RESOLUTION 92-20486 RESOLUTION NO. 92-20486 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AGREEMENTS WITH RESERVE POLICE OFFICERS IN THE FORM ATTACHED HERETO: SEAN BERGERT, ALFREDO CATA, ROBERT CHENOWETH, JOHN CLEMENTS, ANGEL DE LAS SALAS, MICHAEL DENNISTON, DONALD DIXON, GEORGE HATMAKER, GARRY LARKIN, DAISY LEDO, THOMAS LINCOLN, DAVID McCUE, RIGOBERTO OLIVERA, WILLIAM PACHECO, OREN PAISANT, KEVIN PRESCOTT, BARBARA SANCHEZ, JUAN SANCHEZ, CHRISTI TANNER, LASCELLES VERNON, JONATHAN YAVNEH BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: WHEREAS, the City desires to enter into Agreements with Reserve Police Officers for special enforcement purposes by supplementing the staff of full time police personnel; and WHEREAS, by Resolution No. 92-20454 , the City Commission amended the FY 1991/92 Police Confiscation Fund Budget for the City of Miami Beach by an amount of $24, 000 for the program involving recruitment, hiring and training for Reserve Police Officers; and WHEREAS, the City Manager recommends approval of the attached Agreements. NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are hereby authorized to execute Agreements with the following Reserve Police Officers: Sean Bergert, Alfredo Cata, Robert Chenoweth, John Clements, Angel De Las Salas, Michael Denniston, Donald Dixon, George Hatmaker, Garry Larkin, Daisy Ledo, Thomas Lincoln, David McCue, Rigoberto Olivera, William Pacheco, Oren Paisant, Kevin Prescott, Barbara Sanchez, Juan Sanchez , Christi Tanner, Lascelles Vernon, Jonathan Yavneh. THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FOR THE 2ND AMENDMENT TO THE CONFISCATION • FUND BUDGET, PROVIDING FUNDS FOR (1) THE IMPREST CHECKING ACCOUNT ($34 , 300. ) AND (2) A PROGRAM INVOLVING RECRUITMENT, HIRING AND TRAINING (COLLEGE TUITIONS) FOR RESERVE POLICE OFFICERS ($24, 000. ) . BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: WHEREAS, Section 932 .704 (3) (a) , Florida Statutes, provides for the transfer of seized property and/or funds after public notice; such funds to be utilized for the appropriation and expenditures of the Police Confiscation Fund for .law enforcement purposes other than normal operating expenses; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the needs for expenditures and appropriation exist and the expenditure or appropriation of forfeiture funds is in compliance with Section 932 .704 (3) (a) ; and WHEREAS, such funds are available in the Police Confiscation Fund. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT the City Commission hereby amends the FY 1991/92 Police Confiscation Fund Budget for the City of Miami Beach by an amount of $58, 300. 00, said amendment to result in the amended budget as reflected hereinbelow. Carlton` ,�. /• City Manager SUBJECT: POLICE RESERVE OFFICER PROGRAM The Miami Beach Police Reserve Officer Program has been designed and organized to supplement the staff of full time police personnel with trained and qualified individuals who serve as volunteers. Each volunteer is required to serve a minimum of two Patrol shifts per month. Additionally the Reserve Officers are required to volunteer their efforts in at least one community event per year. Reserve Officers must meet the same selection qualifications as do Regular CityEmployee Officers, excepting the Civil Service g • volunteer nature of thisprogram permits Entrance Examination. The the Police Departmentinhibit to by-pass the Civil Service procedures which often the hiring of minority groups and local residents. p At theresent time, the Miami Beach Police Reserve Officer Academy p - people.Class is composed of twenty-one The ethnic background of these individuals is; white males 10 white females 1 hispanic males 6 hispanic females 2 black males 2. In order to ensure each Reserve Officer is properly disciplined and that the City' s liability is reduced as much as possible, each volunteer must conform to all the standards established by the Florida Department of Law Enforcement. Additional they must successfully complete the Field Training and Evaluation Program as established bythe Miami Beach Police Department. This training, and it's on-going evaluation process, ensure that each volunteer Officer conforms to all standards and rules of conduct demanded by the City of Miami Beach. The cost to the City is minimal. Each Officer is issued a uniform, a firearm and the associated equipment. If he is injured in the line of duty, the Officer receives medical benefits but may not be entitled to Workman' s Compensation benefits. In some cases the Citymaypaythe academy tuition. ADMINISTRATION RECOMMENDATION: ' That the City Commission adopt the Resolution. 1 AGENDA ITEM, DATE -2Z AGREEMENT RESERVE POLICE OFFICER CITY OF MIAMI BEACH, FLORIDA THIS AGREEMENT, executed this day of (1 f41?C 14 , 199 , by and between the CITY OF MIAMI BEACH, Florida a municipal corporation of the State of Florida, (hereinafter referred to as "City") and SEA-,v '4o"iqs 13e?RgT , (hereinafter referred to as "Applicant") . The parties hereto agree as follows: The City shall provide, at its own cost, police academy training approved by the Florida State Police Standards and Training Commission to Applicant. Applicant agrees to use his/her best efforts toward the successful completion of this police academy training. Upon execution of this Agreement, Applicant agrees to make himself/herself available for service to the City a minimum of twenty (20) hours per month for a period of thirty three (33) months ("Term of Service") . Said Term of Service shall commence on I`/R2ci- `7``\ J9 cid . This Term of Service may be extended on a month to month basis for a period not to exceed twelve (12) months. Applicant shall not use his/her status as Reserve Police Officer or any information received or acquired in accordance with his/her duties, assignments or position which would inure to his/her private gain or benefit or which he/she knows would inure to the private gain or benefit of any relative or business associate of said Applicant. Applicant agrees to conform to and abide by all rules, regulations, orders, powers and procedures of the Department as well as all laws and ordinances in force. Any violations thereof shall result in termination of Applicant's Term of Service. In the event Applicant is terminated or resigns for any reason, Applicant agrees to reimburse the City for any and all funds expended for training and/or equipment. At the end of the Term of Service, for whatever reason, Applicant shall return all equipment issued to him/her by the City, if any. Applicant agrees to reimburse the City for any damage or loss of any equipment issued to him/her. The list of equipment issued is attached hereto and incorporated herein. Under no circumstances shall the City be obligated in any manner to continue to retain Applicant for the Term of Service described above. Aoplicant's continued service shall be at the will of the City. For the purpose of this Agreement, Applicant shall not be an employee or agent of the City and therefore shall not obtain any rights or benefits under the Civil Service Act or the Pension Ordinance of the City. Applicant shall not obtain any other benefits or rights generally afforded classified or unclassified employees including but not limited to the accumulation of sick or annual leave. When on duty and when performing duties within the scope of service, Applicant will be entitled to Workers Compensation and death benefits. Applicant shall release and hold harmless the City of Miami Beach, its officers and employees and agents, from all claims, demands, suits, damages, costs and expenses on account of, or in any way arising out of the conduct or actions of Applicant performed while not within the scope of his/her duties or responsibilities as a Reserve Police Officer.
