A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
SUBMISSION OF AN APPLICATION TO THE STATE OF
FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS
FOR A $2 .9 MILLION CAPITAL IMPROVEMENT
PROJECT GRANT FOR AN AREA INCLUDED WITHIN
SAFE NEIGHBORHOODS IMPROVEMENT DISTRICT NO. 1
AND WITHIN MIAMI BEACH'S ENTERPRISE ZONE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, THAT,
WHEREAS, Part IV of Chapter 163 of the Florida Statutes,
the Safe Neighborhoods Act, provides for the creation of Neighborhood
Improvement Districts, and provides each District with certain
powers; and
WHEREAS, the City Commission of the City of Miami Beach
provided, through Ordinance No. 88-2605 enacted on April 6, 1988, for
the creation of Safe Neighborhood Improvement Districts within the
city; and
WHEREAS, the City Commission of the City of Miami Beach
created, through Ordinance No. 88-2606, Safe Neighborhood Improvement
District No. 1; and
WHEREAS, the City of Miami Beach' s Enterprize Zone,
designated EZ-1415, covers an area entirely included within Safe
Neighborhoods Improvement District No. 1; and
WHEREAS, Subsection 163 . 521 of the Safe Neighborhoods
Act authorizes local governments of Neighborhood Improvement
Districts which also fall within the boundaries of a State Enterprise
Zone, to request funding from the Legislature for 100% of proposed
capital improvements within the area of overlap, provided that the
project area does not exceed 25% of the area covered by the State
Enterprise Zone; and
WHEREAS, the City of Miami Beach has prepared an
Application for $2 .9 million to fund a "Streetscape and Pilot Blocks
Capital Improvement Project" ; and
WHEREAS, the funding being requested for this project
meets the above requirements; and
WHEREAS, the Advisory Board to Safe Neighborhoods
District No. 1 has recommended to the City Commission that said
Application be submitted to the State' s Department of Community
Affairs; and
WHEREAS, the State Department of Community Affairs will
include said Application in its own budget request to the
Legislature, immediately upon receipt; and
WHEREAS, in order for the Legislature to evaluate the
budget request and Application, it must receive the appropriate
documentation in time for its annual budget deliberations; and
WHEREAS, the City Commission deems it to be in the best
interests of the City and its residents and citizens that said
Application be submitted;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the
Administration is authorized to submit to the State Department of
Community Affairs an application for a $2 . 9 million "Streetscape and
Pilot Blocks Capital Improvement Project" .

ZONE.
BACKGROUND
Subsection 163 . 521 of the Safe Neighborhoods Act authorizes local
governments of Neighborhood Improvement Districts which also fall
within the boundaries of a State Enterprise Zone, to request funding
from the Legislature for 100% of proposed capital improvements within
the area of overlap, provided that the project area does not exceed
25% of the area covered by the State Enterprise Zone.
Part IV of Chapter 163 of the Florida Statutes, the Safe
Neighborhoods Act, provides for the creation of Neighborhood
Improvement Districts, and provides each District with certain
powers. In pursuit of a planning grant, the City Commission of the
City of Miami Beach provided, through Ordinance No. 88-2605 enacted
on April 6, 1988 , for the creation of Safe Neighborhood Improvement
Districts within the city, and created, through Ordinance No. 88-
2606, Neighborhood Improvement District No. 1.
The City of Miami Beach' s Enterprize Zone, designated EZ-1415, covers
an area entirely included within Safe Neighborhoods Improvement
District No. 1.
In order to benefit from these statutory provisions, the City of
Miami Beach has prepared an Application for $2 . 9 million to fund a
"Streetscape and Pilot Blocks Capital Improvement Project" . The
funding being requested for this project meets the above requirement.
The Advisory Board to Safe Neighborhoods District No. 1, at its
meeting of January 9 , 1989, recommended to the City Commission that
said Application be submitted to the State 's Department of Community
Affairs.
It is our understanding that the State Department of Community
Affairs will include said Application in its own budget request to
the Legislature, immediately upon receipt. In order for the
Legislature to evaluate the request, it must receive the
documentation in time for its annual budget deliberations.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the $2 . 9 million "Streetscape and
Pilot Blocks Capital Improvements Project" application be submitted
to the State Department of Community Affairs, under the provisions,--
of Subsection 163 . 521 of the Florida Statutes.
