A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA URGING THE STATE
LEGISLATURE TO DEFEAT HB 2113 AND SB 1648 THAT
WOULD ELIMINATE THE TORT SOVEREIGN IMMUNITY
"PER OCCURRENCE" CAP.
WHEREAS, HB 2113 and SB 1648 will increase exposure of local
governments to liability and will place an extraordinary financial
burden on them at a time of genuine financial crisis, and
WHEREAS, the adoption of these bills will serve to drive
traditional liability insurers out of Florida' s market and will
have a negative and an adverse impact on local governments that
self-insure as the local governments will be unable to gauge their
actuarial risk without the "per occurrence"- cap, and
WHEREAS, SB 1648, in addition to removing the cap, would
exclude court costs from the $100, 000 "per person" cap, and
WHEREAS, the City of Miami Beach hereby expresses its
opposition to the adoption of HB 2113 and SB 1648 .
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1.
The City Commission of the City of Miami Beach hereby urges the
State Legislature to defeat HB 2113 and SB 1648 that would
eliminate the tort sovereign immunity "per occurrence" cap.
SECTION 2 .
That the Miami Beach City Clerk shall cause copies of this
resolution to be distributed to the Governor of the State of
Florida, legislators Simmon and Weinstein (introducers of the
subject bills) , and representatives Burke, Cosgrove, Frankel,
Geller, Press, Simon, Canady and McEwan (proponents of the bills) ,
each member of the Dade County Legislative Delegation, the Senate
Governmental Operations Committee, and the news media.
PASSED and ADOPTED this 23rd day of May 990.
