A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A FIRST
AMENDMENT TO THE LEASE AGREEMENT BETWEEN THE
CITY OF MIAMI BEACH AND ORIGINAL 5TH STREET
PROPERTIES, INC. FOR USE OF CITY PROPERTY AT
4TH STREET AND ALTON ROAD FOR IMPROVED
TEMPORARY PARKING
WHEREAS, pursuant to City Commission Resolution No. 89-19661,
the City and Lessee entered into a Lease Agreement dated July 13 ,
1989 (the "Lease Agreement") for lease of the property located at
4th Street and Alton Road, Miami Beach, Dade County, Florida, for
the purpose of providing temporary parking; and
WHEREAS, the Lessor and Lessee wish to amend the Lease
Agreement to extend the term and to increase the amount of the
monthly payments to the City.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are
hereby authorized to execute the First Amendment to the Lease
Agreement with Original 5th Street Properties, Inc. to extend the
term and to increase the amount of the monthly payments to the
City.

SUBJECT: STREET PROPERTIES, INC. FOR USE OF CITY PROPERTY AT 4TH
STREET AND ALTON ROAD FOR IMPROVED TEMPORARY PARKING
BACKGROUND INFORMATION:
Pursuant to City Commission Resolution No. 89-19661, approved July
12 , 1989, the City enter into a Lease Agreement with Original 5th
Street Properties, Inc. authorizing the use of four vacant lots of
City property at 4th Street and Alton Road, as well as granting a
permit for use of the ten-foot alleyway adjacent to the referenced
lots to be used as temporary improved parking, pending the
negotiation of a development agreement for redevelopment of the
adjoining property.
The Lessee is current in rent payments and has supplied the
required certificate of insurance and sublease documents.
The Lessee has requested and executed a First Amendment to Lease
Agreement to extend the term of the agreement for one (1) year,
terminating July 14 , 1991 and increasing the monthly payments to
the City to $477 . 00 (including Sales Tax) . Under the proposed
First Amendment, either party may cancel the agreement upon thirty
( 30) days written notice, without cause.
ADMINISTRATION RECOMMENDATION:
The City Administration recommends that the City Commission approve
a Resolution authorizing the Mayor and the City Clerk to execute
the proposed First Amendment to Lease Agreement between the City
of Miami Beach and Original 5th Street Properties, Inc. , for use'
as temporary improved parking and extending the term for one year
and increasing the monthly payments to the City.

FIRST AMENDMENT TO LEASE AGREEMENT
THIS FIRST AMENDMENT TO LEASE AGREEMENT, made and entered into
this 17th day of July , 1990, by and between the
CITY OF MIAMI BEACH, a municipal corporation, Lessor (hereinafter
referred to as "City") and ORIGINAL 5TH STREET PROPERTIES, INC. a
Florida Corporation (hereinafter referred to as "Lessee") :
WITNESSETH
WHEREAS, pursuant to City Commission Resolution No. 89-19661,
the City and Lessee entered into an Agreement (hereinafter referred
to as "Lease Agreement") dated July 3 , 1989 , for the lease of
certain real property located at 4th Street and Alton Road in the
City of Miami Beach (hereinafter described as the Premises)
particularly described in Exhibit "A" of said Lease Agreement; and
WHEREAS, said Lease Agreement provides for the use of the
premises for the sole purpose of providing improved temporary
parking as set forth in the referenced Lease Agreement; and
WHEREAS, the parties wish to amend the Lease Agreement to
extend the term and increase the payments to the City, and other
matters.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, and other good and valuable consideration, the
receipt of which is hereby acknowledged, the parties hereby agree
as follows:
1. The term of the lease is hereby extended for a one year period
commencing July 15, 1990 and terminating on July 14 , 1991.
2 . During the extended term the rental shall be Four Hundred
Seventy Seven ($477 . 00) Dollars per month, which amount includes
Florida State Sales Tax at six percent (6%) for a total sum of Five
Thousand Seven Hundred Twenty Four Dollars ($5, 724 . 00) per year.
3 . The parties hereby ratify and confirm all other terms and
conditions of the Lease Agreement which remain unchanged.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be signed by the duly authorized officers and the
respective corporate seals to be affixed this IG day of
