A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, URGING THE LEGISLATURE
OF THE STATE OF FLORIDA TO AMEND CHAPTER 162,
PART I, AND CHAPTER 553, PART VI OF THE FLORIDA
STATUTES TO PROVIDE THAT ALL LIENS IMPOSED BY
LOCAL GOVERNMENT CODE ENFORCEMENT BOARDS OR
SPECIAL MASTERS, PURSUANT TO FLORIDA STATUTE
CHAPTER 162, PART I, AND ALL LIENS ACQUIRED BY
LOCAL GOVERNMENTS PURSUANT TO ADOPTED MINIMUM
BUILDING CODES SHALL BE TREATED AS SPECIAL
ASSESSMENT LIENS EQUAL IN RANK AND DIGNITY TO
AD VALOREM TAXES AND SUPERIOR IN RANK AND
DIGNITY TO ALL OTHER LIENS, ENCUMBRANCES
(INCLUDING MORTGAGES) TITLES AND CLAIMS IN, TO,
OR AGAINST REAL PROPERTY.
WHEREAS, Chapter 162 , Part I, of the Florida Statutes
authorizes Municipal Code Enforcement Boards and Special Masters
to impose liens upon the real and personal property of persons
violating municipal codes and ordinances; and
WHEREAS, Chapter 162 does not provide for any special priority
for liens imposed pursuant to it; and
WHEREAS, due to the lack of special priority for liens imposed
pursuant to Chapter 162 many such liens are extinguished in
mortgage foreclosure proceedings without payment by the respective
code violators; and
WHEREAS, knowledge of the lack of priority of said liens is
widespread, with the result that code violators and mortgage
holders of the properties in violation often ignore the code
enforcement proceedings initiated by local governments, and many
properties (including some historic buildings) remain in
deteriorated condition to the detriment of the public; and
WHEREAS, Chapter 553 , Part VI, of the Florida Statutes
requires local governments to adopt and enforce approved minimum
building codes; and
WHEREAS, some of the adopted minimum building codes, such as
the South Florida Building Code adopted by Metropolitan Dade County
and the City of Miami Beach, require governmental authorities to
expend money to secure unsafe properties and provide for the
recording of liens upon those properties in favor of the
governmental authorities in the amounts so expended; and

WHEREAS, Chapter 553 does not provide any special priority
for liens acquired by governmental authorities in enforcement of
minimum building codes; and
WHEREAS, due to the lack of special priority for liens
acquired pursuant to enforcement of minimum building codes, many
such liens are extinguished in mortgage foreclosure proceedings,
with the result that the financial responsibility for the securing
of private property is shifted from the respective property owners
to the public; and
WHEREAS, the effectiveness of the code enforcement efforts of
local governmental authorities would be greatly increased if
Chapters 162 , Part I and 553 Part VI, of the Florida Statutes were
amended to provide that all liens imposed by local government code
enforcement boards or special masters pursuant to Chapter 162 and
all liens acquired by local governments pursuant to an adopted
minimum building code, shall be treated as special assessment
liens, equal in rank and dignity to all other liens and
encumbrances (including mortgages) , titles and claims in, to, or
against real property.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA: that the City Commission urges
the Legislature of the State of Florida to amend Chapters 162 , Part
I, and 553 Part VI of the Florida Statutes to provide that all
liens imposed by local government code enforcement boards or
special masters and all liens acquired by local governments
pursuant to an adopted minimum building code shall be treated as
special assessment liens, equal in rank and dignity to ad valorem
taxes and superior in rank and dignity to all other liens,
encumbrances (including mortgages) , titles and ordinances in, to,
or against real property.
