Resolution 2019-30944 RESOLUTION NO. 2019-30944 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A NON-EXCLUSIVE UTILITY EASEMENT, IN THE FORM ATTACHED TO THIS RESOLUTION AS EXHIBIT "1", OF APPROXIMATELY 1,626 SQUARE FEET, IN FAVOR OF FLORIDA POWER AND LIGHT (FPL) AT THE COLLINS PARK PARKING GARAGE PROPERTY, LOCATED AT 340 23 STREET, ON LOTS 1, 2 3 AND 4, BLOCK 1, AS RECORDED IN PLAT BOOK 5, PAGE 7, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A VAULT ROOM, DUCT BANK AND ASSOCIATED EQUIPMENT TO SERVE THE COLLINS PARK PARKING GARAGE. WHEREAS, on September 25, 2017, the Mayor and City Commission adopted Resolution No. 2017-30021, approving a new Design/Build contract with KVC Constructors, Inc. (KVC) for the design and construction of the Collins Park Parking Garage (Garage) structure, which lies between Park Avenue and Liberty Avenue from 22nd Street to 23rd Street; and WHEREAS, to provide electrical service to the new parking garage, Florida Power and Light (FPL) will require an easement in the total amount of 1,626 square feet to install and maintain a vault room and a portion of the duct bank located on the City's property; and WHEREAS, a 776.7 square feet vault is needed on the first level of the garage to house the FPL switchgear equipment, plus an additional 849.6 square feet within the entrance ramp of the new garage to run the required duct bank to the vault room; and WHEREAS, FPL requires the execution of a non-exclusive easement to install the portion of the duct bank within the property limits and place its electrical service equipment within the vault; and WHEREAS, the easement grants FPL access to install, service and maintain the duct bank and equipment within the vault located on the City's property; and WHEREAS, the parties have expended time and resources assessing the site conditions to determine the most suitable route for the FPL duct bank and vault; and WHEREAS, the Administration recommends approving and authorizing the execution of the non-exclusive easement to FPL, in the form attached to this Resolution as Exhibit "1", to provide electrical service to the new Parking Garage. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby authorize the Mayor and City Clerk to execute a non-exclusive utility easement, in the form attached to this Resolution as Exhibit "1", of approximately 1,626 square feet, in favor of Florida Power and Light (FPL) at the Collins Park Parking Garage Property, Located at 340 23rd Street, on Lots 1, 2, 3, and 4, Block 1, as recorded in Plat Book 5, of the Public Records of Miami- Dade County, for the installation, operation and maintenance of a vault room, duct bank and associated equipment to serve the Collins Park Parking Garage. The Garage is being constructed on three lots which lie between Park Avenue and Liberty Avenue from 22nd Street to 23rd Street. In order to provide electrical service to the new parking garage, Florida Power and Light (FPL) will require an easement in the total amount of 1,626 square feet in order to install and maintain the vault room and portion of the duct bank located on the City's property. A 776.7 square feet vault is needed on the first level of the garage to house the FPL switchgear equipment, plus an additional 849.6 square feet within the entrance ramp of the new garage to run the required duct bank to the vault room. The FPL duct bank that will service the garage to install from an existing FPL manhole located within the public right-of-way of 23rd Street, south along Liberty Avenue to the entrance ramp of the new parking garage and west into to the FPL vault room. FPL requires the execution of a non-exclusive easement to install the portion of the duct bank within the property limits and place its electrical service equipment within the vault. The easement grants FPL access to install, service and maintain the duct bank and equipment within the vault located on the City's property. The declaration of easement and survey describing the limits of the easement to be recorded per FPL requirements are included herein as Attachment Page 288 of 2228 A.
