A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
EXECUTION OF AN AGREEMENT WITH FRANCES KATZ,
FOR THE RETENTION OF HER SERVICES AS A HUMAN
SERVICES WORKER FOR THE CITY OF MIAMI BEACH
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, THAT,
WHEREAS, the City of Miami Beach has determined that it
is necessary to employ the professional services of a part-time
Human Services Worker for the City of Miami Beach; and
WHEREAS, the City has budgeted funds through the City' s
General Fund for compensation of said Human Services Worker; and
WHEREAS, the City Manager shall recommend to the City
Commission that the City enter into an Agreement with Frances Katz
for a one-year term beginning October 1, 1989 and ending September
30, 1990, to be paid on a bi-weekly basis for a maximum of 20 hours
per week, at the rate of $9 . 90 per hour; providing that aforesaid
individual provides certain social services for the City of Miami
Beach, as per agreement; and
WHEREAS, the City Commission, being familiar with the
provisions of said Agreement, deems it to be in the best interests
of the City and its citizens and residents to enter into said
Agreement;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Clerk be and they are hereby authorized and directed to
execute said Agreement with Frances Katz in the name of and on
behalf of the City, and that the disbursing officers of the City
be and they are hereby authorized and directed to disburse the
monies required by the terms of said Agreement from funds of the
City available for said purpose.

AGREEMENT
This Agreement, made and entered into this 1st day of October
1989 , by and between the City of Miami Beach, a Florida municipal
corporation, hereinafter referred to as the "City" and FRANCES
RATE, hereinafter referred to as "Contractor".
WITNESSETH:
WHEREAS, the City desires to employ the professional services
of a part-time Human Services Worker for the City of Miami Beach,
for a one (1) year period, from October 1, 1989 up to and including
September 30, 1990; and
WHEREAS, the City has budgeted funds for the compensation of
said Human Services Worker; and
WHEREAS, the Contractor is desirous of rendering services to
the City, as hereinafter set forth, as said Human Services Worker;
NOW THEREFORE, for in consideration of the promises and the
mutual covenants and agreements contained herein, the parties agree
as follows:
1. The term of this Agreement shall be for the one (1) year
period starting October 1, 1989 through September 30, 1990.
2. The Contractor will be identified as Human Services Worker and
will be paid bi-weekly for a maximum of 20 hours per week, at
the rate of $9.90 per hour. This will be considered a part-
time position. The Contractor will report to the Assistant
Economic and Community Development Director or the Assistant
Director's Designee, who is considered to be the Contractor's
immediate supervisor.
3 . The Contractor shall be entitled to receive 88 hours of Annual
Leave and 48 hours of Sick Leave. Said time shall be accrued
in the following manner: On the last day of each month for
the first ten (10) months of this Agreement, October through
July, the Contractor will accrue 8 .8 hours of Annual Leave and
4 . 8 hours of Sick Leave, up to the total of 88 hours of Annual
Leave and 48 hours of Sick Leave. The Contractor shall also
en entitled to receive pay for the holidays customarily
celebrated by the City; provided, however, that the Contractor
shall not be paid in excess of 20 hours in any given week.
The Contractor will also abide by the City Work Rules with
regards to all time off. It is further agreed by both parties
that any additional time off shall be at the expense of the
Contractor and at the convenience of the City.
4 . It is agreed by the parties that the City shall have the right
to cancel this entire Agreement or any part hereof upon
failure of the Contractor to meet any of the requirements set
forth herein.
5. In the event of injury, illness, or any other cause which
prevents the Contractor from meeting any of the requirements
set forth herein, the City Manager of Miami Beach shall notify
the Contractor by certified mail at her last known address,
that employment with the City is terminated and shall replace
said Contractor with the approval and consent of the Miami
Beach City Commission.
6. The City agrees to make available office space in which the
Contractor will be able to carry out the services, duties, and
responsibilities as hereinafter set forth during the term of
the Agreement.
7. The Contractor shall provide the following services for the
City:
a. Operate programs such as Medication/Prosthetic Devices,
the Miami Beach Assistance Program, referral services to
other agencies, as well as any other programs that the
City may operate. The Contractor shall follow all
procedures and requirements, set forth in the Standard
Criteria for Operations, for determining client
eligibility and project monitoring. It is further
understood by the Contractor that the eligibility and
reporting requirements may not be the same for all of the
programs and that due care shall be exercised when
preparing all reports.
b. Interview those persons who are in need of, and
requesting, some type of assistance. These needs are to
be either social, economic, psychological, or any
combination of the three (3) .
c. Upon determination that a person is in need of financial
assistance from the City of Miami Beach, make
recommendations for the disbursement of budgeted funds
to the individual or to his or her family in accordance
with the guidelines set forth in the Standard Criteria
for Operations.
d. Maintain written records of all transactions with the
clientele. These records shall indicate the eligibility,
and reason and date of assistance.
e. Keep sufficient and adequate records of daily activities
in the performance of official duties.
f. Assist in the preparation/maintenance of a document
listing community resources to which Miami Beach
residents can be referred for auxiliary-type services.
8 . The Contractor understands that she is not considered a
regular City Employee and is therefore not eligible for any
coverage under any of the City' s insurance programs,
including, but not limited to: Accident, Workmen' s
Compensation and Unemployment Compensation.
9. It is understood that it is the sole responsibility of the
Contractor to pay all federal income taxes and social security
on the salary being paid to her. The City will provide the
Contractor with copies of all forms submitted to the Internal
Revenue Service.
10. The rights and privileges granted herein or any part hereof
shall not be assigned except by express consent of the City
Commission of said City.

SUBJECT: RESOLUTIONS AUTHORIZING EXECUTION OF PROFESSIONAL SERVICE
AGREEMENTS WITH FRANCES KATZ AND PATRICIA H. GLASPER FOR
THEIR CONTINUED EMPLOYMENT AS HUMAN SERVICES WORKERS FOR
THE CITY OF MIAMI BEACH
The City Commission has allocated funds for the services of a
contractual position entitled "Human Services Worker" . In order to
continue to provide an effective level of services, it is necessary
to split the position between two (2) part-time workers to ensure
daily coverage, and full service to Miami Beach clients.
Understanding this fact, both Mrs. Katz and Ms. Glasper have
indicated their desire to continue their employment, on a part-time
basis, at the South Shore Community Center, where they provide a
variety of services for the needy residents of the City of Miami
Beach.
Their compensation as specified in the Agreements are as follows:
Mrs. Katz - $9 .90 per hour, and Ms. Glasper - $7. 20 per hour.
Funds for these positions are included in the City' s Economic and
Community Development departments general fund budget of FY 89/90 .
ADMINISTRATIVE RECOMMENDATION
The Administration recommends that the City Commission adopt the two
(2) Resolutions authorizing the execution of Professional Service
Agreements with Mrs. Katz and Ms. Glasper.
