WHEREAS, in City of Miami Beach v. Herrera, Eleventh
Judicial Circuit Court, Case No. 88-46741 (South Pointe Elementary
School Project) , the City of Miami Beach, Florida, acquired title
to the following legally described properties on December 28 , 1988 :

NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the City of Miami Beach,
Florida, herewith formally requests exemption from taxes as of date
of acquisition of the property herein set forth, pursuant to
Florida Statutes, §196.28 .
BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA that a certified copy of this Resolution be
transmitted to the Metropolitan Dade County Commission, its County
Manager, its Tax Assessor and its Tax Collector.

SUBJECT: RESOLUTION REQUESTING TAX EXEMPTION FOR PROPERTY LOCATED
IN SOUTH POINTE ELEMENTARY SCHOOL EXPANSION PROJECT
On October 7 , 1987 , the City of Miami Beach adopted Resolution No.
87-19007 authorizing the institution of eminent domain proceedings
for the purpose of condemning the following described 16 parcels of
land in the South Pointe Elementary School Expansion Project.

On December 28 , 1988, the City of Miami Beach acquired title to the
aforementioned 16 parcels of land; therefore, pursuant to §196 . 28,
Florida Statutes, the City of Miami Beach must formally request
from Metro-Dade County exemption from real estate taxes as of date
of acquisition. Accordingly, the attached resolution has been
prepared as a housekeeping matter in order to formalize tax exempt
status on the parcels involved, which tax exemption has actually
been recognized by the County heretofore.
