RESOLUTION NO. 2019-30859 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING, BY 5/7TH VOTE OF THE CITY COMMISSION AND FOLLOWING A DULY NOTICED PUBLIC HEARING, THE GRANTING OF A WAIVER OF LAND DEVELOPMENT REGULATIONS, PURSUANT TO CITY CODE SECTION 142-425(D), FOR POLO PARK, LOCATED AT 4301 N MICHIGAN AVENUE, MIAMI BEACH, FLORIDA, IN ORDER TO WAIVE THE SINGLE FAMILY DISTRICT SETBACK REQUIREMENTS SET FORTH IN CITY CODE SECTION 142-106, IN ORDER TO CONSTRUCT A CONCRETE PAD WITH BLEACHERS, HIGHER BACKSTOP, FENCING, SAFETY NETTING AND ONE ADDITIONAL DUGOUT FOR THE BALL FIELD. WHEREAS, Polo Park, located at 4301 North Meridian Avenue, which is utilized by neighborhood residents, as well as by Nautilus Middle School, consists of a playground designed for children aged 2-10 years old, with a custom shade canopy, tennis and basketball courts, and a multiuse baseball field; and WHEREAS, in conjunction with the 2018 General Obligation Bond Program ("G.O."), a project has been approved to provide better use of the Polo Park facility and to increase its value from a programming standpoint; and WHEREAS, the proposed improvements to the baseball field will improve playing conditions, providing a better amenity for neighboring residents, as well as students who attend Nautilus Middle School, while also meeting the needs of the City's baseball programs; and WHEREAS, the project currently planned includes the following improvements: sod and other landscaping improvements throughout the park; irrigation improvements, including pump relocation; addition of clay and laser grading of baseball field; addition of water fountains; addition of benches, picnic tables and trash/recycling receptacles; addition of a concrete perimeter pathway; replacement of the current dugout along the third base line; addition of a concrete pad with bleacher behind the backstop; addition of a new dugout along the first base line; Installation of 10' high fencing along the first and third base lines; installation of 8' high safety netting along the first base line and the replacement of existing 14' backstop with an 18' backstop (the "Project") (Exhibit A); and WHEREAS, out of the aforestated project elements, the following require a setback waiver: addition of a concrete pad with bleacher behind the backstop; addition of a new dugout along the first base line; installation of 10' high fencing along the first and third base lines; installation of 8' high safety netting along the first base line and the replacement of existing 14' backstop with an 18' backstop; and WHEREAS, the Administration has determined that the above improvements, particularly those requiring a setback waiver, are important to improving the functionality and safety of the baseball field; and WHEREAS, the higher backstop, higher fence on first and third base line, and safety netting along the first base line are intended to protect players, other park users, and individuals who reside in the neighborhood from possible errant baseballs; and WHEREAS, the bleachers will provide a safe area for game spectators, as well as seating for others enjoying the park; and WHEREAS, the new dugout would provide a much needed amenity for team members to engage in an orderly and safe use of the field, and to remain protected from the elements; and WHEREAS, the waiver proposed herein will allow the Administration will be able to proceed with the Polo Park Project as planned; and WHEREAS, the Administration has worked closely with the Planning Department and the Nautilus Area Homeowners Association (NAHA) in developing the Project, and they are supportive of the project as presented. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve, by 517th vote and following a duly noticed public hearing, the granting of a waiver of land development regulations, pursuant to City Code Section 142-425(D), for Polo Park, located at 4301 N Michigan Avenue, Miami Beach, Florida, in order to waive the single family district setback requirements set forth in City Code Section 142-106, in order to construct a concrete pad with bleachers, higher backstop, fencing, safety netting and one additional dugout for the ball field. ANALYSIS Polo Park is located at 4301 North Meridian Avenue. The park consists of a playground designed for ages 2-10 years old, with a custom shade canopy, tennis and basketball courts, and a multiuse baseball field. The park is utilized by the residents as well as by Nautilus Middle School. A G.O.B. project has been approved for Polo Park, to provide better use of the facility and increase its value from a programming standpoint. The improvements to the baseball field will improve playing conditions, providing a better amenity for the middle school students and the community, while also meeting the needs of the City's baseball programs. The work currently planned as part of the Polo Park G.O.B.
