RESOLUTION 92-20430 RESOLUTION NO. 92-20430 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE COMPLETION AND SUBMISSION OF AN APPLICATION FOR FUNDING UNDER THE EMERGENCY SHELTER GRANT PROGRAM TO THE U. S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) , PURSUANT TO TITLE IV OF THE STEWART B. MCKINNEY HOMELESS ASSISTANCE ACT, PL 100-77 (7/22/87) AND SECTION 485 OF THE STEWART B. MCKINNEY HOMELESS ASSISTANCE AMENDMENTS ACT OF 1988, PL 100-628 (8/10/88) ; AND AUTHORIZATION TO APPROPRIATE SUCH FUNDS WHEN RECEIVED. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA; WHEREAS, on July 22 , 1987, President Reagan signed into law the Stewart B. McKinney Homeless Assistance Act intended to provide urgently needed assistance to protect and improve the lives of the homeless; and WHEREAS, the City of Miami Beach was allocated $46, 000 for Fiscal Year 1992 to be used for either rehabilitation, operation or maintenance, the provision of essential services, the development of homeless prevention activities, or an appropriate combination of the four, at a shelter for the homeless; and WHEREAS, there is no shelter currently in operation within the City of Miami Beach and the City's allocation of $46, 000 is insufficient to undertake or implement a new project within the City; and WHEREAS, Miami Beach displaced residents who have been unable to obtain adequate housing through their own means require shelter. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager be authorized and directed to complete and submit the application for funding under the Emergency Shelter Grant Program to the U. S. Department of Housing and Urban Development by February 6, 1992 . Further, that the Administration be authorized to appropriate such funds when received. S. DEPARTMENT OF HUD @ $46,000 On January 3 , 1992 , the City received official notification from the U. S. Department of Housing and Urban Development (HUD) , of our allocation @ $46, 000 for Fiscal Year 1992 , under the Emergency Shelter Grant Program (ESGP) . In prior years, the City utilized its allocation for capital improvements and the continued operating and maintenance costs at the Miami Mission Association, Inc. (MMA) , a shelter for homeless women and children which gave priority placement to Miami Beach's homeless women and children at their facility. MMA over the years has provided outstanding service to the community during its tenure with the City. However, this year, MMA has advised us that they will not seek federal support under this program. This decision stems from their desire and commitment to conduct religious teaching and counseling services. As a recipient of federal funds this type of activity is prohibited since it violates First Amendment rights-- separation of church and state. Regreattably, our contractual relationship with the MMA will conclude. As there is no shelter currently in operation within the City of Miami Beach, and the City's annual allocation of $46, 000 is insufficient to either undertake or implement a new activity within the City, or to sustain and operate a shelter annually, we find an unique opportunity has presented itself, as we must now choose a new service provider. Consequently, we will be requesting proposals through a competitive process from qualified outside agencies to provide these services to Miami Beach homeless population. Proposals received will be objectively evaluated and ranked by the administration. At that juncture, we will then present you with a recommendation for approval, and request authorization to execute a corresponding agreement with the selected service provider. Therefore, at this time, will plan to submit the application to U. S. This use of the funds has proven to be the most beneficial to the clients and the City since the annual allocations were insufficient to undertake a new project within Miami Beach and an agreement was reached that priority placement would be given to the housing needs of Miami Beach residents. The City of Miami Beach is proposing to use the 1992 allocation for either the operation and maintenance or provision of essential services at an emergency shelter for the homeless. The match for the grant will be provided by the selected provider(s) . -3- City of Miami Beach Standard Form 424 , Page 3 Process and Criteria for Awarding Grant Funds When the City received its first allocation of Emergency Shelter Grant Program (ESGP) funds @ $30, 000, we combined such with Dade County's initial allocation, in order to undertake the renovation of a shelter for homeless women and children. The City of Miami Beach has had a contractual agreement with the Miami Mission Association, Inc. (MMA) Women and Children's Shelter, for the past five years during which outstanding service was provided to the community. However, this year, MMA has advised us that they will not seek federal support under this