A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING THE ABANDONMENT OF A
UTILITY EASEMENT AND VACATING SAME;
(PROPERTY IS SOUTH 5 FEET OF LOTS 12
AND 13, BLOCK 54, ORCHARD
SUBDIVISIONS NOS. 2 AND 3, PLAT BOOK
8, PAGE 116)
WHEREAS, the owners of the real property described in the
attached Exhibit "A" , have petitioned the City Commission of the
City of Miami Beach to vacate a city utility easement; and
WHEREAS, said easement has been abandoned by the public; and
WHEREAS, the vacation of the subject easement is deemed to be
in the best interest of the City of Miami Beach and its citizens;
and
WHEREAS, the Public Works Department has received waivers from
all private and public utilities serving the area.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City hereby surrenders
all its right, title and interest to the property described in the
attached Exhibit "A" .
PASSED and ADOPTED this 6th day of June 1990.

SUBDIVISION NOS. 2 AND 3, PLAT BOOK 8, PAGE 116, MORE
COMMONLY KNOWN AS 474 ARTHUR GODFREY ROAD
The owner of the property at 474 Arthur Godfrey Road have requested abandonment of the
five foot utility easement behind the property for purposes of extending the existing building
and closing in the garbage and storage area behind the store.
The City does not have any existing utilities in the easement and has no foreseeable need in
the area. Further, the owner has contacted all of the utilities and received approval of the
proposed abandonment. Me proposed improvement will close in unsightly refuse and other
storage in an area of high pedestrian and vehicular traffic.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the existing five foot easement at the rear of Lots 12
and 13, Block 54, of Orchard Subdivision Nos. 2 and 3, be abandoned subject to approval of
all utilities with the understanding that the property owner is responsible for any utility
relocation, if required.
