A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING THE SALE OF
THE OJUS PROPERTY TO MIAMI CHILD'S WORLD, INC. ,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE CONTRACT FOR SALE AND PURCHASE AND
ALL DOCUMENTS NECESSARY TO CONVEY TITLE TO THE
SUBJECT PROPERTY.
WHEREAS, the City of Miami Beach is the owner of the property
known as the Ojus Property, consisting of approximately 143 . 75
acres located at 1511 Northeast 207th Street, Miami, Dade County,
Florida (the "Subject Property") legally described as follows:
Parcel I
The East one-half (E 1/2) of the Northeast
quarter (NE 1/4) less the right-of-way of
Seaboard Air Line Railroad; paralleling the
East boundary line thereof; also less the
Southwest quarter (SW 1/4) of the Southeast
quarter (SE 1/4) of the Northeast quarter (NE
1/4) , all of said land being in Section 32 ,
Township 51 South, Range 42 East.
Parcel II
The west one-half (W 1/2) or the Northeast
quarter (NE 1/4) of Section 32 , Township 51
South, Range 42 East.
and;
WHEREAS, between 1938 and 1977 , the City operated a landfill
on 46 acres of the Subject Property; and
WHEREAS, the City and Miami Child' s World, Inc. entered into
a Lease Agreement on September 30, 1983 for the lease of the
Subject Property located at 1511 N. E. 207th Street, Miami, Florida
pursuant to Resolution No. 83-17483 , and Buyer is currently a
lessee of the Subject Property; and
WHEREAS, the City is desirous of selling the Subject Property,
and having the Landfill officially closed; and
WHEREAS, the City had an appraisal performed by an MAI
appraiser which appraised the value of the Subject Property at
$8 , 745, 000 ; and
WHEREAS, the appraisal did not take into consideration the

Dade County Urban Land Forest located on the property, the Landfill
closure costs (which has been estimated by a later study to cost
$3 , 114 , 850) or the cost of meeting the State and local concurrency
requirements; and
WHEREAS, Miami Child's World, Inc. is desirous of purchasing
the Subject Property on the terms and conditions set forth in the
attached Contract for Purchase and Sale; and
WHEREAS, the City is willing to sell the Subject Property on
the terms and conditions set forth in the attached Contract for
Purchase and Sale; and
WHEREAS, the Contract for Sale and Purchase has been form
approved by the City Attorney and is attached hereto and
incorporated by reference herein; and
WHEREAS, the Administration recommends the sale of the subject
property pursuant to the attached Contract for Purchase and Sale.
NOW, THEREFORE, BE IT DULY RESOLVED by the City Commission
of the City of Miami Beach, Florida that the City Commission hereby
approves the sale of the Ojus Property to Miami Child's World,
Inc. , under the terms and conditions set forth in the attached
Contract for Purchase and Sale and authorizes the Mayor and City
Clerk to execute all documents necessary to convey title to the
subject property.
