A RESOLUTION AUTHORIZING THE EXECUTION OF LEASE AGREEMENT
WITH ORIGINAL 5TH STREET PROPERTIES, INC. , FOR USE OF
NORTHEAST CORNER OF FOURTH STREET AND ALTON ROAD FOR A
ONE-YEAR PERIOD
WHEREAS, the City of Miami Beach is the owner of the property
located at the northeast corner of Fourth Street and Alton Road,
which is more particularly described as follows:
Lots 1, 2 , 3, and 4, OCEAN BEACH ADDITION NO. 3
RESUBDIVISION, according to plat thereof as
recorded in Plat Book 26 at Page 62 of the
Public Records of Dade County, Florida; and
WHEREAS, Original 5th Street Properties, Inc. is the owner of
the property adjoining to the City property referenced above; and
WHEREAS, the City Commission of the City of Miami Beach, at
its meeting on May 10, 1989 , received and approved the report of
the Land Use Committee, which recommended that the City take
necessary steps to declare surplus certain City property at 4th
Street and Alton Road; and
WHEREAS, the City Commission further approved the
recommendation of the Land Use Committee that the City negotiate
a development agreement for said City property at the northeast
corner of 4th Street and Alton Road with Mr. Alan Cohen,
representing Original 5th Street Properties, Inc. for sale and
development of the property; and
WHEREAS, Original 5th Street Properties, Inc. is desirous
of leasing the referenced City property and obtaining a permit for
the alleyway for the purpose of constructing and operating an
improved parking area for a one year term; and
WHEREAS, a lease agreement has been prepared by the City
Manager and approved as to form by the City Attorney; and
WHEREAS, a monthly rental in the amount of $424 . 00 per month,
including tax, or $5, 088 . 00 per annum, has been agreed upon; and
WHEREAS, the lease contains a thirty (30) day cancellation
clause, thus enabling the City to make other use of the property
within a short period of time; and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk
be authorized and directed to execute the above described lease
agreement on behalf of the City, and that the City Manager is
hereby authorized and directed to carry into effect the terms and
provisions undertaken therein by the City.

LEASE AG' EM NT WITH ORIGINAL 5TH STREET PROPERTY, INC.
SUBJECT: FOR CITY-• "NED VACANT PROPERTY AT FOURTH STREET AND ALTON
ROAD
BACKGROUND INFORMATION:
Four vacant lots of City property at 4th Street and Alton Road,
representing 10, 250 square feet of useable land are currently not
being utilized by the City. Adjacent land use is zoned CPS-2
(General Mixed-Use Commercial) .
At its meeting on May 10, 1989 , the City Commission received and
approved the report of the Land Use Committee, which recommended
that the City take necessary steps to declare surplus the
referenced City property. Concurrently, the City Commission
approved the recommendation of the Land Use Committee that the City
negotiate a development agreement for the referenced property with
the owner of the adjoining property, Mr. Alan Cohen of Original 5th
Street Properties, Inc. This agreement will facilitate the
redevelopment of the entire block (Block 103) .
As an interim measure, the proposed lease agreement provides for
the establishment of additional temporary parking until the
development agreement is complete.
The term of this lease will be for one (1) year, with a 30-day
cancellation clause by either party. In addition, the lessee is
required to meet all City insurance requirements.
Proposed lease payments to the City are $424 . 00 per month,
including Florida Sales Tax for all four (4) 25-foot lots.
ADMINISTRATION RECOMMENDATION:
The City Administration recommends that the City Commission approve
a resolution authorizing the Mayor and the City Clerk to execute
the proposed lease agreement between the City of Miami Beach and
Original 5th Street Properties, Inc. for the purpose of providing
vehicular parking on vacant City-owned property.
