RESOLUTION 89-19579 RESOLUTION NO. 89-19579 A RESOLUTION OF THE CITY OF MIAMI BEACH,FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER A RECOMMENDATION OF THE PLANNING BOARD FOR A CHANGE OF ZONING FROM CPS-2 (GENERAL MIXED-USE COMMERCIAL) TO CPS-4 (INTENSIVE MIXED-USE PHASED BAYSIDE COMMERCIAL)FOR PROPERTY LOCATED AT 540 WEST AVENUE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, the Planning Board of the City of Miami Beach held a public hearing on March 28, 1989 and recommended approval of a Change of Zoning from the CPS-2 (General Mixed- Use Commercial) District to the CPS-4 (Intensive Mixed-Use Phased Bayside Commercial) District, as said Districts are defined and set forth in Ordinance No. 1891. for the property described as follows (540 West Avenue), Parcel One: Lots 26 and 27, Amended Plat of Aquarium Site Subdivision, according to the Plat thereof, as recorded in Plat Book 16, at Page 67 of the Public Records of Dade County, Florida. Also shown on the Amended Plat of Aquarium Site Re-Subdivision according to the Plat thereof, as recorded in Plat Book 21, Page 83 of the Public Records of Dade County, Florida; and Parcel Two: Lots 1 and 2, in Block 1, of Fleetwood, according to the Plat thereof, as recorded in Plat Book 14, at Page 60 of the Public Records of Dade County, Florida. Together with the outlot so-called being a parcel of land bounded on the northerly side by the Southerly line of said Lot 1 above referred to, on the southerly side by the northerly line of said Lot 27, above referred to, on the Westerly side by Biscayne Bay, and on the easterly side by the westerly line of West Avenue, as modified to correspond to the land area contained in the overall site plan as submitted on Sheet 2 of the plans drawn by Goldenholtz and Fisher Architects, dated March 27, 1989, WHEREAS, said action of the Planning Board has been duly transmitted to the City Commission pursuant to Section 17, Changes and Amendments to Zoning Ordinance No. 1891. NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing for consideration of the aforementioned Change of Zoning is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, beginning at 11: 15 ru..m.on the 10th day of May , 1989, and the City Clerk is hereby authorized and directed to publish in a newspaper of general circulation of the City of Miami Beach, at which time and place all interested parties will be heard.
