HomeMy WebLinkAbout2003-25334 Reso RESOLUTION NO. 2003-25334 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY ADMINISTRATION TO SUBMIT AN UPDATED BEACHFRONT MANAGEMENT PLAN TO THE STATE OF FLORIDA, AS REQUIRED BY THE BEACHFRONT MANAGEMENT AGREEMENT BY AND BETWEEN THE CITY OF MIAMI BEACH AND THE STATE'S BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND WHEREAS, on February 3, 1982, the City of Miami Beach (City) entered into Management Agreement No. 750-0006 (renumbered 3595) with the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (State)for the management of the beach property from Government Cut to 87th Terrace for recreational and other related activities; and WHEREAS, the term of said Management Agreement is for a period of twenty five (25) years and provides that the City comply with applicable statutory requirements, which currently requires submittal of a management plan for said beachfront land, at least every five years; and WHEREAS, on January 8, 2003, the Administration presented the City Commission with a status report that included the City's submittal of an updated beachfront management plan to the State; and WHEREAS, in response to said submittal, the State's Department of Environmental Protection responded by providing additional information that affects individual management plans for parcels of over 160 acres, which require that said management plans be developed with input from an advisory group; and WHEREAS, on March 19, 2003, the Administration presented an item advising the Mayor and City Commission of the of the Advisory Group requirement, at which time the Administration was instructed to develop a list of potential advisory group nominees, by category, for the following City Commission meeting; and WHEREAS, on April 9, 2003, the Administration provided a list of potential candidates, to the Mayor and City Commission, at which time determination of the selected Advisory Group members were made; and WHEREAS, at the regularly scheduled City Commission meeting of July 30, 2003, the scheduling of a statutorily required public hearing, by the Advisory Group, was announced and set for August 20, 2003; and WHEREAS, on August 20, 2003, the Advisory Group conducted said duly noticed public hearing to review and discuss the Management Plan, and to obtain public input prior to making their final recommendations; and WHEREAS, the Advisory Group endorsed the overall Management Plan, by a vote of five (5) in favor, one (1) opposed, and one (1) absent; and WHEREAS, the Management Plan was also reviewed by the Beach Preservation Committee on August 12, 2003, and by the Marine Authority on September 9, 2003; and WHEREAS, the Administration recommends that the updated Management Plan, as endorsed by the Advisory Group, be submitted to the State, as required in accordance with the Management Agreement. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve a Resolution authorizing the City Administration to submit an updated Beachfront Management Plan to the State of Florida, as required by the Beachfront Management Agreement by and between the City of Miami Beach and the State's Board of Trustees of the Internal Improvement Trust Fund. Item SummarylRecomn~ndation: In 1982, the City entered into a 25 year Agreement with the State for the management of the beachfront from Government Cut to 87th Terrace, which requires that a Management Plan be submitted to the State, at least every 5 years (last submitted in October 1997). On January 8, 2003, the Administration presented a status report to the City Commission, including the submittal of an updated Management Plan. The State responded providing additional information that affects plans for parcels of over 160 acres (our beaches encumber 227 acres+i-), requiring that plans be developed with input from an advisory group. At the City Commission's direction the Administration developed a list of potential advisory group nominees. On April 9, 2003, the Mayor and City Commission selected the individuals to serve on the Advisory Group. The Advisory Group conducted a duly noticed public headng on August 20, 2003, reviewed and discussed the Management Plan, and sought and heard public input pdor to making final recommendations. Additionally, the Plan was reviewed by the Beach Preservation Committee on August 12, 2003, and by the Marine Authority on September 9, 2003. Copies of the respective meeting minutes are included and incorporated into the Management Plan. The Administration recommends adoption of the Resolution. As also required by statute, said public hearing was previously announced at the City Commission meeting of July 30, 2003. During the August 20, 2003 public hearing, the Advisory Group (except for Commissioner Cruz which due to unforeseen circumstances was unable to attend) reviewed and discussed the Management Plan and sought and heard public input, prior to making their final recommendations. The Advisory Group endorsed the overall Plan, by a vote of five (5) in favor, and one (1) opposed (Stuart Reed), one (1) absent. The summary minutes (attached hereto) of said public hearing, including the Advisory Group's recommendations, as well as the input received from the public, are included and incorporated in the Management Plan. Additionally, the Management Plan was reviewed by the Beach Preservation Committee on August 12, 2003 (minutes attached)and by the Marine Authority on September 9, 2003 (verbal report to be provided). Copies of the respective meeting minutes are also included and incorporated into the Management Plan. It is recommended that the Mayor and City Commission authorize the Administration to submit the attached Management Plan to the State of Florida, including the comments received during the Advisory Group public hearing and from various City committees.
