A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
INCREASE IN SCOPE OF THE CONTRACT BETWEEN THE
CITY OF MIAMI BEACH AND THE GEORGE HYMAN
CONSTRUCTION COMPANY TO INCREASE THE
CONTINGENCY ALLOWANCE IN THE AMOUNT OF
$450, 000 FOR OUTSTANDING CHANGE ORDERS ON
PHASE II, AND FOR PHASE III OF THE JACKIE
GLEASON THEATER OF THE PERFORMING ARTS (TOPA)
CONTRACT AND FURTHER ALLOCATING THESE FUNDS
FROM BOND FUND 356 (TOPA BOND FUND 1984) .
WHEREAS, the contingency allowance established as part of the
original Contract has been depleted; and,
WHEREAS, it is necessary to provide funds for work
accomplished as part of Phase II; and,
WHEREAS, it is essential that additional money be provided for
contingency allowance as part of Phase III.
NOW, THEREFORE, be it resolved by the City Commission of the
City of Miami Beach, Florida, that an increase in the scope of the
Contract between the City of Miami Beach and the George Hyman

SUBJECT: JACKIE GLEASON THEATER OF THE PERFORMING ARTS (TOPA) -
CONTINGENCY ALLOWANCE
The original Contract for TOPA was $15, 058,000 which included an
contingency allowance of $1, 000, 000. At the present time,
approximately thirty-five Change Orders are in the process of
negotiations. These Change Orders total about $327, 000 more than
the original contingency allowance.
On May 21, 1990, we will start Phase III of the construction
schedule for TOPA. It is necessary that the City provide money to
pay for any Change Order work already performed and also provide
additional money for any contingency that occurs during Phase III.

the original appropriation. It is requested that this amount be
incorporated into the George Hyman Contract to pay for work
accomplished but not yet paid for and for the work anticipated as
part of Phase , III. It should be . understood that additional
appropriations may be necessary to complete Phase III or to do
other work that may be requested.
ADMINISTRATION RECOMMENDATION
It is the recommendation of the Administration, that the City
Commission: (1) Adopt the resolution increasing the scope of the
George Hyman Construction Company Contract for Phase III in the
amount of $450, 000. This money will be used to pay for the work
already completed and to provide approximately $120,000 as a
contingency for Phase III; and, (2) Adopt the resolution
authorizing the City Manager to approve the Change Orders for Phase
III of TOPA as may be necessary
