A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH URGING ALL CITIZENS TO VOTE YES ON
AMENDMENT NO. 3 TO THE FLORIDA CONSTITUTION ON THE
NOVEMBER 6, 1990 BALLOT, LIMITING UNFUNDED STATE
MANDATES ON CITIES AND COUNTIES.
WHEREAS, "unfunded mandates"are governmental actions required of cities and counties by
state law which do not provide funds in support of the legislation; and
WHEREAS, cities and counties are continuously forced to adjust local service priorities and
raise local taxes and user fees to pay for such unfunded state-mandated programs; and
WHEREAS, since the Florida Constitution preempts all taxing sources to the state (except ad
valorem property taxes) it is unconscionable to require and mandate programs without providing a
method of obtaining funds; and
WHEREAS, there can be no certainty and predictability in the growth planning process if the
State Legislature can continue to mandate new and expensive programs without regard to local
government's ability to fund; and
WHEREAS, unfunded mandates are not fair to the local property owner or the locally elected
official who is trying to address local priorities and problems with a limited amount of financial
resources; and
WHEREAS,during the 1988 Legislative Session approximately 100 members of the Legislature
co-signed or supported the proposed Constitutional Amendment No. 3, which was proposed for the
purpose of extending to the citizens of Florida the right to vote November 6, 1990 on whether to limit
unfunded state legislative mandates on cities and counties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH THAT:
The City Commission of the City of Miami Beach urges all citizens to vote "Yes" on
Amendment No 3 to the Florida Constitution on the November 6, 1990 ballot, which would limit
unfunded state mandates on cities and counties.

ALL CITIZENS TO VOTE YES ON AMENDMENT NO. 3 TO THE FLORIDA
CONSTITUTION ON THE NOVEMBER 6, 1990 BALLOT, LIMITING UNFUNDED STATE
MANDATES ON CITIES AND COUNTIES
This resolution addresses the problem of "unfunded mandates" by the
State Legislature.
These mandates are continuously forcing cities and counties to
adjust local service priorities and raising local taxes and user
fees to pay for said unfunded state-mandated programs.
During the 1988 Legislative Session, approximately 100 members of
the Legislature co-signed or supported the proposed Constitutional
Amendment No. 3 , which was proposed for the purpose of extending to
the citizens of Florida the right to vote November 6, 1990 on
whether to limit unfunded state legislative mandates on cities and
counties.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission approve the
attached resolution urging all citizens to vote yes on Amendment
No. 3 .
