A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RECOMMENDING
THAT THE CITY PENSION BOARD FOR UNCLASSIFIED
EMPLOYEES AND ELECTED OFFICIALS OF THE CITY OF
MIAMI BEACH REVIEW THE BASIS OF CALCULATING
THE PENSION BENEFIT OF FORMER CITY MANAGER,
ROB W. PARKINS, TO SEE IF AN ERROR WAS MADE BY
INCLUDING THE DEFERRED COMPENSATION IN
PENSIONABLE EARNINGS AND IF SO TO WITHHOLD
FROM ALL FUTURE RETIREMENT BENEFIT PAYMENTS TO
BE MADE TO FORMER CITY MANAGER, ROB W.
PARKINS, THE PORTION OF SUCH BENEFIT WHICH IS
BASED UPON THE $7,500 IN DEFERRED COMPENSATION
AWARDED TO HIM BY THE CITY COMMISSION ON JULY
11, 1990 WHICH MAY HAVE BEEN ERRONEOUSLY
TREATED AS PENSIONABLE SALARY AND THAT ANY
SUCH PAYMENTS MADE PRIOR TO SAID DETERMINATION
BE DEDUCTED FROM MR. PARKINS FUTURE PENSION
BENEFIT PAYMENTS.
WHEREAS, on July 11, 1990, the City Commission awarded $7, 500
in deferred compensation to the then City Manager Rob W. Parkins;
and
WHEREAS, the City Commission did not intend that the $7 , 500 in
deferred compensation, which it granted to former City Manager Rob
W. Parkins on July 11, 1990, be subject to pension benefits; and
WHEREAS, the City Commission believes that Rob W. Parkins has
been receiving excessive retirement benefits based upon an
erroneous $7 , 500 increase in pensionable earnings; and
WHEREAS, the City Commission believes that such pension
benefits may be based upon an error in calculation by including
deferred compensation as pensionable earnings, and if so, the
erroneous amount should be discontinued at once; and
WHEREAS, the City Commission of the City of Miami Beach
wishes to express its grave concern about the possible
miscalculation of former City Manager Rob W. Parkins ' pension
benefits, which may have been based upon the erroneous inclusion of
deferred compensation as pensionable earnings.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
1. When the City Commission acted on July 11, 1990 it did
not intend that the $7 , 500 in deferred compensation
granted to former City Manager Rob W. Parkins be subject
to pension benefits; and
2 . The City Commission hereby recommends that the City
Pension Board for Unclassified Employees and Elected
Officials of the City of Miami Beach review the basis of
calculating the pension benefit of former City Manager,
Rob W. Parkins to see if an error was made by including
the deferred compensation in pensionable earnings, and if
so, to withhold from all future retirement benefit
payments to be made to former City Manager, Rob W.
Parkins, any portion of such benefit which is based upon
the $7, 500 in deferred compensation awarded to him on
July 11, 1990 by the City Commission which may have been
erroneously treated as pensionable salary and that any
such payments made prior to said determination be
deducted from Mr. Parkins future pension benefits.
PASSED and ADOPTED this 11th day of September, 1991.
