the City, including an evaluation of the value conferred on the developer, in connection with any development agreements, and/or the proposed sale, vacation or conveyance of City property.
