In rendering its decision of May 13 , 1992 , the Board did not consider evidence as to whether the reflective material on the windows is or is not a part of the window glass and as to when and by whom the reflective tinting/glass was installed, and that the Board should hear such evidence and then reconsider that part of its decision relating to retention of the reflective tinting/glass. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows: 1. The Design Review Board/Historic Preservation Board' s decision of May 13 , 1992 not to waive or vary from the adopted Design Guidelines and to deny Design Review Approval and a Certificate of Appropriateness to Brachma Holding Company to retain metal siding at the Catalina Hotel was based upon competent, substantial evidence that the metal siding was not in compliance with the Design Guidelines and upon the lack of evidence of circumstances which would make it appropriate for the Board to waive or vary from the Guidelines; the Board did not act arbitrarily or capriciously in reaching this decision. b) The Design Review Board should receive evidence as to whether the reflective material on the windows is tinting or is imbedded in the glass and as to when and by whom it was installed and should then reconsider its decision relating to retention of said reflective material. 2 . That part of the Design Review Board/Historic Preservation Board' s decision of May 13 , 1992 to denying Brachma Holding Company' s request for Design Review Approval and a Certificate of Appropriateness to retain metal siding at the Catalina Hotel, 1732 Collins Avenue, is hereby affirmed. 3 . That part of the Design Review Board/Historic Preservation Board' s decision of May 13 , 1992 relating to retention of reflective window tinting at the Catalina Hotel is hereby remanded to the Design Review Board/Historic Preservation 2 Board for reconsideration in keeping with the aforestated findings. CARLTON FROM: LAURENCE FEINGOLDL•f CITY ATTORNEY SUBJECT: APPEAL TO CITY COMMISSION OF DENIAL OF DESIGN REVIEW BOARD APPROVAL/CERTIFICATE OF APPROPRIATENESS The purpose of this Memorandum is to provide the Commission with legal guidelines for review of the Design Review Board/Historic Preservation Board decision in the attached matter. Subsection 18-2 . I of the City's Zoning Ordinance No. 89-2665 provides that decisions of the City' s Design Review Board may be appealed to the City Commission. In deciding such appeals, the City Commission sits in a review capacity to determine if the Board acted properly. The City Commission may not consider issues which were not raised before the Board or issues which are not within the jurisdiction of the Board; nor may the Commission consider new evidence or arguments not considered by the Board. If the Commission finds that the Board' s decision was based upon competent substantial evidence and that the Board did not act arbitrarily or capriciously, then the Commission must deny the appeal and affirm the Board' s decision. Conversely, if the Commission finds that the Board did not act properly, it must grant the appeal and reverse the Board's decision. Pursuant to Section 18-2 . I of the Zoning Ordinance, a 5/7ths vote is required to reverse a decision of the Design Review Board.
