A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
SUBMISSION OF AN APPLICATION FOR FUNDING
UNDER THE EMERGENCY SHELTER GRANT PROGRAM
THROUGH THE FISCAL YEAR 1988 FURTHER
CONTINUING APPROPRIATIONS ACT, PL 100-202

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
WHEREAS, on July 22, 1987 President Reagan signed into law the Stewart B.
McKinney Homeless Assistance Act intended to provide urgently needed assistance to
protect and improve the lives of the homeless; and,
WHEREAS, the City Commission authorized the submission of the
Comprehensive Homeless Assistance Plan (CHAP) on September 16, 1987; and
WHEREAS, the City Commission authorized the submission of an application for
funding under the Emergency Shelter Grant Program by Resolution #87-19009; and
WHEREAS, the City of Miami Beach was allocated $33,000 for the rehabilitation
and/or operation of an emergency shelter; and
WHEREAS, this funding was contractually combined with the Metro-Dade
County allocation to be used for the operation and rehabilitation of the Miami Rescue
Mission, located at 2250 N.W. 1st Avenue, Miami, for the benefit of all homeless
women and children, thus assisting the homeless in Miami Beach; and
WHEREAS, it has been agreed that priority will be given to the housing needs of
Miami Beach residents who have been displaced by the closing of unsafe buildings
through code enforcement action, or other City actions; and
WHEREAS, the City of Miami Beach has been allocated an additional five
thousand dollars ($5,000) to be matched by Metro-Dade County for the above described
project, and transmitted through the aforementioned contract;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager be authorized and
directed to submit the application for an additional $5,000 of funding under the
Emergency Shelter Grants Program to the U.S. Department of Housing and Urban
Development by March 28, 1988. Further, that the Administration be authorized to
revise and/or supplement the contract to transmit said funding to Metro-Dade County
for the operation and renovation of the Miami Rescue Mission located within Miami,
with the stipulation that Miami Beach's homeless women and children be allowed to
utilize said facility.

AND DADE COUNTY REGARDING THE
IMPLEMENTATION OF THE EMERGENCY
SHELTER GRANT FUNDED BY THE U.S.
DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT
WHEREAS, on July 22, 1987 President Reagan signed into law the Stewart B.
McKinney Homeless Assistance Act intended to provide urgently needed assistance to
protect and improve the lives of the homeless; and,
WHEREAS, the Miami Beach City Commission authorized the submission of the
Comprehensive Homeless Assistance Plan (CHAP) on September 16, 1987; and
WHEREAS, under one component of this Plan, the Emergency Shelter Grant
Program, the City of Miami Beach has been allocated $33,000 for the rehabilitation
and/or operation of an emergency shelter; and
WHEREAS, Dade County received an Emergency Shelter Grant allocation of
$253,000 for the rehabilitation and/or operation of an emergency shelter; and
WHEREAS, under the 1988 Further Continuing Appropriations Act PL 100-202,
the City of Miami Beach was allocated an additional $5,000 and Dade County was
allocated an additional $40,000; and
WHEREAS, the City, via Resolution 1/87-19009, adopted on October 7, 1987,
determined that the City's initial allocation of $33,000 was insufficient to properly
undertake and/or implement an independent project; therefore, that the City's funding
may be contractually combined with the Metro-Dade County allocation to be used for
the operation and rehabilitation of the Miami Mission Association, Inc., located at
2250 N.W. 1st Avenue, Miami, for the benefit of all homeless women and children, thus
assisting the homeless in Miami Beach; and
WHEREAS, it has been agreed that priority will be given to the housing needs of
Miami Beach residents and/or homeless women and children, who have been displaced
by the closing of unsafe buildings through code enforcement action, or other City
actions;
IT IS THE INTENT OF THE PARTIES TO THIS AGREEMENT, THE CITY OF MIAMI
BEACH, HEREINAFTER REFERRED TO AS THE "CITY", AND THE METROPOLITAN
COUNTY, HEREINAFTER REFERRED TO AS THE "COUNTY",TO CLARIFY THE
RESPONSIBILITIES FOR THE ADMINISTRATION OF THE MIAMI MISSION
ASSOCIATION, INC. REHABILITATION PROJECT FOR THE HOMELESS, THROUGH
THE EMERGENCY SHELTER GRANT (SEE ATTACHMENT A). THE
RESPONSIBILITIES ARE SET FORTH HEREIN.
