A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
CITY MANAGER OR HIS DESIGNEE TO REVIEW,
PROCESS, AND APPROVE ALL FUTURE CHANGE ORDERS
FOR THE JACKIE GLEASON THEATER OF THE
PERFORMING ARTS (TOPA) CONTRACT BETWEEN THE
CITY OF MIAMI BEACH AND THE GEORGE HYMAN
CONSTRUCTION COMPANY DATED JUNE 10, 1988,
WHICH ARE WITHIN THE PRESENTLY EXISTING OR
HEREAFTER INCREASED CONTINGENCY ALLOWANCE FOR
SAID CONTRACT, AND REPORTING PERIODICALLY TO
THE CITY COMMISSION THE NATURE AND AMOUNT OF
ALL SUCH CHANGE ORDERS.
WHEREAS, the construction Contract with George Hyman
Construction Company dated June 10, 1988 provides for a contingency
amount of $1, 000, 000 for Change Orders for unforeseen work; and,
WHEREAS, pursuant to Resolution No. 90-19900 the City
Commission authorized the City Manager or his designee to approve
Change Orders within the $1, 000, 000 contingency allowance; and,
WHEREAS, the City Manager has recommended that he or his
designee be authorized to review, process and approve all future
Change Orders, within the presently existing or hereafter increased
contingency allowance and that he report periodically to the City
Commission the nature and amount of all such Change Orders.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the City Manager or his designee
is hereby authorized to review, process, and approve all future
Change Orders for TOPA Contract between the City of Miami Beach and
the George Hyman Construction Company dated June 10, 1988, which
are within the presently existing or hereafter increased
contingency allowance for said contract, and that the City Manager
is to report periodically to the City Commission the nature and
amount of all such Change Orders.

SUBJECT: JACKIE GLEASON THEATER OF THE PERFORMING ARTS (TOPA) --
CONTINGENCY ALLOWANCE

The
original Contract for TOPA was $15,058, 000 which included an
time,
contingency allowance of $1, 000, 000. At the present
approximately thirty-five Change Orders are in the process of
negotiations. These Change Orders total about $327,000 more than
the original contingency allowance.
On May 21,
1990, we will start Phase III of the construction
schedule for TOPA. It is necessary that the City provide money to
for anyChange Order work already performed and also provide
pay o
additional money for any contingency that occurs during Phase III.
At thep resent time, there is approximately $450,000 remaining of
the original appropriation. It is requested that this amount be
incorporated into the George Hyman Contract to pay for work
accomplished but not yet paid for and for the work anticipated as
part of Phase III. It should be understood that additional
appropriations ro riations may be necessary to complete Phase III or to do
other work that may be requested.
ADMINISTRATION RECOMMENDATION
It is the recommendation of the Administration, that the City
Commission: (1) Adopt the resolution increasing the scope of the
Hyman e H an Construction Company Contract for Phase III in the
amount of $450, 000. This money will be used to pay for the work
already completed and to provide approximately $120, 000 as a
contingency for Phase III; and, (2) Adopt the resolution

authorizing the City Manager to approve the Change Orders for Phase
III of TOPA as may be necessary
