Resolution 2019-30864 RESOLUTION NO. 2019-30864 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND DIRECTING THE CITY ADMINISTRATION TO ALLOCATE A LINE ITEM, IN THE AMOUNT OF $250,000.00, IN THE CITY'S CAPITAL OPERATING BUDGET FOR FISCAL YEAR 2019/2020, IN ORDER TO PROVIDE FUNDING FOR THE PLANNING AND DESIGN PROCESS OF THE WATERWAY RESTORATION PROJECT. WHEREAS, the City of Miami Beach (the "City") is surrounded by more than sixty (60) miles of waterways that provide access for public safety response from the water, allow residents to access their private docks, and provide recreational boating opportunities; and WHEREAS, maintaining navigability of the City's waterways requires on-going maintenance, which has not occurred historically; and WHEREAS, in 2016, the City began receiving frequent requests from residents, as well as the City's waterway contractors and other water-dependent City services, to address accumulated sediment, trim vegetation and conduct other activities to restore navigation throughout the City's waterways; and WHEREAS, the two waterways that are in greatest need of dredging are Biscayne Pointe Waterway and Collins Canal, where sediment accumulation has caused some areas to be entirely unnavigable; and WHEREAS, one of the General Obligations Bond ("GOB") projects that was approved in the amount of $6,000,000, is the "Waterway Restoration" project (the "Project"), which will include conducting an updated waterway survey, updating the 2003 dredging analysis, obtaining the permits necessary to dredge, paying for any mitigation for impacted resources (i.e., seagrass critical habitat), and restoring navigability to Biscayne Pointe Waterway and Collins Canal; and WHEREAS, the funding for the Project has been allocated in the second tranche of the GOB program, which will be issued in Fiscal Year 2022/2023; and WHEREAS, the Project is estimated to take approximately nine years to complete and is divided into two main phases: 1) planning and design, and 2) construction; and WHEREAS, as such, the first phase, which involves the planning, design and permitting,will take at least two years to complete, and thus, it is of the utmost importance that design and permitting phase be initiated prior to tranche two funding; and 1 WHEREAS, at the March 13, 2019 City Commission meeting, the City Manager confirmed that the Administration is committed to initiating the first phase of the Project in 2019, to ensure that the work on the Biscayne Pointe Waterway and Collins Canal begins in tranche two; and WHEREAS, accordingly, the City Commission hereby directs that the Administration allocates a total of$250,000.00 in the City's Capital Operating Budget for Fiscal Year 2019/2020, to fund the planning and design process of the Project. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and direct the City Administration to allocate a line item, in the amount of $250,000.00, in the City's Capital Operating Budget for Fiscal Year 2019/2020, in order to provide funding for the planning and design process of the Waterway Restoration Project.
