A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH,FLORIDA,PURSUANT TO ORDINANCE No.90-2690,CREATING
A RESIDENTIAL PARKING PERMIT AREA IN THE AREA BOUNDED BY
THE CENTERLINE OF ALTON ROAD ON THE WEST, THE
CENTERLINE OF MERIDIAN AVENUE ON THE EAST, BY THE
CENTERLINE OF FIFTH STREET ON THE SOUTH AND THE
CENTERLINE OF ELEVENTH STREET ON THE NORTH, TO BE
REFERRED TO AS "RESIDENTIAL PERMIT PARKING AREA #4".
WHEREAS, the City Commission of the City of Miami Beach has enacted Ordinance
No. 90-2690, authorizing the creation of residential parking permit areas in the City of
Miami Beach; and
WHEREAS, the City Manager has determined that the area bounded on the west
by the centerline of Alton Road, on the east by the centerline of Meridian Avenue, on the
south by the centerline of Fifth Street and on the north by the centerline of Eleventh Street
is impacted by commuter vehicles; and
WHEREAS, residents of the above described area have been provided notice of
public hearing in accordance with the requirement set forth in Ordinance No. 90-2690; and
WHEREAS,the affected residents have had the opportunity to express their concerns
and considerations at the public hearing as prescribed by Ordinance No. 90-2690.
NOW, THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, as follows:
1. A residential parking permit area is hereby created in the area bounded by
the west by the centerline of Alton Road, on the east by the centerline of Meridian
Avenue, on the south by the centerline of Fifth Street and on the north by the centerline
of Eleventh Street, to be referred to as "Residential Parking Permit Area #4".
2. The City Manager is authorized and directed to create a residential parking
permit for Residential Parking Permit Area #4 which will allow permitted vehicles to be
parked in the following areas only:
(a) at any available municipal metered parking space within the Residential
Parking Permit Area #4.
(b) at any available space in the specific "Residential Parking Permit Only"
locations in Residential Parking Permit Area #4, as shown on Exhibit "A"
attached hereto and by reference made part hereof, during the hours from
6:00 P.M. to 8:00 A.M., Monday through Sunday.
3. The permit for Residential Parking Permit Area #4, shall not be honored at
any Municipal Parking Facility (either on- or off-street, metered or attended) outside of the
Residential Parking Permit Area #4.
4. The cost for the permit for Residential Parking Permit Area #4 is hereby
established in the amount of $6.00 vehicle fora erioo of six-months.

CITY MANAGER'S DETERMINATION THAT A PROPOSED RESIDENTIAL PERMIT PARKING AREA IS
IMPACTED BY COMMUTER VEHICLES.

Re: Area No. 4 Bounded as follows: On the north by the centerline of 11th
Street, on the east by the centerline of Meridian Avenue, on the south by the
centerline of 5th Street and on the west by the centerline of Alton Road.
1) Pursuant to Article XII of Chapter 44 of the City of Miami Beach
Code, Before a Residential Permit Parking Area can be created, the City manager
must make a determination that the proposed are is impacted by commuter vehicles.
2) Based upon the data provided to me by the City's Parking Department,
a copy of which is attached hereto, I hereby find and determine that the above
described area is impacted by commuter vehicles because:
(Check one of the following)
x (1) A condition exists whereby (i ) the total number of spaces
actually occupied by any vehicles exceeds 70 percent of the
number of spaces on such streets on the weekdays of any month;
and, (ii ) the average number of commuter vehicles parking on
streets in the residential area is in excess of 25 percent of
the number of parking spaces on such streets, or
(2) A condition exists whereby an undue number of commuter vehicles
are being driven into or left in a residential area regularly
between the hours of 7:00 P.M. and 6:00 A.M. of the following
day, parking therein for purposes unrelated to residential
uses.

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission of the City of Miami
Beach, Florida, adopt the attached resolution which, after consideration of
public opinion, authorizes the City Manager to implement a residential parking
permit program in the area which is bounded on the west by the centerline of
Alton Road, on the east by the centerline of Meridian Avenue, on the south by the
centerline of Fifth Street and on the north by the centerline of Eleventh
Street.
BACKGROUND:
Over the past several months, the Administration has received numerous requests
to evaluate the feasibility of implementing a residential permit program in the
neighborhood between Fifth and Eleventh Streets, Alton Road and Meridian
Avenue. As a result of these requests, the Parking and Police Departments have
reviewed the parking concerns expressed by the residents. It was determined
that a conflict of parking requirements exists in the areas identified for this
residential parking program.
The Parking Department originally recommended a program which was bounded by
Alton Road and Meridian Avenue, between Fifth and Eighth Streets. The
Administration was directed to review and consider the expansion of the program
to Eleventh Street. The Resolution attached hereto reflects the revised
boundries for the program up to Eleventh Street. As presented, however, the
zone can be changed by direction of the Commission.
Fee structures for residential parking permit programs vary between
neighborhoods. For example, the $75.00 semi-annually fee for the Ocean Drive
Residential Area #1 was based upon anticipated metered revenue proceeds.
Residential Area #2 (east of the Convention Center) and Area #3 (south of Fifth
Street) are non-metered zones. The costs for these programs are based upon the
installation and maintenance costs (materials and labor) allocated to the
number of available non-metered spaces. The number of available parking spaces
in the proposed Area #4 is approximately four times the total spaces available
south of Fifth Street; therefore, the fee for the newly proposed area is less
since a larger population will be participating in the program. •,

Residential Parking Permit Programs have been successfully implemented in the
Ocean Drive corridor east of Collins Avenue. In addition, the Administration
had been directed to implement a test program in the area east of the Convention
Center. These two programs have been operational since 1990 and 1991
respectively. Recently, a new residential program has been set into place in
the area south of Fifth Street. This new program is different from other
neighborhoods since it is a direct result of the impact of nightclub activity
in a residential community.
ANALYSIS:
In evaluating the need for residential programs, the Administration carefully
reviews the number of dwelling units and the available number of spaces.
Residential Area #4, a 24-block neighborhood, is comprised of approximately
1,485 undesignated on-street spaces serving an estimated 4,000 apartments
within the perimeter of the tract. Spill over from the nearby commercial areas
into the residential portions of the neighborhood significantly impact the
parking situation for individuals residing in the area. The Administration has
found that a need clearly exists for the creation of a residential decal
program.

CONCLUSION:
During the process of identifying residential parking zones, the
Administration has clearly determined that residential parking needs conflict
with entertainment use. As such, it is recommended that the City Commission
authorize the City Manager to implement Residential Parking Program #4 to
assist residents in the zone with their parking requirements. All spaces will
be clearly designated and delineated accordingly. In addition, enforcement
personnel will administer the program, issuing citations and towing improper
vehicles. This program should effectively assist residents in the designated
area with their parking demands.
