A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH AUTHORIZING
THE DIRECTOR OF PARKS & RECREATION AND THE DIRECTOR OF THE BASS MUSEUM TO
EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MIAMI BEACH
PARKS & RECREATION DEPARTMENT AND THE CITY OF MIAMI BEACH BASS MUSEUM FOR
THE PURPOSE OF PROVIDING AN ART SCHOOL, OFFICE SPACE FOR THE MUSEUM
DEVELOPMENT STAFF AND STORAGE SPACE AT THE 21st STREET RECREATION CENTER.
WHEREAS, the City has determined that it would be in its best interest to
enter into a Memorandum of Understanding between the Parks & Recreation
Department and the Bass Museum for the purpose of providing an art school,
office space for the museum development staff and storage at the 21st Street
Recreation Center so as to more fully utilize the facility.
WHEREAS, the Bass Museum desires to obtain from the Parks & Recreation
Department the privilege of operating an art school, development staff offices
and storage facilities at the 21st Street Recreation Center as described in the
Memorandum of Understanding attached hereto, and the Parks & Recreation
Department desires to enter into a Memorandum of Understanding with the Bass
Museum for operation of said activities.
WHEREAS, the Memorandum of Understanding and the Bass Museum's use of the
21st Street Recreation Center is to be temporary in nature and shall be in
effect no longer than two (2) years after the date of execution.
WHEREAS, the Bass Museum Board of Trustees has reviewed and has recommended
execution of the Memorandum of Understanding.
WHEREAS, the City Manager has recommended execution of the Memorandum of
Understanding and the City Attorney has approved it as to form.
NOW THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH that the Director of Parks & Recreation and the Director of Life sass
Museum have been authorized to execute a Memorandum of Understanding between the
Parks & Recreation Department and the Bass Museum for the purpose of providing
an art school, office space for the museum development staff and storage
facilities at the 21st Street Community Center for a period not to exceed two
(2) years after the date of execution.

SUBJECT: MEMORANDUM OF UNDERSTANDING REGARDING RENTAL OF SPACE AT THE
21st STREET RECREATION CENTER TO THE BASS MUSEUM
Pursuant to our discussions on the above subject matter, the Parks &
Recreation Department would be pleased to make space available at the
21st Street Recreation Center under the following terms and
conditions.
1. That the Bass Museum be permitted to rent space at the Center on
a temporary basis for the purpose of operating a museum art
school, office space for the museum development staff and
temporary storage space for museum equipment (excluding any part
of the Museum art collection).
2. That the Bass Museum have utilization of the following square
footage and pay the Parks & Recreation Department the enumerated
compensation for same for each fiscal year that this agreement is
in effect:
CLUB HOUSE/MUSEUM SCHOOL
Rental 2,372 square feet x 4.75 = $11,267.00
Utilities 2,372 square feet x 1.50 = $3,558.00
SUB-TOTAL $14,825.00
RECREATION CENTER/OFFICE & STORAGE
Rental 1,000 square feet x 4.75 = $4,750.00
Utilities 1,000 square feet x 1.50 = $1,500.00
SUB-TOTAL $6,250.00
TOTAL RENT $21,075.00
Payments will be made to the City of Miami Beach, Parks &
Recreation Department on a monthly basic in the amount of
$1,756.12 and will be received no later than the 15th of the
month.
3. The Bass Museum will be permitted to perform the following
renovations to the facility at its sole cost and expense:
CLUB HOUSE/MUSEUM SCHOOL
Carpeting of wood floor $1,020.00
Fencing $1,695.00
SUB-TOTAL $2,715.00
RECREATION CENTER/OFFICE & STORAGE
Office partitions $3,651.34
SUB-TOTAL $3,651.34
TOTAL RENOVATIONS $6,366.34
4. The Bass Museum agrees to perform all custodial services required
to maintain the above outlined areas during the full term of this
agreement together with any repairs resulting from the negligence
or misuse of the facility by its agents or patrons. All other
building maintenance functions not the result of negligence or
misuse on the part of the Bass Museum its agents or patrons will
be the responsibility of the Parks & Recreation Department.
5. The Bass Museum agrees that no further renovations, other than
those outlined above, will take place at this facility without
the prior written approval and authorization of the Parks &
Recreation Director.
6. The Bass Museum will have exclusive use of both the Men's and
Ladies restrooms facilities in the Recreation Center during day
time hours. Custodial services for these facilities will be the
responsibility of the Bass Museum except in cases when said
facilities are utilized for night time programs sponsored by the
Parks & Recreation Department.
7. The Bass Museum will be responsible for insuring that their
utilization of the Club House facility is in compliance with all
C.D.B.G. rules and regulations as it effect same.
8. At the termination of this agreement, the Bass Museum agrees to
return the site to its original condition at its sole expense not
withstanding normal wear and tear.
It is mutually agreed that this agreement will become effective on
June 1, 1989 and be in effect for a period not to exceed two (2)
years after said date.
Further, it is mutually agreed that all terms, conditions and
execution of this agreement is subject to Commission approval and
without said approval no agreement will be in effect.
If the above outlined agreement meets with your approval, please sign
and return same to my office for final execution.