program. This decision stems from their desire and commitment to conduct religious teaching and counseling services, in the future, which is expressly prohibited under the terms of our agreement. As we have previously advised HUD, the City' s annual allocation of ESGP funds have been insufficient to renovate and operate a shelter in Miami Beach; therefore, we must now choose a new service provider. We propose to meet this need by requesting proposals through a competitive process from qualified outside agencies to provide these services to Miami Beach residents. A time line for completion of this task is outlined in Attachment 1 to this document. Should a modification be necessary, we will provide such to HUD, in writing. -7- r V LOCAL GOVERNMENT GRANTEE EMERGENCY SHELTER GRANTS PROGRAM CERTIFICATIONS BY THE CHIEF EXECUTIVE OFFICER I, Carla Bernabei Talarico, Chief Executive Officer of the City of Miami Beach, Florida, certify that the local government will ensure the provision of the matching supplemental funds required by the regulation at 24 CFR 576.71. I have attached to this certification a description of the sources and amounts of such supplemental funds. I further certify that the local government will comply with: (1) The requirements of 24 CFR 576. 21 (a) (4) (ii) providing that the funding of homeless prevention activities for families that have received eviction notices or notices of termination of utility services will meet the requirements that (A) the inability of the family to make the required payments must be the result of a sudden reduction in income; (B) the assistance must be necessary to avoid eviction of the family or termination of the services to the family; (C) there must be a reasonable prospect that the family will be able to resume payments within a reasonable period of time; and (D) the assistance must not supplant funding for preexisting homeless prevention activities from any other source. (2) The requirements of 24 CFR 576. 51 (b) (2) (v) concerning the funding of emergency shelter in the hotels or motels or commercial facilities providing transient housing. (3) The requirements of 24 CFR 576.73 concerning the continued use of buildings for which emergency shelter grants are used for rehabilitation or conversion of buildings for use as emergency shelters for the homeless; or when funds are used solely for operating costs or essential services, concerning the population to be served. (4) The building standards requirement of 24 CFR 576. 75 ; (5) The requirements of 24 CFR 576.77, concerning assistance to the homeless; and (6) The requirements of 24 CFR 576.79, other appropriate provisions of 24 CFR Part 576, and other applicable Federal laws concerning nondiscrimination and equal opportunity. -8- (7) The requirements of 24 CFR 576.80 concerning the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970. (8) The requirement of 24 CFR 576. 80 concerning minimizing the displacement of persons as a result of a project assisted with these funds. (9) The requirements of 24 CFR Part 24 concerning the Drug Free Workplace Act of 1988 . (10) The requirement of the National Affordable Housing Act (Pub. L. 101-625, November 28, 1990) contained in Section 832 (e) (2) (C) that grantees develop and implement procedures to ensure the confidentiality of records pertaining to any individual provided family violence prevention or treatment services under any project assisted" under the Emergency Shelter Grants Program and "that the address or location of any family violence shelter project assisted" under the Emergency Shelter Grants Program "will, except with written authorization of the person or persons responsible for the operation of such shelter, not be made public. " I further certify that the local government will comply with the provisions of, and regulations and procedures applicable under, section 104 (g) of the Housing and Community Development Act of 1974 with respect to the environmental review responsibilities under the National Environmental Policy Act of 1969 and related authorities as specified in 24 CFR Part 58. On January, 1989, the City prepared an environmental review of this program. That review was intended to encompass more than one funding year of the program. The description of the activities to be undertaken with this new funding allocation (Fiscal Year 1992) is substantially the same, i.e. , homeless prevention, operations, essential services. Under 24 CFR Part 58. 34 (b) a recipient does not have to submit a Request for Release of Funds (RROF) and certification, and no further approval from HUD will be needed by the recipient for the drawdown of funds to carry out this project. It is found that the project is not a major federal action which would significantly affect the quality of the human environment. No further environmental review action is necessary for the release of funds.
