RESOLUTION 89-19665 RESOLUTION NO. 89-19665 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT OF THE RIGHT-OF-WAY, INCLUDING AIR RIGHTS, OVER THE NORTHERLY PORTION OF TWENTY- NINTH (29TH) STREET FROM COLLINS AVENUE EAST TO MIAMI BEACH DRIVE COMMENCING AT A HORIZONTAL PLANE 30 FEET VERTICAL FROM +7.0' ELEVATION U.S.E.D. BAY DATUM, LOCATED IN MIAMI BEACH IMPROVEMENT COMPANY'S OCEAN FRONT PROPERTY SUBDIVISION, AS RECORDED IN PLAT BOOK 5, PAGE 7 & 8, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, the Plat of Miami Beach Improvement Company' s Ocean Front Property Subdivision was approved and recorded in Plat Book 5, Page 7 & 8, of the Public Records of Dade County, Florida; and WHEREAS, lying in said plat is the public right-of-way known as Twenty-ninth (29th) Street from Collins Avenue east to Miami Beach Drive including air rights, located in Miami Beach Improvement Company' s Ocean Front Property Subdivision, as recorded in Plat Book 5, Page 7 & 8, of the Public Records of Dade County, Florida; and WHEREAS, the Miami Beach City Commission has provided notice of these proceedings to the public; and WHEREAS, the Miami Beach City Commission has met to determine whether abandonment of the right-of-way, including air rights, over the northerly portion of Twenty-ninth (29th) Street from Collins Avenue east to Miami Beach Drive commencing at a horizontal plane 30 feet vertical from +7.0' elevation U.S.E.D. bay datum, located in Miami Beach Improvement Company' s Ocean Front Property Subdivision, as recorded in Plat Book 5, Page 7 & 8, of the Public Records of Dade County, Florida would be in the best interest of the general public welfare; and WHEREAS, the Miami Beach City Commission has made the following determinations: 1. The public right-of-way, including air rights, over the northerly portion of Twenty-ninth (29th) Street from Collins Avenue east to Miami Beach Drive, as more fully described in Exhibit "A- 3" attached hereto, commencing at a horizontal plane 30 feet vertical from +7.0' elevation U.S.E.D. bay datum, located in Miami 1 Beach Improvement Company's Ocean Front Property Subdivision, as recorded in Plat Book 5, Page 7 & 8, of the Public Records of Dade County, Florida, are part of the City of Miami Beach road system and, as such, the City of Miami Beach holds this property in trust for the benefit of the public. 2 . The City does not now have any need, nor does it anticipate any future need for use of the right-of-way above 30 feet for municipal or public purposes. 3 . The City of Miami Beach City Commission, is duly vested with the authority to abandon the above referenced air rights above the public right-of-way. 4 . The abandonment of the right-of-way, including air rights, over the northerly portion of Twenty-ninth (29th) Street from Collins Avenue east to Miami Beach Drive commencing at a horizontal plane 30 feet vertical from +7.0' elevation U.S.E.D. bay datum, located in Miami Beach Improvement Company's Ocean Front Property Subdivision, as recorded in Plat Book 5, Page 7 & 8 , of the Public Records of Dade County, Florida, is found to be in the best interest of the general public welfare; and WHEREAS, after due consideration of all of the facts and circumstances, the City Commission of the City of Miami Beach finds it to be in the best interest of the general public welfare to abandon, and disclaim any and all right, title and interest in the following described property above the public right-of-way in Miami Beach Improvement Company's Ocean Front Property Subdivision and depicted in Exhibit A attached hereto: THE RIGHT-OF-WAY, INCLUDING AIR RIGHTS, OVER THE PROPERTY DESCRIBED IN EXHIBIT "A-3" ATTACHED HERETO COMMENCING AT A HORIZONTAL PLANE 30 FEET VERTICAL FROM +7.0' ELEVATION U.S.E.D. BAY DATUM. NOW THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami Beach does hereby abandon and disclaim all of the public's right, title and interest in and to the following described property above the public right-of-way in Miami Beach Improvement Company' s Ocean Front Property Subdivision and depicted in Exhibit "A-3" attached hereto: 2 THE RIGHT—OF—WAY, INCLUDING AIR RIGHTS, OVER THE PROPERTY DESCRIBED IN EXHIBIT "A-3" ATTACHED HERETO COMMENCING AT A HORIZONTAL PLANE 30 FEET VERTICAL FROM +7.0' ELEVATION U.S.E.D. There is a request by Mr. Bruce E. Lazar, Attorney for the current owners of the 100' diameter circle and all of Block 11 of Miami Beach Improvement Company's Ocean Front Property Subdivision, that the Mayor and City Commission consider the City's abandonment of air rights over the northerly portion of 29th Street from Collins Avenue east to Miami Beach Drive as described above in Miami Beach Improvement Company's Ocean Front Property Subdivision, as recorded in Plat Book 5, Pages 7 & 8, of the Public Records of Dade County, Florida. The Public Works Department has reviewed the request and has no objection to the abandonment of air rights subject to retaining a clear 30 foot high corridor, 30 foot vertical from the existing street grade at any point along the north side of 29 Street to the commencement of the area of air rights abandonment. ADMINISTRATION RECOMMENDATION: The City Administration recommends that the Mayor and the City Commission adopt the attached resolution calling for the abandonment of air rights of the above described right-of-way.
