A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING THE CREATION OF A SPECIAL TAXING
DISTRICT FOR THE BISCAYNE POINT AREA IN ORDER TO PROVIDE
24-HOUR GUARD SERVICE, SUBJECT TO COMPLIANCE WITH
APPLICABLE METRO DADE COUNTY CHARTER AND CODE
REQUIREMENTS.
WHEREAS, some of the citizens of Miami Beach, residing on Biscayne Point, have
indicated their wish to petition Dade County under Chapter XVIII of the Metropolitan
Charter and Sections 18-2 and 18-3 of the Dade County Code to create a Special Taxing
District for special guard protection of the Biscayne Point area; and
WHEREAS, the residents of the Biscayne Point area request the approval of the Miami
Beach City Commission for Dade County to hold a referendum vote of the residents of said
Biscayne Point area, at no expense to the City of Miam Beach, to determine whether a
Special Taxing District should be created in said Biscayne Point area,
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, that creation of a Special Taxing District in the Biscayne Point
area, Miami Beach, FLorida, in accordance with Chapter XVIII of the Metropolitan Charter
and Sections 18-2 and 18-3 of the Dade County Code for special guard protection is hereby
approved by the City Commission of the City of Miami Beach, Florida, said special guard
protection to consist of:
1) Creation of a security guard district and special assessment levied to
support this service.
2) Construction of a guardhouse within the public right-of-way at the
entrance to the District.
3) Construction and operation of gates to enable security personnel to record
description and tag number of all incoming vehicles.
4) Contracting for twenty-four hours a day, seven days a week, 365 days a
year, unarmed, uniformed, Guard services with a duly licensed and bonded,
State of Florida approved security guard service and/or off-duty police to
provide such services at the entrance of the District.
Such approval being further conditioned upon the affirmative vote of the residents of
the Biscayne Point area in an election to be conducted according to the Metropolitan Dade
County Code and further subject to approval of the Dade County Commission.

SUBJECT: SPECIAL TAXING DISTRICT--BISCAYNE POINT AREA
The residents of Biscayne Point have created a Biscayne Point Homeowners Association,
Inc., and have caused to be collected in excess of 51 percent (51%) of the district's land
owners' signatures for the purpose of creating a Special Taxing District.
Metropolitan Dade County requires that the City of Miami Beach Commission approve a
resolution requesting the Special Taxing District prior to the County Commission
considering the item.
Consequently, we have prepared the attached resolution supporting the request of the
Biscayne Point Homeowners Association, Inc., to create a Special Taxing District for the
purpose of installing a private guardhouse and employing a guard.
ADMINISTRATION RECOMMENDATION:
The City Administration recommends that the City Commission adopt the resolution
supporting the creation of a Special Taxing District for the Biscayne Point area.

Wednesday, February 21, 1990.
A majority of the residents of Biscayne Point have signed petitions indicating their desire to create a
special taxing -is ct to construct and man a guard house at the entrance to Biscayne Point, located
at the 77th Street Bridge.

Therefore,the purpose of our appearance would be to obtain permission from the City Commission
to go before the Dade County Commissioners with our request for the creation and establishment
of a Special Taxing District to provide security guard services to the residents of Biscayne Point. At
the Miami Beach Commission Meeting on February 21st we will present the signed petitions.
