A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, URGING THE STATE LEGISLATURE
TO DEFEAT THE COMMITTEE SUBSTITUTES FOR PROPOSED
HOUSE BILL 1863 AND PROPOSED SENATE BILL 1808,
CURRENTLY UNDER CONSIDERATION BEFORE THE STATE
LEGISLATURE, WHICH WOULD AUTHORIZE AN INDIRECT,
DOLLAR-FOR-DOLLAR EXEMPTION FOR ALL REAL PROPERTY
AND OTHER TAXES OTHERWISE OWED TO MUNICIPALITIES BY
THEIR RESPECTIVE ELECTRIC UTILITY FRANCHISEE
WHEREAS, the Florida State Legislature is currently
considering the Committee Substitutes for House Bill (HB) 1863 and
Senate Bill (SB) 1808 which would authorize an indirect, dollar-
for-dollar exemption for all real property and other taxes
otherwise owed to municipalities by their respective electric
utility franchisee;
WHEREAS, the Florida League of Cities vehemently opposes the
passage of these bills because they "effectively nullify existing
franchise agreements and they clearly cripple the future ability of
local governments to negotiate favorable franchise agreements with
electric utilities" ; and
WHEREAS, the City Commission firmly believes that HB 1863 and
SB 1808 would constitute an intolerable intrusion on local
government home rule powers;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
Section 1: That the Florida State Legislature is hereby urged
to defeat the Committee Substitutes for House Bill 1863 and Senate
Bill 1808 which would authorize an indirect, dollar-for-dollar tax
exemption of all property and other taxes otherwise owed to a
municipality by its electric utility franchisee.
Section 2 : That the City Clerk is hereby authorized to
transmit certified copies of this Resolution to both Houses of the
State Legislature and to the Dade County legislative delegation and
the Executive Office of Governor.
