A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
VACATION OF A PORTION OF THE EAST-WEST ALLEY
IN BLOCK 12 OF BISCAYNE POINT, ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT BOOK 14,
PAGE 35 OF THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA, AND AUTHORIZING EXECUTION AND
DELIVERY OF A QUIT-CLAIM DEED TO ONE HALF OF
SAID VACATED REAL PROPERTY TO THE ADJOINING
PROPERTY OWNERS, AND PROVIDING FOR A
RESERVATION OF A 10 ' UTILITY EASEMENT.
WHEREAS, the Plat of Block 12 of Biscayne Point
Subdivision as recorded in Plat Book 14 Page 35, reflects an alley,
twenty feet (20 ' ) in width, running East and West, bounded on the
North by Lots 1 through 5, inclusive, and bounded on the South by
lots 6 through 15, inclusive, and
WHEREAS, the owners of Lot 1 and the West thirty feet
(30 ' ) of Lot 2 in Block 12 of said Subdivision have petitioned the
City Commission of the City of Miami Beach to vacate that portion
of said alley as described in Exhibit A, attached hereto and
incorporated herein.
WHEREAS, the Miami Beach City Commission has held a public
hearing to determine whether vacation of the above-referenced alley
would be in the best interest of the general public welfare; and
WHEREAS, the Miami Beach City Commission has made the
following determinations:
1. The subject alley is held by the City of Miami Beach in
trust for the benefit of the public.
2 . The City of Miami Beach City Commission is duly vested
with the authority to vacate the above referenced right-of-way.
3 . The vacation of that portion of the subject alley as
shown on Exhibit "A" is deemed to be in the best interest of the
City of Miami Beach and its citizens and the subject alley is no
longer required for the public use and convenience; and
4 . The vacation of the subject alley is found not to be for
the benefit of a purely private interest; and
5. The Public Works Department of the City of Miami Beach
recommends that the City retain a ten foot (10 ' ) utility easement,
five feet (5 ' ) on either side of the said center line of the
subject alley;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of
Miami Beach does hereby vacate that portion of the East-West alley,
in Block 12 , of BISCAYNE POINT, according to the Plat thereof
recorded in Plat Book 14 , at Page 35 of the Public Records of Dade
County, Florida, adjoining and immediately North of Lots 10, 11, 12
and 13 and immediately South of Lot 1 and the west thirty feet
(30 ' ) of Lot 2 , in said Block 12, being approximately 120 feet
(120 ' ) by twenty feet (20 ' ) , except insofar as the City reserves in
said property utility easements for the installation, maintenance
and repair of its sanitary sewer, present or future storm sewers
and such other utilities as may be appropriate or necessary in the
future, and the Mayor and City Clerk are hereby authorized to
execute a Quit Claim Deed to the adjoining property owners to the
North and South halves of said vacated property, more particularly
described as follows:
That portion of the unnamed East-West alley,
in Block 12 of BISCAYNE POINT, according to
the Plat thereof recorded in Plat Book 14 at
Page 35 of the Public Records of Dade County,
Florida, described as follows:
Bounded on the South by the North lines of
Lots 10, 11, 12 and 13 of said Block 12 ;
bounded on the West by the extension of said
alley up to the East line of said Lot 14 ,
running North ten feet; bounded on the North
by Lot 1 and the West 30 feet of Lot 2 of said
Block 12 ; and bounded on the East by the
extension of the East line of said Lot 10 and
the extension of the East line of the West 30
feet of Lot 2 ; being approximately 120 feet by
10 feet; subject to the reservation of a 10
foot utility easement, 5 feet on either side
of the centerline of the subject alley.

SUBJECT: REQUEST FOR VACATION OF ALLEY ON BISCAYNE POINT BETWEEN
NORTH BISCAYNE POINT ROAD AND CLEVELAND ROAD FROM NORTH
BISCAYNE POINT ROAD TO CECIL STREET
Mr. Melvin Richard has been retained by one of the property
owners in Block 12 , Biscayne Point Subdivision, to request vacation
of that portion of the alley located at the rear of his property,
similar to the Commission' s action on the same alley on Block 12 in
1983 . If the alley is vacated half of it would revert to each
abutting property owner.
The Public Works Department has reviewed the request and feels
that since it is an unpaved alley presently not used by the City,
and there are no existing utilities, there is no objection to its
vacation provided a ten-foot underground utility easement, five
feet on each side, is retained for possible future use.
Upon request of the City Attorney' s Office, Mr. Richard has
obtained a petition, in favor of said vacation, signed by all
current abutting property owners.
Also, in accordance with the Criteria/Standards for Vacation
Or Abandonment Of Streets Or Other Rights-Of-Way as adopted by the
City Commission in 1989, Mr. Richard has:
1. requested a waiver of the $5, 000. 00 processing fee
because a portion of this same alley was vacated in 1983
for his clients, even though he requested vacation of the
entire alley;
2 . submitted a copy of the warranty deed for said property
showing proof of current ownership by Mr. and Mrs. M.
Rotbart;
3 . stated in the petition how the vacation is in* the best
interest of the general public; and
4 . agreed to the vacation being subject to a 10 ' utility
easement for any future utilities.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission vacate
that portion of the unnamed alley, subject to the City' s
reservation of a utility easement.

