A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ,ACCEPTING THE RECOMMENDATION OF THE
ART IN PUBLIC PLACES COMMITTEE ("AIPP COMMITTEE"), AND
APPROVING THE ESTABLISHMENT OF A"LEGACY PROGRAM" BETWEEN
THE CITY OF MIAMI BEACH AND ART BASEL MIAMI BEACH, FOR THE
SELECTION AND PURCHASE OF ARTWORKS BY MID-CAREER OR
ESTABLISHED, INTERNATIONALLY RECOGNIZED ARTISTS WHO ARE
REPRESENTED AT THE ANNUAL ART BASEL EXHIBITION AT THE MIAMI
BEACH CONVENTION CENTER, WITH ANY SUCH ACQUISITIONS TO BE
MADE PURSUANT TO (1) THE RECOMMENDATIONS OF THE AIPP
COMMITTEE IN ACCORDANCE WITH THE SELECTION CRITERIA SET
FORTH IN THE CITY'S AIPP ORDINANCE AND AIPP GUIDELINES, (2)
APPROVAL BY THE CITY COMMISSION, IN ACCORDANCE WITH SECTION
82-612(F) OF THE CITY CODE, AND (3) A PUBLIC VOTE PROCESS (VIA AN
ELECTRONIC MEDIUM TO BE DETERMINED BY THE ADMINISTRATION),
TO PROVIDE THE PUBLIC WITH THE OPPORTUNITY TO PARTICIPATE IN
THE FINAL SELECTION' OF THE FINAL ARTWORK(S) THAT WILL BE
INCLUDED IN THE CITY OF MIAMI BEACH ART IN PUBLIC PLACES
COLLECTION, AND THEREBY PROMOTE THE PUBLIC'S ENGAGEMENT
WITH.THE CITY'S AiPPCOLLECTION.
WHEREAS, the Art in Public Places:(AiPP) Ordinance, as set forth in Sections 82-536
through 82-612 of the City Code, was created to "enhance the aesthetic environment of the City
of Miami Beach by including works of art on public property within the City and in 'City
construction projects"; and
WHEREAS, the AiPP program is funded by 1 'A % of all hard costs of certain covered
City projects, including new construction, additions, and costs for construction of joint
private/public projects. The fund is used for the commission or acquisition of works of art;
conservation and maintenance of works of art; research and evaluation of works of art printing
and distribution of related materials; and administration; and
WHEREAS, the goals of the AiPP program are; overseeing the City's public art
collection; enhancing the physical environment of Miami Beach with artworks of the highest
level of quality and suitability for the site; serving as the coordinating body for all public art
projects on City property, building partnerships with the private sector, non-profit and community
groups that connect the AIPP projects to the life of the City; encouraging participation by artists
based locally, nationally and internationally; and serving as a source of information about public
art; and
WHEREAS, in a continued effort to support partnerships and build the Miami Beach Art
in Public Places Collection in a thoughtful, strategic way that promotes community engagement
with the City's AiPP Program, the City and Art Basel Miami Beach desire to establish a legacy
purchase program (the "Legacy Program"), to Support artists and art galleries that participate in
Art Basel Miami Beach by purchasing moveable works of art for display in public areas within
City of Miami Beach buildings;and

WHEREAS, the Legacy Program will include,a process for the selection and acquisition
of one or more works of art'by an artist who is represented at the Art Basel exhibition, with a
process that includes (1) the recommendation of short listed works by the AIPP Committee, in
'accordance with the criteria set forth in. the AiPP Ordinance, (2) the approval of the City
Commission of the short listed works and delegation of authority to the City Manager to
purchase, during the Art Basel event, the'short listed work that receives,the greatest number of
votes; pursuant to a public vote process, via an electronic medium to be determined by the
Administration,to promote engagement with the City's AiPP Program; and
WHEREAS, on August,27, 2019, the Art in Public Places Committee recommended
using existing funds in the amount of>$100,000 (Fund "147) to establish the first fund for the
acquisition of works represented at the annual Art Basel event; and
WHEREAS, Art in Public Places 'Fund 147 currentlyholds an available balance of
$182,954. This amount does not include the contingency balance available from the. Miami
Beach Convention Center public art projects, which at close out of the projects,. will generate
approximately $100,000 to Fund 147. It is anticipated the Miami Beach Convention Center
public art project close out will occur in.December 2019;.and
WHEREAS, the Art in. Public Places Committee anticipates that it will short list a
selection of artworks in October, 2019,:to permit the:City Commission consideration of the short,
list ata City Commission meeting in October, 2019;.and
WHEREAS, in view of the lack of a regularly scheduled City Commission meeting during
the Art Basel event period and the associated timing constraints, the Administration
recommends that once the City Commission approves the short list, it also delegate to the City
Manager the authority topurchase the final work of art that receives the greatest number of
public votes;:and
WHEREAS, 'notwithstanding the public vote process, the shortlisted artworks (and
accordingly, the final work selected for purchase)will be selected based on artistic excellence,
relevance of the artwork in terms of current artistic practice, national and international
representation, suitability of the artwork in a public:environment and investment value to the Art
in Public Places Collection, The artwork with the most votes will be acquired by the Art in Public
Places Program and become part of the Miami Beach Art in Public Places Collection.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby accept tha recommendation of the Art in Public Places Committee ("AiPP
Committee"), and approve the establishment:of.a "Legacy Program" between the:City of Miami
Beach and Art Basel Miami Beach,'for the selection and purchase of artworks by mid-career or
.established, internationally recognized artists who are.:representedat the annual Art Basel
exhibition at -the Miami Beach Convention Center, with any such acquisitions to be made
pursuant to (1) the recommendations of the AiPP Committee, in accordance with the selection
criteria set fOrth in the City's AiPP :Ordinance and. AiPP Guidelines; (2) approval by the City
Commission, in accordance with section -82=612(f) of the City Code, and (3), a public vote
process (via an electronic medium to be determined by the Administration), to provide the public
with the.opportunityto participate in the final selection of the'final artwork(s) that will be included
in the City of Miami Beach Art In Public Places Collection, and thereby promote thepublic's
engagement with the.City's AiPP Collection.

SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF
THE ART IN PUBLIC PLACES COMMITTEE TO ESTABLISH A LEGACY
PURCHASE PROGRAM BETWEEN THE CITY OF MIAMI BEACH ART IN
PUBLIC PLACES AND ART BASEL MIAMI BEACH FOR THE PURCHASE
ARTWORKS BY INTERNATIONALLY RECOGNIZED ARTISTS FOR THE
CITY OF MIAMI BEACH ART IN PUBLIC PLACES COLLECTION.
RECOMMENDATION
The administration recommends that the Mayor and Commission approve this initiative to deepen the
connection of the City of Miami Beach residents and Art Basel Miami Beach by allowing the Miami
Beach cornunity to come together and select a legacy piece for our Art in Public Places art
collection to exist in the Miami Beach Convention Center year round.
ANALYSIS
The Art in Public Places (AiPP) Ordinance (Ordinance No. 95-2985)was adopted in 1995. The
ordinance was created to "enhance the aesthetic environment of the City of Miami Beach by
including works of art on public property within the City and in City construction projects."
The AiPP program is currently funded by 1 '/2% of all hard costs of City projects, including new
construction, additions, and costs for construction of joint private/public projects. The fund is
used for the commission or acquisition of works of art; conservation and maintenance of works
of art; research and evaluation of works of art; printing and distribution of related materials; and
administration.
The goals of the AiPP program are: overseeing the City's public art collection; enhancing the
physical environment of Miami Beach with artworks of the highest level of quality and suitability
for the site; serving as the coordinating body for all public art projects on City property; building
partnerships with the private sector, non-profit and community groups that connect the AiPP
projects to the life of the City; encouraging participation by artists based locally, nationally and
internationally; and serving as a source of information about public art.
In a continued effort to support partnerships and build the Miami Beach Art in Public Places
Collection in a thoughtful, strategic way, Miami Beach Art in Public Places and Art Basel Miami
Beach are establishing a legacy purchase program. On August 27, 2019, the Art in Public
Places Committee held a meeting to discuss this initiative and made a formal recommendation

that the Mayor and Commission approve the use of funds for this first acquisition.
The funding for this purchase has already been identified from the existing Art in Public Places
fund,from contingency funding not utilized during the production of the Miami Beach Convention
Center Art in Public Places installations.
The Art in Public Places / Art Basel Miami Beach Legacy Purchase Program will allow the
public to determine the artwork(s) selected for purchase. The Tourism and Culture department
is working directly with Art Basel Miami Beach to orchestrate this initiative which will allow the Art
in Public Places Committee to access the fair in order to short list a selection of three (3)
artworks that will be posted on the City of Miami Beach's social media accounts for popular
vote. The artworks will be selected based on artistic excellence, relevance of the artwork in
terms of current artistic practice, national and international representation, suitability of the
artwork in a public environment and investment value to the Art in Public Places Collection.
Residents of Miami Beach are encouraged to purchase tickets to Art Basel Miami Beach to see
the selected works, as well.
The artwork with the most votes will be acquired by the Art in Public Places Program and
become part of the Miami Beach Art in Public Places Collection which will be displayed within
the Miami Beach Convention Center.
The intent of the Legacy Purchase Program is to connect the Miami Beach residents with Art
Basel Miami Beach, by having them be an active participant in the selection of a legacy piece for
our public art collection, while supporting artists and art galleries that participate in the annual art
fair.
CONCLUSION
The administration recommends that the Mayor and Commission approve this initiative to deepen the
connection of the City of Miami Beach residents and Art Basel Miami Beach by allowing the Miami
Beach community to come together and select a legacy piece for our Art in Public Places art
collection to exist in the Miarri Beach Convention Center year round.
