RESOLUTION 89-19734 RESOLUTION NO. 89-19734 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A SECOND AMENDED AND RESTATED CAFETERIA PLAN WHICH EXTENDS THE CAFETERIA PLAN COVERAGE TO POLICE OFFICERS HEALTH INSURANCE COSTS AND TO ADD PROVISIONS TO COMPLY WITH SECTION 89 OF THE INTERNAL REVENUE CODE OF 1986. WHEREAS, the City of Miami Beach has in effect for its employees a Cafeteria Plan, as provided for in Section 125 of the Internal Revenue Code of 1986, as amended; and WHEREAS, the City is desirous of extending the full benefits of that Plan to its police officers so long as the health insurance costs of the police officers may be paid directly by the City by payroll deductions; and WHEREAS, the Second Amended and Restated Cafeteria Plan in the form attached satisfies the requirements of Sections 89 and 125 of the Internal Revenue Code of 1986, as amended, and the objectives of the City; and WHEREAS, the City Commission of the City of Miami Beach is familiar with the provisions of said Second Amended Cafeteria Plan; NOW, THEREFORE, BE 1T DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT the Second Amended and Restated Cafeteria Plan be and the same is hereby adopted by the City Commission; that the Mayor and City Clerk be and they are hereby authorized and directed to execute said Second Amended and Restated Cafeteria Plan in the name of and on behalf of the City. Par s •IA0 I/� City Manager SUBJECT: SECOND AMEND L I AND RESTATED CITY OF MIAMI BEACH CAFETERIA PLAN In September, 1988, the City Commission adopted a Resolution providing for the creation of a Cafeteria Plan of flexible benefits for City of Miami Beach employees. The Plan, as created, was in accordance with Section 125 of the Internal Revenue Code of 1986. In March of 1989, the City Commission approved the First Amended and Restated Cafeteria Plan in order for the City to provide similar flexible benefits to employees covered by the Firefighters Health Insurance Trust Fund. It is now recommended that the Plan be amended and restated again in order for the City to provide the same flexible benefits, without any penalties, to employees who might be covered by a Police Insurance Trust Fund. Additionally, minor changes, in order to comply with Section 89 amendments to the Internal Revenue Code, have been included in the proposed amended and restated Plan. RECOMMENDATION: Adopt the Resolution amending and restating the City of Miami Beach Cafeteria Plan.
