Resolution 2019-30985 • Resolution No. 2019-30985 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) 2019-093-JC, FOR RED LIGHT VIOLATION CAMERA ENFORCEMENT SYSTEM AND RELATED SUPPORT SERVICES; AUTHORIZING THE ADMINISTRATION TO ENTER INTO SIMULTANEOUS NEGOTIATIONS WITH CONDUENT STATE & LOCAL SOLUTIONS, INC., THE TOP-RANKED PROPOSER, AND AMERICAN TRAFFIC SOLUTIONS, INC., DBA VERRA MOBILITY, THE SECOND-RANKED PROPOSER; AND FURTHER, PROVIDING THAT THE FINAL SELECTION OF THE RECOMMENDED PROPOSER AND APPROVAL OF MATERIAL TERMS FOR THE AGREEMENT SHALL BE SUBJECT TO THE PRIOR APPROVAL OF THE MAYOR AND CITY COMMISSION. WHEREAS, on December 10, 2008, the Mayor and City Commission enacted Ordinance No.. 2008-3621, creating Article XI entitled "Dangerous Intersection Safety" of Chapter 106 of the Miami Beach Code, entitled "Traffic and Vehicles"; and WHEREAS, the Florida Legislature enacted the Mark Wandall Traffic Safety Program (the "Wandall Act"), which is set forth in Section 316.0083 of the Florida Statutes, and became effective on July 1, 2010; and WHEREAS, The Wandall Act authorizes a county or municipality to utilize red light cameras for its traffic enforcement efforts; and WHEREAS, on April 10, 2019, the City Commission approved the issuance of RFP (the "RFP") No. 2019-093-JC, Red Light Violation Camera Enforcement System and Related Support Services; and WHEREAS, on April 10, 2019, the City Manager, appointed an Evaluation Committee (the "Committee"), comprised of David Price, Sergeant, Miami Beach Police Department; Wendy Rich-Goldschmidt, Chief of Staff, Miami Beach Police Department; and, Allison Williams, Deputy Finance Director, City of Miami Beach Finance Department; and WHEREAS, the Procurement Department issued solicitation notices to 340 firms utilizing www.publicpurchase.com; with 107 prospective proposers accessed the RFP notice; and WHEREAS, a voluntary pre-proposal conference was held on April 24, 2019; and WHEREAS, Proposals were due and received on June 14, 2019; and WHEREAS the City received a total of five (5) proposals; and WHEREAS, the Committee convened on June 25, 2019, to consider the proposals received; and WHEREAS, the Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law, as well as general information on the scope of services and a copy of each proposal, and was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFP; and WHEREAS, the City's evaluation process, including qualitative and quantitative factors, resulted in the following order of ranking: 1st- Conduent State & Local Solutions, Inc.; 2nd -American Traffic Solutions, Inc., dba Verra Mobility; 3rd - RedSpeed Florida, LLC; . 4th - Sensys Gatso Group (tied); 4th - Sensys America, Inc (tied); and WHEREAS after reviewing the results of the Evaluation Committee process, and the proposals received, the City Manager has exercised his due diligence and recommends that the Mayor and City Commission authorize the Administration to enter into simultaneous negotiations with the two (2) top ranked proposers, Conduent State & Local Solutions, Inc., and American Traffic Solutions, Inc., dba Verra Mobility, with the final selection of the recommended proposer subject to the prior approval of the Mayor and City Commission. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager, pursuant to Request for Proposals (RFP) No. 2019-093-JC, for Red Light Violation Camera Enforcement System and Related Support Services; authorize the Administration to enter into simultaneous negotiations with Conduent State & Local Solutions, Inc., the top-ranked proposer, and American Traffic Solutions, Inc., .dba Verra Mobility, the second-ranked proposer; provided that the final selection of the recommended proposer and approval of material terms for the Agreement shall be subject to the prior approval of the Mayor and City Commission. Morales, City Manager DATE: September 11, 2019 SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 2019-093-JC, FOR RED LIGHT VIOLATION CAMERA ENFORCEMENT SYSTEM AND RELATED SUPPORT SERVICES. RECOMMENDATION The administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida approve the City Manager's recommendation pertaining to the proposals received pursuant to RFP for red light cameras. ANALYSIS On December 10, 2008, the Mayor and City Commission enacted Ordinance No. 2008 3621, creating Article XI entitled "Dangerous Intersection Safety" of Chapter 106 of the Miami Beach Code, entitled "Traffic and Vehicles". This provision authorizes the enforcement of red light infractions through the utilization of an automated image capture technology in an effort to reduce traffic crashes and resulting injuries. Installation of this system consists of a camera, strobe and two lasers mounted on a metal pole near an intersection with a traffic light. This equipment is designed to monitor the traffic light signal phases and upon the light turning red any vehicle proceeding into the intersection without stopping will be photographed and captured on video. The images are then electronically forwarded to the vendor reviewed for quality and then sent to a Miami Beach Police Department ("MBPD") employee for review to determine if an infraction has occurred. If MBPD determines an infraction has taken place, an infraction notice is then sent to the violator via United States Postal Service ("USPS"). The Florida Legislature enacted the Mark Wandall Traffic Safety Program (the "Wandall Act"), which is set forth in Section 316.0083 of the Florida Statutes, and became effective on July 1, 2010. The Wandall Act authorizes a county or municipality to utilize red light cameras, wherein the images captured by the red light cameras are reviewed by traffic enforcement officers ("local law enforcement officers")before issuance of a traffic violation for proceeding through an intersection that is illuminated by a steady red signal. In the interest of public safety, the City's Administration monitored the use of this emerging technology for a few years before pursuing a red light camera enforcement program. As a result Page 1667 of 2228 or its findings, the City determined it was in its best interests to issue RFP 02-08/09 in November 2008, in order to bring a red light violation camera enforcement system to the City of Miami Beach. The City's Red Light Camera