A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, FIXING
A TIME AND PLACE AT WHICH THE OWNERS OF
PROPERTY SPECIALLY BENEFITTED BY THE
CONSTRUCTION OF STREETS, SIDEWALKS, STORM
SEWERS AND WATER MAIN IMPROVEMENTS ALONG
THE EAST AND WEST SIDE OF OCEAN DRIVE
BETWEEN FIFTH AND FIFTEENTH STREETS, ALL
LYING WITHIN THE CORPORATE LIMITS OF THE
CITY OF MIAMI BEACH, OR ANY OTHER PERSONS
INTERESTED THEREIN MAY APPEAR BEFORE THE
CITY COMMISSION OF SAID CITY TO BE HEARD
AS TO THE PROPRIETY AND ADVISABILITY OF
MAKING SUCH IMPROVEMENTS, AS TO THE COST
THEREOF, AS TO THE MANNER OF PAYMENT
THEREFOR, AND AS TO THE AMOUNT THEREOF TO
BE ASSESSED AGAINST EACH PROPERTY SO
IMPROVED.
Whereas, the City Commission of the City of Miami Beach
has by Resolution determined that it is necessary for the welfare
of the citizens of Miami Beach, and particularly those living on
the east and west sides of Ocean Drive from Fifth to Fifteenth
Street, to construct street, sidewalk, storm sewer and water main
improvements to Ocean Drive from Fifth to Fifteenth Streets, all
lying within the corporate limits of the City of Miami Beach, and

Whereas, it has also been determined that a part of the
cost of construction of such improvements shall be assessed against
the property specially benefitted thereby, and
Whereas, Florida Statutes Chapter 170 requires that the
City Commission of the City of Miami Beach fix a time and place at
which the owners of the property to be assessed, or any other
persons interested therein, may appear before said City Commission
and be heard as to the propriety and advisability of making such
improvements, as to the cost thereof, as to the manner of payment
thereof, and as to the amount thereof to be assessed against each
property so improved.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA:
That the City Commission of said City shall meet at the
Commission Chambers in the City Hall in said City at the hour of
3 : 00 o'clock P. M. on the 22th day of July, 1992 , at which time
the owners of the property to be assessed or any other persons
interested therein, may appear before said City Commission and be
heard with regard thereto, and that the area to be improved and the
property specially benefitted by the construction of said
improvements is the east and west sides of Ocean Drive from Fifth
through and including Fifteenth Streets, all within the corporate
limits of said City.
BE IT FURTHER RESOLVED: that all persons interested in
connection with the construction of said improvements and the
assessments against the property to be specially benefitted are
advised that the description of each property to be assessed and
the amount to be assessed to each piece or parcel of property may
be ascertained at the office of the City Clerk of the City of Miami
Beach.

SUBJECT: RESOLUTION CALLING A PUBLIC HEARING ON THE OCEAN DRIVE IMPROVEMENTS
Administrative Recommendation
The Administration recommends that this Resolution be adopted calling a Public
Hearing on the improvements to Ocean Drive on July 22, 1992 at 3:00 p.m.
Background
The Ocean Drive Improvement was undertaken and completed by the end of 1989. At
the completion of the project, the Administration planned a series of actions
which needed to be completed so that the bills for the property specially
benefited by the improvements could be processed. This Resolution, second in a
series of such Resolutions relating to Ocean Drive, is necessary under Florida
Statutes Chapter 170 to allow all interested parties to be heard on the
improvements, the cost and the amount and method for the calculation of the
special assessments to be sent to benefited properties.
Analysis
The series of actions outlined in Florida Statutes Chapter 170 include the
following:
1. The plans, specifications, cost estimates and assessment plat must be
filed with the City Clerk and open for inspection to the public.
(Completed May 29, 1992)
2. City Commission Approval of the initial Resolution which describes the
improvements, describes the project area and call for the special
assessments. (Completed June 3, 1992)
3. Public Works Department must file with the City Clerk the Preliminary
Assessment Roll. (Completed June 15, 1992)
4. The original Resolution must be published in its entirety in the Miami
Herald. (Completed June 14, 1992)
5. City Commission approval of a Resolution calling a Public Hearing for
July 22, 1992 at 3:00 p.m. for all interested parties to be heard on
the improvements. (This Resolution)
6. Mail notices to all property owners and advertise the Public Hearing; a
minimum of ten days notice is required.
7. Hold Public Hearing and at the conclusion adopt a Resolution finalizing
the assessment roll and confirming and accepting the project
improvements.
8. Enter the final assessments in the City's Improvement Lien Book.
9. Prepare and mail the special assessment notices and begin collections.
Conclusion
The City Commission should approve this Resolution and continue the course of
action to allow for the assessment of specially benefited property owners.
