RESOLUTION 89-19762 RESOLUTION No. 89- 19762 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR TO EXECUTE, ON BEHALF OF THE CITY, AN AMENDMENT TO THE LEASE AGREEMENT WITH DERR INVESTMENTS, INC. , A FLORIDA CORPORATION, FOR 120 METERED PARKING SPACES IN THE CITY'S MUNICIPAL PARKING LOT 2A BETWEEN 6:00 P.M. AND 6:00 A.M. FOR DERR INVESTMENTS, INC. , VALET PARKING SERVICES D/B/A CONTINENTAL PARKING. WHEREAS, the City Commission of the City of Miami Beach passed Resolution No. 88-19334 on September 7, 1988 authorizing the Mayor to enter into an agreement for rental of parking spaces; and WHEREAS, Paragraph 11 provides for the renegotiation of the rate applied to the rental of such meters; and WHEREAS, the Administration has determined that a $1 .00 per meter per month increase is required to cover the costs for the additional servicing required in this facility. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor be and the same is hereby duly authorized by the City Commission of the City of Miami Beach, Florida, to execute, on behalf of the City, the attached Amendment No. 1 to the Lease Agreement between the City of Miami Beach and Derr Investments, Inc. , a Florida corporation, attached hereto. Parki lir iv ' City Manager p /AO SUBJECT: AMENDMENT No. 1 TO THE LEASE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND DERR INVESTMENTS, INC. , A FLORIDA CORPORATION, REVISING THE RATE STRUCTURE APPLIED TO THE EXISTING CONTRACT FOR RENTAL OF 120 PARKING SPACES IN MUNICIPAL PARKING LOT 2A. The attached resolution authorizes the Mayor to execute, on behalf of the City, an amendment to a Lease Agreement between the City of Miami Beach and Derr Investments, Inc. , d/b/a Club Deco's, for the rental of 120 metered parking spaces in the City's Municipal Parking Lot 2A. The original agreement was accepted by both parties and was adopted by Resolution 88-19334 on September 7, 1988. Paragraph 11 of the Agreement allows for an amendment to the rate which is applied to the rental of these meters. After evaluating the usage level , the average return on the meters, and the additional servicing necessary in the facility, it was determined that a $1 .00 per meter per month increase is necessary. This amounts to an approximate 20% increase in the rate charged to the Lessee or $1,440.00 per year. The Parking Department has spoken with Edgar Moreau, the President and principle owner of Club Deco's and Derr Investments, Inc. He has agreed to the rate increase. Upon adoption of the Resolution and respective- execution of the Amendment No. 1 of the Lease Agreement, this rate increase will become effective November 1, 1989. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt the attached resolution authorizing the Mayor and City Clerk to amend the existing Lease Agreement between the City and Derr Investments, Inc. , for the rental of 120 metered par ' g spaces in Municipal Parking Lot 2A with an effective date of November , 1 89. ,.�M. .pc # 5 AGENDA (2 . 6 ITEM DATE 10 -4— AMENDMENT No. 1 TO THE LEASE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND DERR INVESTMENTS, INC. , A FLORIDA CORPORATION, REVISING THE RATE STRUCTURE APPLIED TO THE EXISTING CONTRACT FOR RENTAL OF 120 PARKING SPACES IN MUNICIPAL PARKING LOT 2A. THIS AMENDMENT TO THE AGREEMENT is made and entered into this 30th day of November, 1989, by and between the City of Miami Beach, as Lessor (hereafter referred to as "Lessor" or "City") and Derr Investments, Inc. , as Lessee (hereafter referred to as "Lessee" or "Derr") . PREAMBLE: Pursuant to a Lease Agreement between the City and Lessee, executed and dated September 22, 1988, (the "Lease Agreement"), the Lessee obtained from the City permission to lease 120 parking spaces in the Municipal Parking Lot (2A) located at 12th Street and Washington Avenue, during the hours of 6:00 PM and 6:00 AM daily. The Lease Agreement with the Lessee provided for financial compensation to the City for the rental of these spaces at a rate of $5.00 per space per month or an annual fee of $7,200.00. The lease Agreement, as defined in Paragraph 11, provides for the election to renegotiate the lease rate by providing thirty (30) days written notice prior to the end of any annual term, without prejudicing its rights otherwise hereunder. The paragraph also provides for the renegotiated rates to take effect by written addendum to the lease executed by both parties. NOW, THEREFORE, in consideration of the premises and other good and valuable consideration, the parties agree as follows: 1. Recitals: the foregoing recitals are true and correct. 2. Paragraph 3 of the Lease Agreement shall be amended to read as follows: paragraph 3: The lease rate for these parking spaces shall be $6.00 per space per month, which for 120 spaces totals $720.00 per month. 3. Ratification: Except as herein modified, all of the terms and provisions of the Lease Agreement are hereby ratified and confirmed.