PETITION FOR CITY OF MIAMI BEACH TO ABANDON AND VACATE
A PORTION OR ALL OF THE EAST-WEST STREET OR ALLEY
IN BLOCK 12 OF BISCAYNE POINT, ACCORDING TO THE
PLAT THEREOF RECORDED IN PLAT BOOK 14 , AT PAGE 35
OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA
We, the owners of the following lots in Block 12 of BISCAYNE
POINT, according to the Plat thereof recorded in Plat Book 14 , at
Page 35, of the Public Records of Dade County, Florida, MOISES
ROTBART and S I LV IA ROTBART, his wife, owner uf Lot 1 and wcst 30
feet of Lot 2 , ROSALYN DUBESHTER, owner of Lots 10 and 11, and
EDITH B. KAHN, owner of Lots 12 and 13 , petition the Miami Beach
City Commission either to abandon and vacate the entire 20 foot
East-West street or alley dedicated on the plat, or to abandon and
vacate that portion of such street or alley adjoining the said Lots
1 and west 30 feet of Lot 2 , and Lots 10 , 11 , 12 and 13 , and, upon
request of the adjoining property owners , to quit-claim 10 feet on
each side of said street or alley to the adjoining property owners .
Petitioners would show that the subdivision of BISCAYNE POINT
was platted and the subject street or alley was dedicated on the
plat in the year 1925 , that since that date, 65 years ago, the
subject street or alley has never been paved or otherwise used by
the city or by any utility, that in 1983 the city did abandon,
vacate and quit-claim to the owners of Lots 14 and 15 , in said
Block and subdivision the north 10 feet of said street or alley
immediately adjoining said Lots 14 and 15 , which makes it

impossiblecityever to pave or otherwise employ the use of

said street or alley, or otherwise provide for use of said street
by public,alleythe that the said street or alley serves no
public purpose for utilities or otherwise, that there have been
consistent encroachments on the street or alley by all lot owners
in said Block 12, that the adjoining property owners have fenced
the street or alley property and have taken and used same as part
of theirP rivate property, that both the east and west ends of said
street or alley have been fenced, that ingress or egress into or
out of said street is impossible and that the city has had to waste
time, effort, and money attempting to deal with the encroachments .

That portion of the unnamed East-West alley, in Block 12,
of Biscayne Point, according to the Plat thereof recorded
in Plat Book 14, at Page 35, of the Public Records of Dade
County, Florida, described as follows:
Bounded on the South by the North lines of Lots 10 and 11
of said Block 12; bounded on the East by the extension of
the East line of said Lot 10 running North 10 feet to the
center line of said unnamed East-West alley; bounded on
the North by the center line of said unnamed East-West
alley of said Block 12; and bounded on the West by the
extension of the West line of said Lot 11 running North 10
feet to the center line of said unnamed East-West alley,
being approximately 60 feet by 10 feet.
Subject, however, to reservation in Grantor of a five foot utility easement on
the South side of the center line of said alley.
This deed is intended to convey and perfect title to the portion of said alley,
described herein, in and to the Grantee, pursuant to Resolution No. 91-20250, duly
passed and adopted February 20, 1991 by the City Commission of the City of Miami
Beach, Florida, and duly recorded May 6, 1991 in Official Records Book 15010, at

Page 2982 of the Public Records of Dade County, Florida, in which the City of Miami
Beach, Florida, surrendered all of its right, title, and interest in and to that portion
of the East-West alley in Block 12, of Biscayne Point, according to the Plat thereof,
recorded Plat Book 14, at Page 35, of the Public Records of Dade County, Florida,
described herein.
IN WITNESS WHEREOF, the said Grantor has caused this Quitclaim Deed to
be signed by its duly authorized officer, the Mayor of the City of Miami Beach, and
attested by the City Clerk, and has caused its official seal to be affixed hereto, this
