A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, LEVYING SPECIAL
ASSESSMENTS AND ADOPTING AND CONFIRMING THE
ASSESSMENT ROLL ASSESSING PROPERTY SPECIALLY
BENEFITTED BY THE CONSTRUCTION OF STREETS,
SIDEWALKS, STORM SEWERS AND WATER MAIN
IMPROVEMENTS ALONG OCEAN DRIVE FROM FIFTH
THROUGH FIFTEENTH STREETS, ALL WITHIN THE
CORPORATE LIMITS OF THE CITY OF MIAMI BEACH,
FLORIDA.
Whereas, the City Commission of the City of Miami Beach, Florida did determine
by Resolution ( the "Improvement Resolution"), pursuant to the provisions of Chapter 170
Florida Statutes, to construct streets, sidewalks, storm sewers and water main improvements
along Ocean Drive from Fifth through Fifteenth Streets, all lying within the corporate limits
of the City of Miami Beach, and to finance a portion of said improvements with special
assessments, and
Whereas, the City Commission of said City did determine the amount to be assessed
against the property specially benefitted by the construction of said improvements, and
Whereas, the City Commission of said City did,pursuant to said Chapter 170, Florida
Statutes, fix the hour of 3:00 o'clock P. M. on the 22nd day of July, 1992, at the Commission
Chambers in the City Hall of said City as the time and place at which the City Commission
would meet and at which time the owners of property to be assessed, or any other persons
interested therein, may appear before the Commission and be heard with regard to such
improvements and assessments, and
Whereas, The City Commission of said City did meet, at the time and place above
stated, after due notice had been given of such meeting in accordance with the provisions
of Chapter 170.07 Florida Statutes, and did thereupon and thereat hear and consider all
testimony as to the propriety and advisability of making the improvements and funding a
portion of said improvements with special assessments and all complaints that were made
as to such special assessments and has adjusted and equalized said assessments on the basis
of justice and right, and does hereby find that the assessment roll, as adjusted, regarding
the assessment of a portion of the cost of construction of said improvement against the
property specially benefitted thereby, has been made on the basis of justice and right, and

Whereas, other than the adjustment described above, the City Commission has heard
no valid objections presented to any such assessments, nor the manner and method in which
made, nor to the propriety and advisability of making such improvements, nor as to the cost
thereof, nor as the manner of payment thereof, nor as to the amount to be assessed against
each property so improved,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the special assessments described in the
Improvement Resolution be levied and the assessment roll heretofore prepared with regard
to the property specially benefitted by the construction of the improvements herein set
forth and the assessments as therein set forth shall be, and the same hereby stand
confirmed and shall remain legal, valid and binding first liens, upon the property against
which assessments are made, until paid as provided in the Improvement Resolution.

SUBJECT: Resolution confirming the Special Assessments on the Ocean Drive
Improvements
Administration Recommendation
The Administration recommends that the City Commission Adopt the Resolution
confirming the assessments against the properties benefitted from the construction of the
improvements to Ocean Drive from Fifth through Fifteenth Streets.
Background
After the conclusion of the Public Hearing on the Ocean Drive Improvements and the
Commission serving as an equalization board on the special assessments, this Resolution
is the document which actually causes the special assessments to be confirmed. the passage
of this Resolution is necessary to properly assess the specially benefitted property owners
for their proportionate share of the costs incurred on the project.

Analysis
The preliminary assessments on the property owners from the improvements on Ocean
Drive are based on an assessment of $234.15 per front foot of property. This includes the
property along Fifteenth Street at an assessment of 50% of that amount per front foot. The
total assessable property in the project area is 9,846.8 feet and is almost split exactly
50%/50% between the public and private sectors. The assessment on the average hotel site
along Ocean Drive is $23,415.00 based on an average lot size of 100 feet and may be payed
in full without interest or over ten years at an annual cost of $3,489.53 including interest
at eight per cent (8%).
Conclusion
The City Commission should adopt the attached Resolution confirming the special
assessments on the specially benefitted properties as per the preliminary special assessment
roll.
