NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, THAT:
Section 1 . The Lincoln Road Commercial District Special
Improvement District Number 1 shall be authorized for a period of
one year in accordance with the steps set forth in Section 30 of
the City Charter; and shall incorporate the total area as shown
in Exhibit A and for which a legal description is shown in
Exhibit B, attached to this resolution. Said district is located
in the area generally bounded by West Avenue to the West, The
Atlantic Ocean to the East, 16th Street to the South and 17th
Street to the North, and excludes all municipal parking space and
residential property not fronting Lincoln Road.
Section 2 Said improvement shall consist of management, marketing
and promotion of the Lincoln Road Commercial District including
advertising, promotion, business recruitment, and planning and
design of physical improvements to the area. A detailed narrative
and budget of the proposed program appears in Exhibit C, attached
to this resolution.
Section 3 . This improvement shall be designated in all
proceedings, assessments and legislation as the Lincoln Road
Commercial District Special Improvement District Number 1, and
the property against which special assessments shall be made for
Two Hundred Ninenteen Thousand Six Hundred Dollars representing
seventy-nine percent (79%) of the total estimated cost of the
improvement, shall be made on the basis of assessable property
value with an assessment of 2 . 5 mills, as explained in detail in
Exhibits C and D attached to this resolution. All properties
within the boundaries as outlined in Exhibit A and as reflected
on the most current Dade County Real Estate Rolls, inclusive of
both land and building, will be included in the assessment.

BACKGROUND
Chapter 170, Sections 170. 01 through 170. 16, Florida Statutes and
Sections 29 and 30, Supplement #45, 5-88 of the City Charter of
the City of Miami Beach allow for the establishment of Special
Improvement Districts for "retail and/or wholesale business
districts and/or nationally recognized historic districts to be
improved through promotion, management and marketing and other
similar services in business districts of the municipality. "
The Lincoln Road Development Corporation supports the concept of
creating a Special Improvement District around Lincoln Road for
the purpose of assessing property owners for promotion,
management and marketing of the district . Funds generated
through the special assessment will also be used to initiate the
planning and design process for major physical improvements to
Lincoln Road.
The Department of Economic and Community Development together
with the Lincoln Road Development Corporation have prepared the
attached report entitled "Proposed Special Assessment District
for the Lincoln Road Commercial District" which provides the
necessary steps required to establish the Special Improvement
District, a narrati""e of the proposed services to be provided
under the program, a detailed 3ucget breakdown, the basis and
rationale for the proposed manner )f assessment and a map of the
proposed district.

The attached resolution represents the first step in creating the
Special Improvement District. The purpose of the resolution is to
order the special improvement, specify the proposed nature and
cost of the improvement, and to identify the District' s
boundaries and the proposed manner of assessment. After passage
of said resolution, additional steps need to be taken in
accordance with Sections 29 and 30 of the City Charter and as
outlined in the attached report.
THE REQUEST
That the City Commission adopt the attached Resolution
of Intent , ordering the establishment of the Lincoln Road
Commercial District Special Improvement District in accordance
with the steps set forth in Sections 29 and 30 of the City
Charter in order to fund a promotion, management and marketing
program for the Lincoln Road Commercial District.
RECOMMENDATION
The Administration recommends that the attached Resolution be
passed which orders the establishment of the Lincoln Road
Commercial District Special Improvement District Number 1 in
accordance with the steps set forth in Sections 29 and 30 of the
City Charter.

PROPOSED EXPENDITURE OF FUNDS FOR ING/PROMOTION
Shopping malls have traditionally assessed retail tenants for
marketing and promotion as part of the tenants lease agreement.
The purpose of the assessment is to provide continuity with
promotional activities and to create a greater visibility for the
mall as a place for one stop shopping. Merchants receive the
benefit of increased sales, quality promotions and greater impact
than if they advertised individually.
Using the concept that has been successful for shopping malls, the
special assessment district for marketing/management/promotions
would provide the Lincoln Road Development Corporation a unique
opportunity to provide similar services within the Lincoln Road
Commercial District.
The Lincoln Road Development Corporation proposes that a portion
of the funds generated from a special assessment district be used
for marketing/promotions of the Lincoln Road Commercial District.
BUDGET: $64 , 000.
A local Public Relations firm would be hired that would provide
LRDC with services for one year. They would be charged with
producing an overall image campaign to position Lincoln Road as an
Arts/Entertairunent/Dining/Shopping experience unique to Miami Beach
and the Greater Miami area.
Cost of Public Relations Firm: $24 , 000.
Products for the campaign would include: Developing a logo and
position slogan for use in all advertising, direct mail promotions
and banners.
Cost of logo/slogan: $2 , 600. _
Design and production of a Lincoln Road press kit which would be
used to send information to the media.
Cost of press kit: $1, 400.
Institutional ads 1 column by 6" placed in local newspapers
including the Miami Herald and New Times. 52 ads to include design
and production.
Cost of ad placement: $24 , 000.
Publication of current newsletter, INSITES, to be expanded and
published bi-monthly.
Cost of production/distribution/postage: $6, 000.
Reprint & update of Lincoln Road Business Directory, 20, 000 copies.
Cost of Directory: $5,000.