Program ("RLCP") has been operational since April 15, 2010. The City has continued to utilize the awarded vendor, Conduent, Inc. ("City Vendor"), as its third-party service provider, since the City's RLCP inception. In anticipation of a replacement contract, the City issued RFP 2016-046-KB on February 16, 2016, for a red light camera violation enforcement system and related support services, with an opening date of July 14, 2016, in which the City received six (6) proposals. However, on December 14, 2016, via resolution No. 2016-29664,the Mayor and City Commission accepted the recommendation of the City Manager to reject all proposals received and further authorized the City Administration to issue a new RFP. Subsequently as documented in LTC 265-2018, local government RLCPs were most recently challenged in both State and Federal Court, and these lawsuits sought to invalidate the legal authority of the a local government, such as the City of Miami Beach, to enter into a contractual agreement that would allow a private, third-party vendor to screen photo images and make an initial determination of whether the recorded images should be forwarded to the City's Police Department for issuance of a violation for the traffic infraction. Until recently, legal actions have delayed and impeded the issuance of the City's RFP for a replacement program. In response to recent court rulings allowing the continuation of red light camera programs, the City proceeded with the development and issuance of an RFP. RFP PROCESS On April 10, 2019, the City Commission approved the issuance of the RFP No. 2019-093-JC, Red Light Violation Camera Enforcement System and Related Support Services, which was issued on April 10, 2019. The Procurement Department issued solicitation notices to 340 firms utilizing www.publicpurchase.com. 107 prospective proposers accessed the advertised solicitation. RFP responses were due and received on June 14, 2019. The City received a total of five (5) proposals from the following firms: • American Traffic Solutions, Inc., dba Verra Mobility("Verra") • Conduent State & Local Solutions, Inc. ("Conduent") • RedSpeed Florida, LLC • Sensys America, Inc • Sensys Gatso Group O n April 10, 2019, the City Manager appointed the Evaluation Committee via Commission Memorandum. The Evaluation Committee convened on June 25, 2019, to consider proposals received. The Committee was comprised of the following: David Price, Sergeant, Miami Beach Police Department; Wendy Rich-Goldschmidt, Chief of Staff, Miami Beach Police Department; and,Allison Williams, Deputy Finance Director, Finance Department, City of Miami Beach. The Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law. The Committee was also provided with general information on the scope of services and a copy of each proposal. The Committee was instructed to score each proposal pursuant to the evaluation criteria established in the RFP. The City's evaluation process resulted in the ranking of proposers as indicated in Attachment A, in the following order: Page 1668 of 2228 1st- Conduent State & Local Solutions, Inc. 2rld-American Traffic Solutions, Inc., dba Verra Mobility 3'd- RedSpeed Florida, LLC 4th- Sensys Gatso Group(tied) 4th- Sensys America, Inc (tied) The following is a brief summary of the qualifications of the two (2) top ranked proposers, as provided in their response to the RFP. Conduent State & Local Solutions. Inc. According to its proposal, Conduent is a leading provider of photo enforcement systems across North America, and is\the largest producer of public safety, parking, and moving violation notices in the country. Conduent provides similar services to many major jurisdictions using including Los Angeles, CA, Garland, TX, City of Chicago, Ill, Delaware Department of Transportation (DeIDOT), and Montgomery County, MD. Conduent maintains over 1,500 individual photo enforcement systems under contract in North America. Conduent brings over 20 years of experience to the City of Miami Beach. American Traffic Solutions, Inc.,dba Verra Mobility According to its proposal, Verra is a provider of red light camera solutions for large-city programs across the United States, including, Tampa, FL, Orlando, FL, New York City, NY, Memphis, TN, Washington, D.C., and Seattle, WA. Additionally, Verra maintains over 30 programs within the state of Florida, and 10 programs within Miami-Dade County. Verra brings over 25 years of experience to the City of Miami Beach, and is an industry leader capable of delivering up-level technology applications for the City's red light safety program. CONCLUSION I have reviewed the RFP, the proposals received and the results of the Evaluation Committee. In doing so, I find as follows. I believe that the City is fortunate to have received five (5) responses to the RFP. Most of the companies that responded appear to have the qualifications and background to assist the City with red light camera enforcement products and services. Regarding the two top ranked firms, I find that both Conduent State & Local Solutions ("Conduent")and Verra Mobility("Verna")are closely ranked. When only qualifications are considered, Verra receives top ranking from the Evaluation Committee process. When qualifications and cost are both considered, Conduent becomes the top-ranked proposers. In my opinion, both are well qualified and the cost difference between the two proposals is not major. Conduent's expertise and strong market presence is a critical factor as the City continues operating its red light camera enforcement program.Verna also presented a strong proposal and a full range of systems options. Because qualifications and cost are comparable, I believe it is in the City's best interest to consider both firms during the negotiation phase. Therefore, I recommend that the Mayor and City Commission approve the Resolution Page 1669 of 2228 authorizing the Administration to enter into simultaneous negotiations with Conduent State & Local Solutions, Inc., the top-ranked proposer, and American Traffic Solutions, Inc., dba Verra Mobility, the second-ranked proposer; and further, providing that the final selection of the recommended proposer and approval of material terms for the project shall be subject to the prior approval of the Mayor and City Commission.
