A RESOLUTION CALLING FOR A SPECIAL ELECTION TO
BE HELD ON NOVEMBER 7 , 1989 FOR THE PURPOSE OF
SUBMITTING TO THE ELECTORATE OF THE CITY OF
MIAMI BEACH FOR THEIR APPROVAL OR DISAPPROVAL
AN AMENDMENT TO SECTION 28 1/2 OF THE MIAMI
BEACH CITY CHARTER AND TO SECTION 100 OF THE
CITY'S RELATED LAWS REGARDING ADMINISTRATION
OF THE LIFE INSURANCE AND HEALTH PLANS FOR CITY
OFFICERS AND EMPLOYEES, SAID AMENDMENT TO
PROVIDE FOR ADMINISTRATION THEREOF BY THE CITY
MANAGER AND OR HIS DESIGNEE (S) RATHER THAN THE
CITY OF MIAMI BEACH BOARD OF TRUSTEES OF THE
EMPLOYEES RETIREMENT SYSTEM.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH:
SECTION 1.
In accordance with provisions of the Charter of the City of Miami
Beach, Florida and the general laws of the State of Florida, a Special
Election is hereby called and directed to be held in the City of Miami
Beach, Florida, from 7 : 00 a.m. to 7 : 00 p.m. on November 7 , 1989 for the
purpose of submitting to the electorate the question as set forth
hereinafter.
SECTION 2 .
That the appropriate and proper Dade County election officials
shall conduct the said Special Election hereby called, except for the
certification of the results of said Special Election, which duty shall
be performed by the City Commission. The official returns for each
precinct shall be furnished to the City Clerk of the City of Miami Beach
as soon as the ballots from all precincts have been tabulated on the
night of said Special Election.
SECTION 3.
Said voting precincts in the City of said Special Election shall
be as established by the proper and appropriate Dade County Election
Officials. All electors shall vote at the polling places and the voting
precincts in which the OFFICIAL REGISTRATION BOOKS show that the said
electors reside. A list of the voting precincts and the polling places
therein (subject to change by the Supervisor of Elections of Dade
County, in accordance with the laws of Florida) is attached hereto as
Exhibit A.
SECTION 4.
Registration of persons desiring to vote in the Special Election
shall be in accordance with the general laws of the State of Florida
governing voter registration. Qualified persons may register to vote
at the City registration office located in the lobby of City Hall, 1700
Convention Center Drive, Miami Beach, Florida 33139, each and every
Wednesday until October 3 , 1989, between the hours of 9 : 00 a.m. and 4 : 30
p.m. , and at such other voter registration centers and during such times
as may be provided by the Supervisor of Elections of Dade County. All

questions concerning voter registration should be directed to the Dade
County Elections Office, 111 N.W. 1st Street, Floor 19 , Miami, Florida

SECTION 5.
Copies of the proposed amendment to the Miami Beach City Related
Laws shall be made available to the electors at the office of the City
Clerk from 9 : 00 a.m. to 5: 00 p.m. each day, Saturdays, Sundays, and
holidays excepted, not later than thirty days prior to the date of said
election.
SECTION 6.
Not less than thirty days ' notice of said Special Election shall
be given by publication in a newspaper of general circulation in Miami
Beach, Dade County, Florida. Such publication shall be made at least
once each week for four consecutive weeks next preceding said Special
Election.
SECTION 7 .
The notice of election shall be substantially in the following
form:

SUBMITTED TO THE DULY REGISTERED AND QUALIFIED
VOTERS OF THE CITY OF MIAMI BEACH THE FOLLOWING
QUESTION:

SECTION 9.
Absentee voters participating in said Special Election shall be
entitled to cast their ballots in accordance with the provisions of the
laws of the State of Florida with respect to absentee voting.
SECTION 10.
That the City of Miami Beach shall pay all expenses for
conducting this Special Election and will pay to Dade County or directly
to all persons or firms, upon receipt of invoice or statement approved
by the Supervisor of Elections of Dade County, Florida.
SECTION 11.
This resolution shall be effective immediately upon its passage.

ADMINISTRATION OF LIFE INSURANCE AND HEALTH PLANS
FOR CITY OFFICERS AND EMPLOYEES.
City of Miami Beach Charter §28 1/2. Group life insurance plan for city
officers and employees.
The city commission of the City of Miami Beach shall have power and
authority to establish by ordinance a group life insurance plan for the
officers and employees of said city on a contributory basis with the
city bearing not more than one-half of the cost.

or his designee(s) and said bee.rd city manager or his designee(s) shall
have full power and authority to enter into contractual obligations with
insurance carriers authorized to do business in the State of Florida,
or by establishing a self-administered plan or by a combination thereof;
and to establish rates of costs based on actuarial analyses subject to
approval by the city commission, the coverage of which shall be fixed
by ordinance and shall not exceed two thousand dollars.
All regular employees and officers, at the effective date of such
insurance plan may elect, within a reasonable time to be fixed by
ordinance, in which to elect membership in the plan and, after said
effective date, every officer or employee, upon becoming a regular
employee, shall automatically become a member thereof and once
membership is attained it shall be continued throughout the period of
employment by the city and the plan by special provisions, may provide
for continuance of membership by employees who are retired under any
city pension system.
Notwithstanding anything herein to the contrary, all unclassified city
employees upon their first day of employment, and all classified
employees upon having been continuously employed for ninety days, shall
be eligible to become members of the city's group insurance plan.

SUBJECT: AMENDMEN TO HEALTH AND LIFE INSURANCE PLANS FOR OFFICERS
AND EMPLOYEES
It is hereby recommended that the appropriate amendments be made to
Section 283 of the City of Miami Beach Charter and Section 100 of the City
of Miami Beach Related Laws in order to provide for a more effective
administration of the City's health and life insurance plans.
Traditionally, the City had only two pension plans, the Police and Firemen's
Plan and the General Employees Plan, with administrative responsibilities for
the health and life insurance assigned to the General Employees governing
board. With the establishment of the City's third pension plan, the
Unclassified and Elected Officials Retirement System, it is felt that
jurisdiction for the health and life insurance should not rest with any one
governing board, but, rather, should be an administrative responsibility with
recommendations offered by the City Manager. or his designee(s) to the City
Commission. The final determination for any changes or amendments in
either plan would remain, as in the past, with the City Commission.
Since the amendments require changes to the City Charter and Related Laws,
- a referendum vote is necessary before said amendments may be implemented.
Accordingly, attached hereto, is the appropriate resolution calling for a
• special election regarding the subject referendum question. The proposed
changes are incorporated in the text, also attached hereto.

Adopt the Resolution calling for a special election to amend Section 283 of
the Miami Beach City Charter and Section 100 of the City's Related Laws
regarding administration of the health and life insurance plans for City
officers and employees.