I. The project shall be funded jointly by combining the City of Miami Beach's initial
entitlement allocation of $33,000 and an additional allocation of $5,000, and
Dade County's initial entitlement allocation of $253,000, and an additional
allocation of $40,000, for a total of $331,000 from the Emergency Shelter Grant
Program. The aforementioned funds are derived from a grant from the U.S.
Department of Housing and Urban Development, pursuant to Section IV of the
Stewart B. McKinney Act of 1987.
2. This money will be used to rehabilitate an emergency shelter for women and
children to he located at 2250 N.W. 1st Avenue, Miami, Florida, and to be
operated by the Miami Mission Association, Inc.
3. The funding will be utilized according to the revised budget in the Emergency
Shelter Grant application (See Attachment B). Any changes in line items by one
entity shall require prior written approval of the other. This is an administrative
approval only, and shall not require City or County Commission approval.
4. Miami Beach will transmit its allocation of $38,000 to Dade County in one lump
sum within thirty (30) calendar days from receipt of all $38,000 in funds from the
federal government. The City's salary (non-administrative) line item @
$4,450.00 in this allocation will be monitored through receipt of a Famis 552
report, to be submitted by the County Office of Community and Economic
Development on a monthly basis to the City's Community Development Division.
The rehabilitation line item @ $33,050.00, will be expended by the Miami Mission
Association, Inc., and charged to the City of Miami Beach and Dade County on a
pro-rata percentage basis of the invoices submitted by the general contractor.
Copies of these invoices will be sent to the City of Miami Beach for monitoring
on a monthly basis.
5. Dade County and the Miami Mission Association, Inc. will provide the "in-kind"
match for the City of Miami Beach's $38,000.00 share of funding, as well as their
own matching funds.
6. Dade County will provide the City of Miami Beach with a copy of the
Environmental Review of the Winwood area, which the City of Miami Beach
understands was prepared by the City of Miami, and which reveals no significant
environmental impact. It is clearly understood that the City of Miami Beach
relied upon Dade County regarding the findings contained in such Environmental
Review record.
7. It is understood by the parties that the U. S. Department of Housing and Urban
Development, Jacksonville Office, has clarified that Davis-Bacon and other
federal labor standards requirements are not applicable to this project, unless
CDBG (Non-shelter grant allocation) funds are utilized. Dade County will
provide the City of Miami Beach with information and documentation on this
issue.
8. Dade County will also be responsible for ensuring that all building standards
under 24 CFR 575.53, 575.55, 575.57, and 575.59(9) are fully adhered to, as per
the City's application to HUD for the Emergency Shelter Grant.
9. As per City of Miami Beach Resolution /187-19009, women and children of Miami
Beach, who have been displaced and made homeless by the closing of unsafe
buildings through code enforcement action or other City action, will be given
priority placement in the shelter for short-term stays, but such priority is
contingent upon the availability of space. The County will make every
reasonable effort to ensure that the women and children homeless population of
Miami Beach will be served by this facility, and that the minimum number served
will be based on the City's proportionate share of funds allocated for this facility
(See Attachment C).
10. Dade County will enter into an agreement with the Miami Mission Association,
Inc. for the implementation of this project and will ensure that the Mission will
be responsible/liable for all phases of the rehabilitation and operation of the
shelter. This includes obtaining Architect/Engineer selections and contracting,
as well as construction, in accordance with all pertinent federal, state and local
laws and regulations, et cetera, including applicable procurement procedures.
Dade County will be responsible for project monitoring.
11. In accordance with the requirements of the Emergency Shelter Grant Program
Agreement, Dade County will take all necessary steps to ensure that funds are
committed/obligated within one hundred eighty (180) days of the execution of
the Grant agreement(s). The date will be based on the earliest approval date
given by the U. S. Department of Housing and Urban Development to the City or
the County. (City's approval date would require commitment of funds by May 4,�
1988
for U.S. HUD's $33,000 award and by September 2, 1988 for U.S. HUD's
S5,000 award. )
12. Dade County will take all necessary steps to ensure that church and/or state
prohibitions, as defined by the U. S. Department of Housing and Urban
Development, are strictly adhered to.
13. Each governmental agency will be responsible for the preparation and submission
of its Annual Grantee Performance Report (GPR) for this project, on the
respective dates prescribed by the U.S. Department of Housing and Urban
Development.
