A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING FUNDING, AND
RETROACTIVELY APPROVING AND AUTHORIZING THE CITY
MANAGER, OR HIS DESIGNEE, TO APPLY FOR AND ACCEPT
FUNDING (INCLUDING MATCHING FUNDS AND ANY RELATED CITY
EXPENSES), FROM THE U.S. DEPARTMENT OF JUSTICE, OFFICE OF
JUSTICE PROGRAMS, FOR THE FISCAL YEAR 2019 EDWARD BYRNE
MEMORIAL JUSTICE ASSISTANCE GRANT ("JAG") PROGRAM, IN
THE APPROXIMATE AMOUNT OF $67,845; AND FURTHER
AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO
EXECUTE ANY AND ALL DOCUMENTS OR AGREEMENTS IN
CONNECTION WITH THE GRANT APPLICATION.
WHEREAS,the City Administration requests approval to submit a grant application
to the U.S. Department of Justice, Office of Justice Programs, for the Fiscal Year 2019
Edward Byrne Memorial Justice Assistance Grant ("JAG") Program, in the approximate
amount of$67,845; the details of which are as follows:
WHEREAS, the Edward Byrne Memorial Justice Assistance Grant ("JAG")
Program (42 U.S.C. 3751(a)), is the primary provider of federal criminal justice funding to
state and local jurisdictions; and
WHEREAS, the JAG Program provides states and units of local governments with
critical funding necessary to support a range of program areas; and
WHEREAS, JAG funds may be used for local initiatives such as additional
personnel, equipment, supplies, contractual support, training, technical assistance, and
information systems for criminal justice, including any one or more of the following:
• Law enforcement programs.
• Prosecution and court programs
• Prevention and education programs.
• Corrections and community corrections programs.
• Drug treatment and enforcement programs.
• Planning, evaluation, and technology improvement programs.
• Crime victim and witness programs (other than compensation).
• Mental health programs and related law enforcement and corrections programs.
WHEREAS, the Department of Justice requires that the applicant agency accepts
certain Certifications and Assurances; and
WHEREAS, these Certifications and Assurances include, but are not limited to the
following three items which are summarized as follows: (1) JAG funds may not be used
to supplant state or local funds but must be used to increase the amounts of such funds,
that would, in the absence of federal funds, be made available for law enforcement
activities; (2) the application must be made available for review by the governing body;
and, (3) the application must be made,public and an opportunity to comment on the
application provided to citizens. In addition, the City is required to certify that it complies
with prohibitions on certain actions regarding information regarding citizenship and
immigration status and complies with 8 U.S.C. §§ 1373 &1644; and
WHEREAS, the purpose of this agenda item is to ensure that the information
regarding the Fiscal Year 2019 JAG application is available to the public; and
WHEREAS, in addition to this agenda item, information regarding this grant and
the grant application are available on the City's website at:

comment; and
WHEREAS, the City's Application is for Video analytics Solution for Private Video
Footage Evidence; and
WHEREAS, the City is requesting funds in the amount of $67,845 to be used to
purchase the equipment necessary for the extraction and collection of outside video
evidence and to cover the cost associated with training one (1) detective to function as
the primary investigator for all digital and video evidence; and
WHEREAS, the training courses are offered by the Law Enforcement Video
Association International, Inc. ("LEVA"), an organization known as the authority on
forensic video analysis; and
WHEREAS, technological resources are critical to the success of Miami Beach
Police Department (MBPD) and are needed to assist in reducing crime, enhancing officer
safety, and strengthening community safety, well-being, and confidence; and
WHEREAS, While the City has a network of public surveillance cameras on the
public right-of-way, MBPD needs to purchase equipment to assist in the extraction and
collection of outside video evidence, such as DVRs and NVRs owned by private citizens;
and
WHEREAS, MBPD faces the same challenge with digital evidence contained
within mobile devices and computers. Currently, in order to process evidence, MBPD
requests assistance from other agencies and sends videos to Miami-Dade Police
Department and federal agencies for processing. Depending on the type of crime being
investigated, as well as the workload and priorities of the agency processing the
video/digital evidence, the wait time for MBPD varies from one day to several months;
and
WHEREAS, the Administration is therefore requesting funding through the FY
2019 JAG grant application to purchase equipment for forensic video analysis and data
extraction and to cover the cost associated with training one (1) detective to function as
the primary investigator for all MBPD digital and video evidence that will enable the MBPD
to keep the City of Miami Beach safer; and
WHEREAS, the following project identifiers are associated with the proposed
activities: surveillance, prosecution, equipment-video/audio, equipment-forensic,
computer software/hardware, criminal intelligence, crime prevention, adjudication and
conferences, and training; and
WHEREAS, the Budget is as follows:
• Equipment: $54,616
• Travel: $10,520
• Mandatory 3% Set-aside for National Incident-Based Reporting System
(NIBRS): $2,036
• Administrative Costs 1%: $673
• Total Grant Award: $67,845
WHEREAS, matching funds are not required for this grant.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby appropriate funding, and retroactively approve and authorize the City
Manager, or his designee, to apply for and accept funding (including matching funds and
any related City expenses), from the U.S. Department of Justice, Office of Justice
Programs, for the Fiscal Year 2019 Edward Byrne Memorial Justice Assistance Grant
("JAG") Program, in the approximate amount of $67,845; and further authorize the City
Manager, or his designee, to execute any and all documents or agreements in connection
with the grant application.

ANALYSIS
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program (42 U.S.C. 3751(a)) is
the primary provider of federal criminal justice funding to state and local jurisdictions. The JAG
Program provides states and units of local governments with critical funding necessary to
support a range of program areas. JAG funds may be used for local initiatives such as
additional personnel, equipment, supplies, contractual support, training, technical assistance and
information systems for criminal justice , including any one or more of the following:
• Law enforcement programs.
• Prosecution and court programs
• Prevention and education programs.
• Corrections and community corrections programs.
• Drug treatment and enforcement programs.
• Planning,evaluation, and technology improvement programs.
• Crime victim and witness programs (other than compensation).
• Mental health programs and related law enforcement and corrections programs.