PROPOSED MANNER OF ASSESSMENT AND SUPPORTING RATIONALE
In attempting to determine the manner of assessment, we have been
exploring various alternatives (formulas) used by other
municipalities . In the case of the Lincoln Road Commercial
District, we are inclined towards using the same method used by
the City of Miami in establishing the Flagler Core Area Security
Special Improvement District. The basis for the assessment
formula would be the taxable value of property located within the
District. The proposed assessment would add approximately 2 . 5
mills to the taxes already paid by the properties located in the
Lincoln Road District. This figure was determined by dividing the
total assessed value within the district by the proposed program
budget amount as presented in this report. Due to the lack of
accurate information concerning many of the properties within the
district (net leasable space, tenant mix, etc. ) we are of the
opinion that using the taxable value of property as a basis for
the assessment represents the most equitable method since the
taxable value is based upon the income potential of each
property.
In using this method of assessment, we have determined the
average annual assessment per property to be $1, 887 and a median
annual assessment of $949 . In looking at specific properties and
their respective annual assessments , 701 Lincoln Road which
houses Florida Power & Light, Peoples' Gas and Douglas Gardens,
and which has an assessed value of $928, 987 would be assessed at
$2 , 322 ; 818 Lincoln Road, a single-tenant/owner-occupied property
with an assessed value of $163 , 620 would be assessed at $409 per
year; the highest annual assessment would be incurred by 100
Lincoln Road, a rental apartment building with ground floor
commercial space . The property has an assessed value of
$15, 657 , 004 and would be assessed at $39, 143 annually.

EXHIBIT "F'"
The procedure for establishing a special assessment district for
local improvements is set forth in Sections 29 and 30 of the Miami
Beach City Charter. Essentially, the following steps must be taken
for such assessments.
1. Miami Beach City Charter Section 30 (d) : Resolution ordering -
the local improvement must be passed at a regular or special
meeting of the City Commission. The resolution must be
specific in indicating the local improvement to be made. -
2 . Miami Beach City Charter Section 30 (e) : After the passage
of said resolution, the Officer so designated by the City
Commission shall file with the City Clerk an estimate of the
improvements' cost.
3 . Miami Beach City Charger Section 30 (f) : The-City Clerk shall
notice the meeting of the City Commission not earlier than ten
days from such notice that the Commission will hear objections
of all interested persons to the confirmation of the
resolution ordering the local improvement.
4 . Miami Beach Charter Section 30 (g) : At the City Commission
meeting named in the aforementioned notice, the Commission
shall receive written objections of interested persons, and
may act upon the objections. (NOTE: If the property owners
object to the local improvement, the Commission may vote
against the local improvements) .
5. Miami Beach City Charter Section 30 (i) : All objections not
made in writing and filed with the City Clerk shall be waived.
The confirmation of the resolution shall be the final
adjudication of the issues presented, unless proper steps
shall be taken in a court of competent jurisdiction to secure
relief within ten days.
6. Within ten days after confirmation, the resolution, together _
with the estimates submitted by the official designated by the
City Commission shall be recorded by the City Clerk.
7 . Miami Beach City Charter Section 30 (k) : The City Engineer
shall prepare a preliminary assessment roll and file it with
the City Clerk.
8. The assessment roll shall be filed with the City Clerk and
shall be published by the Clerk for two successive weeks. The
Clerk shall notice the regular meeting of the City Commission
at which all interested persons may appear and file written
objections to the confirmation of the assessment roll.

9. Miami Beach City Charter Section 30 (s) : At that meeting the
City Commission shall hear and receive written objections of
interested persons regarding the assessment roll . Then or
thereafter, the City Commission shall act upon the objections.
10. Miami Beach Charter Section 30 (t) : Any property owners so
assessed shall within ten days from confirmation of the
assessment roll file a written verified petition in the
Circuit Court objecting to the assessment.
11. Miami Beach City Charter Section 30 (v) : Thirty days after
the confirmation of the assessments, the amounts apportioned
shall be due and payable at the office of the Finance
Director.
12 . Miami Beach City Charter Section 30 (y) : On or after the
confirmation of the resolution ordering the local
improvements, the City Commission may, by resolution, issue
bonds of the City for the payment of the entire cost or any
part thereof.
