A RESOLUTION OF THE CITY COMMISSION FOR THE
CITY OF MIAMI BEACH, FLORIDA APPROVING,
SUPPORTING, RECOMMENDING AND REQUESTING THE
CONTRACTION OF A. 0. 231 ACRE PARCEL FROM THE
MUNICIPAL BOUNDARIES OF THE CITY OF MIAMI
BEACH TO THE BOARD OF COUNTY COMMISSIONERS FOR
METROPOLITAN DADE COUNTY, FLORIDA.
WHEREAS, Island Developers, Ltd. ("Island Developers") owns
and is developing the majority of Fisher Island, Florida; and
WHEREAS, a 17± acre portion of Fisher Island, legally
described in Exhibit "A" , that is owned by Island Developers is
within the jurisdiction of the City of Miami Beach (the "City") ;
and
WHEREAS, Island Developers development plan for Fisher Island
will result in approximately 178 residential units (or more) being
developed in the portion of Fisher Island that is within the
jurisdiction of the City (the "City Jurisdiction Parcel") ; and
WHEREAS, a portion of Fisher Island that is owned by Island
Developers to the south of the City Jurisdiction Parcel is within
the jurisdiction of Metropolitan Dade County (the "County") ; and
WHEREAS, Island Developers ' proposed development plan for
Fisher Island reflects that a small portion of a certain building
would cross City and County jurisdictional lines, with the great
majority of that certain building within the jurisdiction of
Metropolitan Dade County and a very small portion would be within
the jurisdiction of the City; and
WHEREAS, in order to develop that particular building, it is
necessary to have it located within a single jurisdiction for
building, zoning, taxation and other purposes; and
WHEREAS, in order to accomplish placing the remainder of that
building within the jurisdiction of the County, the portion of the
City Jurisdiction Property legally described in Exhibit B (the
"Contraction Property") must be deannexed from the jurisdiction of
the City ("Location Sketch" attached as Exhibit "C") ; and
WHEREAS, the Contraction Property is only 0. 231 of an acre;
and
WHEREAS, Island Developers, as current owners of the subject
property, has agreed to keep the remainder of the City Jurisdiction
Property within the jurisdiction of the City, which will result in
substantial ad valorem tax revenues to the City once developed; and
WHEREAS, a resolution of the City approving and requesting
that the County contract the municipal boundaries of the City is
required pursuant to Article 5. 04 of the Metropolitan Dade County
Home Rule Charter and Chapter 20 of the Code of Metropolitan Dade
County;
NOW, THEREFORE, be it resolved by the City Commission for the
City of Miami Beach, Florida as follows;
Section 1. The City Commission of the City of Miami Beach
hereby approves, supports, recommends and requests that the Board
of County Commissioners for Metropolitan Dade County, Florida
favorably consider Island Developers ' application to contract the
municipal boundaries of the City of Miami Beach, Florida by
deannexing the portion of Fisher Island, Florida legally described
in Exhibit B from the incorporated City of Miami Beach and,
therefore, allow the property to come within the jurisdiction of
Metropolitan Dade County, Florida.

SUBJECT: A RESOLUTION RECOMMENDING AND REQUESTING THE
CONTRACTION OF A 0.231 ACRE PARCEL FROM THE MUNICIPAL
BOUNDARIES OF THE CITY OF MIAMI BEACH TO THE BOARD OF
COUNTY COMMISSIONERS FOR METROPOLITAN DADE COUNTY,
FLORIDA
The Request:
Island Developers, Ltd. are the owners and developers of a 17 acre parcel on Fisher Island (the
University of Miami site) which is under the jurisdiction of the City of Miami Beach. The
remainder of Fisher Island is under the jurisdiction of Metro-Dade County.
As part of its overall development plan for the island, Island Developers intends to construct
approximately 178 residential units on the parcel under City jurisdiction. The average assessed
valuation for each unit is expected to be $1.5 million. This will result in annual tax revenues
to the City of approximately $3.65 million, based upon present millage rates of 9.966 for
general operating and 3.705 for debt service. Construction is anticipated to be complete within
approximately three to four years.
Island Developers has asked that the City recommend and request that Dade County de-annex
a 0.231 acre portion of this property from the municipal boundaries of the City. This is
necessary because a small portion of one of the buildings crosses jurisdictional boundaries
between the City and the County and it must be located within one jurisdiction for building,
zoning, taxation and other purposes. The majority of the building is located in the area
outside municipal boundaries.
Analysis:
The de-annexation of a small parcel of Fisher Island will facilitate the orderly development
of the area in a manner consistent with the development regulations contained with the City's
Zoning Ordinance and Comprehensive Plan as well as those regulations established by Dade
County. The positive benefits to the City resulting from the remaining proposed development
under the City's jurisdiction will be substantial, and any efforts to facilitate this project
should be undertaken.
The request was reviewed by the City Commission Finance Committee on July 9, 1990.
Administration Recommendation:
The Administration recommends that the City Commission adopt a resolution recommending
and requesting the contraction of a 0.231 acre parcel from the municipal boundaries of the
City of Miami Beach to the Dade County Commission.
