RESOLUTION NO. 92-20572
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA URGING GOVERNOR
LAWTON CHILES TO ISSUE AN EXECUTIVE ORDER
EXTENDING BY SIXTY (60) DAYS THE TIME FOR
ADOPTING BUDGETS AND MILLAGE RATES FOR
COUNTIES AND MUNICIPALITIES AFFECTED BY
HURRICANE ANDREW.
WHEREAS, Executive Order 92-220-E was issued by the Office of
the Governor on August 23 , 1992 , declaring the existence of a state
of emergency as a result and consequence of the serious threat
posed to public health, safety and property in portions of South
and Central Florida, and
WHEREAS, on August 24 , 1992 , Hurricane Andrew passed across
the State of Florida and destroyed and damaged millions of dollars
of property and rendered homes unsuitable for occupation, and
WHEREAS, Hurricane Andrew also caused millions of dollars of
damage to public property, creating a great financial burden on
localg overnments to clean up debris, restore services and repair
damaged public property, and
WHEREAS, pursuant to provisions of Chapter 200 o f the Florida
Statutes, City and County governments have already set a proposed
millage rate for Fiscal Year 1992-1993 and provided notice to the
property appraiser of the proposed millage rate, and
WHEREAS, Section 200 . 065, of the Florida Statutes provides a
mandatory timetable for the final adoption of millage rates and
budgetsCity
byand County Governments and Section 166. 241 requires
thatmunicipalbudgets bud ets for the next fiscal year be established
prior to October 1; and
WHEREAS, due to the great financial burden on City and County
governments resulting from Hurricane Andrew, City and County
governments mayneed to increase the proposed millage rate to fund
these costs
and mayneed additional time within which to adopt
their budgets.
NOW,
THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI
BEACH, FLORIDA: that the City Commission urges

Governor Lawton Chiles to execute and issue the attached Executive
Order, extending by sixty (60) days the time for counties and
cities to adopt millage rates and budgets.

WHEREAS, due to the great financial burden on city and
county governments resulting from Hurricane Andrew, city and
county governments may need to adjust the proposed millage rates
to fund these costs is and may need additional time within which to
adopt their budgets.
Now, THEREFORE, Y LLAWTON CHILES, as Governor of Florida by
virtue of the authority vested by Article IV, 1( a) , of the
Florida Constitution, Chapter 252 , Florida Statutes, and all
other applicable laws, do hereby promulgate the following

executive order, effective immediately:
Section 1.
CityCounty
and officials are hereby granted and delegated
the power and authority to extend any time period set forth in
Florida Statute 200 . 065 for adopting budgets and millage rates by
up to sixty ( 60) days, notwithstanding the limitations imposed by
Y
Section 200.065 .
Section 2 .
In the event that any extension of time implemented pursuant
to
Section 1 of this Executive Order shall cause any city or
county budget bud et for fiscal year 1992-1993 to be adopted on or after
October 1,
1992, then in such event such city or county shall be
authorized,
notwithstanding the provisions of Section 166 ,241 of

the Florida Statutes, to appropriate a pro rata budget for the
duration of such extension which is based on the prior fiscal
year.
