A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ADOPTING AN
OPERATING BUDGET AND APPROPRIATING FUNDS FOR
THE POLICE TRAINING TRUST FUND FOR FISCAL
YEAR 1992/93 .
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA:
WHEREAS, Florida Statutes Section 943 . 25 (9) ,
Criminal Justice Trust Fund, provides for funds to be made
available to the law enforcement agency for the
implementation of training programs; and
WHEREAS, such funds are currently available in the
Criminal Justice Training Trust Fund, amounting to
$35, 000. 00 ; such funds being court costs from criminal
proceedings.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT the
City Commission of the City of Miami Beach, Florida,
thereby adopts the proposed operating budget for the
Police Training Trust Fund, a true and correct listing of
which is included and incorporated herein by reference,
and monies therein be and same are hereby appropriated, as
follows (Exhibit 1) :

do hereby certify that the aforementioned proposed request
for expenditures from the City of Miami Beach Police
Training Trust Fund, for the 1992/93 fiscal year to
provide funds for the education of police personnel at
various schools, conferences, and workshops, and for the
purchase of training/operational supplies is in accordance
with guidelines established by the Division of Criminal

SUBJECT: POLICE TRAINING TRUST FUND FOR FISCAL YEAR 1991/92
The Administration requests permission to adopt an
operating budget of the Police Training Trust Fund for
fiscal year 1992/93 to appropriate $35, 000. 00 to provide
funds for the education of police personnel at various
schools, conferences, and workshops, and for the purchase
of training/operational supplies in accordance with
guidelines established by th0 Division of Criminal Justice
Standards and Training, as provided by Florida Statute .
943 . 25 (9) ; the source of such funds being court costs from
criminal proceedings.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission
adopt the operating budget for the Police Training Trust
Fund and appropriate funding.
BACKGROUND
Florida Statute 943 . 25 (9) provides for the administration
of the Criminal Justice Training Trust Fund, and monies
from this Trust Fund May be expended for specialized
training courses and criminal justice training school
enhancements. The amount of monies available is based
upon the number of total full-time law enforcement
officers budgeted.
The Police Department embarked on a training program
during FY 91/92 which encompassed a broad range of
programs targeting cross cultural awareness, sensitivity
training, and liability training. The Department ' s
initiative and goals are, and have been, to reduce the
incidents that have the potential of exposing the city to
civil liability. Training has been the vehicle used
successfully to accomplish this initiative. Not only was
multi-cultural sensitivity training necessary in Miami
Beach dealt with, but training in discrimination,
supervisory and management issues as well . Many of the
Department ' s Executives and Supervisors received training
to increase the skills of many of the new supervisors.
Supervisors play a most crucial role in the overall
management and leadership of an organization ' s personnel
resources.

ANALYSIS
Florida Statute Sec. 943 . 25 creates and authorizes with
the State Department of Law Enforcement a Criminal Justice
Training Trust Fund for the purpose of providing statewide
approved criminal justice advanced and specialized
training and criminal justice training school
enhancements. (This is governed by the Criminal Justice
Standards and Training Commission within the Department of
Law Enforcement) . Al courts, in addition to other fines
or penalties shall assess $3 as a court cost against every
person convicted of a violation of criminal statute or
county or municipal violation. All such costs collected
by the courts shall be remitted to the State Department of
Revenue, and $2 of each $3 assessment shall be deposited
in the Criminal Justice Training Trust Fund (State Fund) .
Such funds, earmarked to the Department of Law Enforcement
shall be disbursed only as necessary for the
implementation of training programs approved by the
commission. (Criminal Justice Standards and Training
Commission) .
The Police Department is currently developing a 40 hour
in-service training curriculum for 1993 which will create
a cornerstone for such topics as sensitivity training, and
legal liability instruction.
CONCLUSION
The correct procedures have been complied with in
accordance with F.S.S . 943 . 25 (9) .
