A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, CALLING FOR A PUBLIC HEARING TO BE HELD
PURSUANT TO ORDINANCE NO. 91-2742 TO CONSIDER RAISING THE
FRANCHISE FEE PAID TO THE CITY BY PRIVATE WASTE
CONTRACTORS FROM THE CURRENT FEE OF EIGHT PERCENT (8%) OF
THE FRANCHISEE'S TOTAL MONTHLY GROSS RECEIPTS FOR WASTE
REMOVAL IN THE CITY TO TEN PERCENT (10%) OF SAID
RECEIPTS.
WHEREAS, pursuant to Ordinance No. 91-2742 , enacted on April
24 , 1991, the City Commission is authorized to adopt a Resolution
once yearly raising the amount of the franchise fee paid to the
City by Private Waste Contractors by up to two percent (2%) ; and
WHEREAS, the Administration has recommended that said
franchise fee be raised from the current fee of eight percent (8%)
of the franchisee' s total gross receipts for waste removal within
the City of Miami Beach to a fee of ten percent (10%) of said
receipts, said raise to be effective on October 16, 1992 ; and
WHEREAS, the City Commission wishes to consider the aforesaid
recommendation of the Administration and to receive public input
regarding this matter.
NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that a hearing to consider the
aforementioned recommendation of the Administration, that the
franchise fee paid to the City by Private Waste Contractors
pursuant to Ordinance No. 91-2742 be raised from eight percent (8%)
of the franchisee' s total monthly gross receipts for waste removal
in Miami Beach to ten percent (10%) of said receipts, is hereby
called to be held before the City Commission in its chambers on the
Third Floor of City Hall, 1700 Convention Center Drive, Miami
Beach, Florida on September 16 , 1992 , beginning at
4: 15 p .m. ; and the City Clerk is hereby authorized and
directed to publish an appropriate Public Notice of the said Public
Hearing in a newspaper of general paid circulation in the City of
Miami Beach, at which time and place all interested parties may be
heard.

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission approve the resolution calling for
a public hearing pursuant to Ordinance No. 91-2742 to consider raising the Franchise Fee
paid to the City by private waste haulers from the current eight percent (8%) to ten percent
(10%) the fr anchisee's total monthly gross receipts.

BACKGROUND
Under Chapter 14A of the Miami Beach City Code, Section 14A-16 provides regulations, fees,
and procedures for applications and licensing of the Franchise Waste Contractors. The
Ordinance provides that the City has the option of raising the Franchise Fee once yearly, said
raises not to exceed two percent and shall be imposed only by resolution after a public
hearing and thirty days prior notice to all Franchise Waste Contractors. It is proposed that
a public hearing be held on the regular Commission Meeting of September 16, 1992, and that
public notices be sent the week of August 11, 1992.
ANALYSIS
The proposed Franchise Fee increase from eight percent (8%) to ten percent (10%) will
generate an additional estimated revenue of$157,396.00 per year. These funds will partially
offset the current general fund contribution to the Sanitation Enterprise Fund.
