A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPOINTING TWO
INDIVIDUALS TO THE DADE COUNTY SHORELINE
DEVELOPMENT REVIEW COMMITTEE; AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT WITH DADE
COUNTY FOR PURPOSES OF EFFECTUATING
APPOINTMENTS TO SAID COMMITTEE AND DESIGNATING
THE CITY OF MIAMI BEACH PLANNING AND ZONING
DEPARTMENT TO FUNCTION AS THE STAFF TO THE
DADE COUNTY SHORELINE DEVELOPMENT REVIEW
COMMITTEE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, THAT,
WHEREAS, the Board of County Commissioners of
Metropolitan Dade County, Florida, adopted Ordinance 85-14 amending
Chapter 33D of the Code of Metropolitan Dade County, Florida,
providing for review of development actions and plans within the
shoreline development review boundary; and
WHEREAS, Section 6 of said Ordinance contained provisions
whereby any affected shoreline municipality may develop a
memorandum of agreement with Metropolitan Dade County, Florida,
identifying its professional capability for providing staff reviews
in accordance with the intent and requirements of the ordinance;
and
WHEREAS, the City of Miami Beach has the professional
capabilities required and is desirous of providing the staff
reviews for any development actions or plans as defined in
Ordinance 85-14 , and
WHEREAS, Chapter 163 . 01 Florida Statutes, provides that
local governments ya y enter interlocal t..+ov.- make the
most efficient use of their powers, enabling them to provide
services in a manner that will be in accord with geographic,
economic, population and other needs of the communities.
WHEREAS, Section 33D - 33 of said Ordinance contains a
provision to enable local governments to appoint two members to the
Dade County Shoreline Development Review Committee.
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby appoints
Stuart Cohen _ and Randy Sender as the City' s appointments to the
Dade County Shoreline Development Review Committee; and hereby
authorizes the City Manager to enter into an agreement to
effectuate the appointments and to designate the City of Mlami
Beach Planning and Zoning Department staff to function as the staff
to the Dade County Shoreline Development Review Committee.

SUBJECT: APPOINTMENTS OF TWO INDIVIDUALS TO DADE COUNTY' S
SHORELINE DEVELOPMENT REVIEW COMMITTEE
The Dade County Biscayne Bay Shoreline Review Ordinance established
a Shoreline Development Review Committee whose purpose is to review
projects that are within the Biscayne Bay Aquatic Preserve. Their
review includes architectural objectives which are designed to
encourage projects that allow for visual and physical access to
Biscayne Bay.
The Shoreline Development Review Manual, which includes urban
design guidelines to implement the aforementioned objective,
includes setbacks which in some cases exceed the City' s. As such,
it is possible that projects which are consistent with City Zoning
Ordinance' s are not compatible with the regulations established by
the County. In recognition of this issue, the Dade County
Ordinance allows City Commissions to appoint two voting members who
serve on the Shoreline Development Review Committee when a project
lies within the boundaries of a municipality. The Dade County
Ordinance requires that these additional members serve at the
discretion of the local governing body and that the appointments
may be made for a specified term or limited to a single development
action or plan. The appointments are limited to recognized
professionals in one or more of the following fields:
architecture, landscape architecture or urban design. The County
Ordinance also allows City' s with a professional planning staff to
function as the staff for the Shoreline Review Committee. It was
envisioned that the local appointments combined with the City' s
staff would insure that the municipalities interest would be
represented on the Committee.
ADMINISTRATION RECOMMENDATION
It is recommended that: a) architects Stuart Cohen and Randy Sender
be appointed to serve on the Shoreline Development Review Committee
for a term of two (2) years; and, b) that the City Manager be
authorized to enter into an Agreement with the County to effectuate
the appointments and designate the City' s Planning and Zoning
Department as staff to the Dade County Shoreline Review Committee.
