A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE ADMINISTRATION TO PUBLICLY BID THE SALE OF
THE CITY OWNED PROPERTY LOCATED AT 1749
JEFFERSON AVENUE, MIAMI BEACH, FLORIDA.
WHEREAS, at their meeting of May 21, 1997, the Mayor and City Commission he ld a
public hearing to consider the sale of the City-owned property located at 1749 Jefferson A vem e
(subject property) to Gary Davenport, the adjacent property owner; and
WHEREAS, during the public hearing, issues were raised as to whether the sale of tl e
subject property should be submitted for competitive bidding, as well as whether the City clm]:l
utilize it for a park or other municipal use; and
WHEREAS, it has been determined that based on the size of the subject property ani is
proximity to single family homes, it is not suitable for an active nor passive park; and
WHEREAS, it has also been determined that the subject property is no longer suitablt: f( r
any water and/or sewer system expansion or other public works related use; and
WHEREAS, because of the existing low-density residential community, converting t1 e
subject property into a municipal parking lot is not necessary, nor would it be in keeping witt. t1 e
character of the neighborhood; and
WHEREAS, the Administration has concluded that, based on the inappropriateness o]~ t1 e
subject property for the aforestatcd municipal uses, it would be in the City's best interest to solie.t
competitive bids for the sale of the subject property.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Administratic1n s
hereby authorized to publicly bid the sale of the City-owned property located at 1749 Jeffersc n
Avenue, Miami Beach, Florida.

Approve the Resolution.
BACKGROUND:
The City had previously been approached by Mr. Gary Davenport, the owner of the adjacer t
property at 1775 Jefferson A venue, whom requested to purchase the property. Mr. Davenport ha 1
recently sought to acquire the subject property in order to build a single.family residence wit 1
possible guest/servant quarters. Mr. Davenport had previously sought to acquire the site solely t )
construct an accessory swimming pool. The total area of all habitable improvements proposed b I
Mr. Davenport was not to exceed 4,200 square feet.
On May 21, 1997, the City Commission requested that the City Administration consider th.~
suitability of the City owned property, located at 1749 Jefferson Avenue, for a municipal use, an 1
to consider competitively bidding the purchase and sale of the property if it was concluded that n )
public use was viable
ANALYSIS
The issues were examined and reports were submitted by the Recreation, Culture and Park;
Department, and the Planning and Zoning Division. City records indicate that the lot is 9750 {6~ '
x 150') square feet in size. Based on the size of the lot and its adjacency to single family hone~ ,

it was determined not to be suitable for an active nor passive park. Furthermore, it was determinel
that the site was not suitable for a municipal parking lot, public works project, or any Olht r
municipal use (see Commission Memo No. R7F).
CONCLUSION:
Based on the inappropriateness of the for a municipal use the Administration recommend;
competitively bidding the sale of the property subject to, the existing deed restrictions, restric:in.~
the development to a single family home, and require a minimum bid of$155,750.
