RESOLUTION NO. 92-20530 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY CLERK TO SCHEDULE A PUBLIC HEARING TO ALLOW FOR COMMUNITY INPUT AND COMMENTS REGARDING THE CREATION OF RESIDENTIAL PARKING PERMIT PROGRAM #4 FOR THE CITY COMMISSION MEETING OF JULY 8 , 1992 . WHEREAS, the City Commission is vested with the authority to direct the Administration of the City to create residential parking permit areas; and WHEREAS, the Administration has received request from members of the community to create a residential area identified by the City as Area #4 ; and WHEREAS, Residential parking area #4 , is bounded by the centerline of Fifth Street on the south to the centerline of Eighth Street on the north; the centerline of Meridian Avenue on the east to the centerline of Alton Road on the west; and WHEREAS, Article XII of Chapter 44 of the Code of the City of Miami Beach requires that a determination be made to determine that commuter vehicles impact a given neighborhood which would require the creation of a residential parking program; and WHEREAS, the Administration has determined that a need exists for the creation of a residential parking program in the above referenced neighborhood; and WHEREAS, the Finance Committee has reviewed, discussed and agreed that a residential parking program should be established in the above referenced neighborhood. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager and City Clerk are hereby authorized and direc ed to schedule a public hearing at the regular meeting of the City Commission of July 8, 1992 , at 5: 01 P.M. to allow or public input into the creation of the Residential Parking rmit Program #4 . Carlt �� City Manager SUBJECT: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY CLERK TO SCHEDULE A PUBLIC HEARING TO ALLOW FOR COMMUNITY INPUT AND COMMENTS REGARDING THE CREATION OF RESIDENTIAL PARKING PERMIT PROGRAM #4 FOR THE CITY COMMISSION MEETING OF JULY 8, 1992 ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt the attached Resolution calling for a Public Hearing at 5:01 PM, July 8, 1992, for the purpose of taking public comment regarding the establishment of Residential Parking Permit Zone #4. BACKGROUND: The residents of the area bordered by the centerlines of Alton Road on the west, Fifth Street on the south, Meridian Avenue on the east and Eighth Street on the north, have requested their neighborhood be considered for a residential parking permit zone due to the conditions created by the nightclub located on Fifth Street and Lenox Avenue. After inspecting the area in question, the Administration agrees that the area qualifies for this status, as visitors to the nightclub are parking throughout the neighborhood until the early morning hours. Such parking disturbs the peace of the residents in the area. ANALYSIS: After speaking with the Police Department, reviewing their records, and after hearing from residents, the Parking Department conducted a "windshield survey" of the neighborhood. The results of the survey found that, in accordance with Ordinance #90-2690, which defines eligibility for such zones, that an undue number of non-resident vehicles were parking in this area between the hours of 7:00 P.M. and 6:00 A.M. for purposes unrelated to residential uses. Based on this data, the Parking Department presented these finding to the Finance Committee. Their recommendation was to refer this matter to the full City Commission for consideration. Passage of the Resolution calling for a public hearing is the first step towards this consideration. CONCLUSION: The Administration recommends passage of this Resolution in order to begin the process of preserving the residential character of this neighborhood.
