Amend NO.4 Agreement with The School Board of Miami-Dade County Z o 11 - 2 9gaq AMENDMENT NO. 4 TO AGREEMENT AMONG THE SCHOOL BOARD OF MIAMI-DADE COUNTY, MIAMI, FLORIDA And THE CITY OF MIAMI BEACH, FLORIDA And THE FLORIDA INTERNATIONAL UNIVERSITY BOARD OF TRUSTEES, MIAMI, FLORIDA This Amendment No. 4(the "Amendment") to the Agreement, dated March 19, 2015, as amended by Amendment No. 1, dated May 26, 2016, and Amendment No. 2, dated October 25, 2017, and Amendment No. 3, dated November 27, 2018, (collectively, the "Agreement"), by and among the City of Miami Beach, Florida, a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 1700 Convention Center Drive, Miami Beach, Florida 33139("CMB"),The School Board of Miami-Dade County, a body corporate and political subdivision of the State of Florida, having its principal place of business at 1450 NE 2nd Avenue Miami, Florida ("M- DCPS"), and The Florida International University Board of Trustees, a member of the State University System of Florida, having its principal place of business at 11200 SW 8th Street, Miami, Florida 33199 ("FIU") (CMB, M-DCPS and FIU may be individually referred to as a party or collectively as parties), is entered into this 11 day of OCT , 2019 (Effective Date): RECITALS WHEREAS, FIU and M-DCPS entered into an inter-institutional agreement in the summer of 2018 (the "M-DCPS-FIU Agreement") to promote educational opportunities through the dual enrollment program in Miami-Dade County, a copy of which is attached as Exhibit A and incorporated into this Agreement by reference; WHEREAS, in accordance with the M-DCPS-FIU Agreement, CMB seeks to deploy its resources with M-DCPS and FIU in order to increase the competitiveness of thestudents of Miami Beach Senior High School by nurturing and supporting the dual enrollment programs taught at Miami Beach Senior High School (the "High School"), Nautilus Middle School (the"Middle School") and the Fienberg Fisher K-8 Center(the""K-8 Center") ; and WHEREAS, the parties desire to again amend the Agreement to continuethe expansion of the program, as FIU resources permit, by providing dual enrollment classes at the Middle School, in order to provide 8th graders, who attend the Middle School and the K-8 Center, with the opportunity to take dual enrollment courses at the Middle School, and to establish guidelines for CMB to financially support the dual enrollment courses taught at the High School and Middle School. NOW THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, CMB, M-DCPS and FIU hereby agree to amend the Agreement as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 1 2. MODIFICATIONS. The Agreement is hereby amended (deleted items struck through and inserted items underlined) as follows.: (a) The first full paragraph of Section 2.01 of the Agreement is hereby deleted in its entirety and replaced with the following: 2.01 Term of Agreement. The term of this Agreement shall be effective as of the last date signed by all parties through the 30th of June, 2020, unless the Agreement is terminated earlier pursuant to Section 3.02 below or the M-DCPS- FIU Agreement is terminated. This Agreement may be renewed for additional periods of time upon the mutual written consent of the parties and subject to such terms and conditions as the parties shall determine in writing. (b) Section 2.03 of the Agreement Section E is hereby deleted in its entirety and replaced with the following: E. Course Selection and Scheduling.The High School or Middle School principal shall select the dual enrollment courses to be taught at the High School or Middle School, as applicable, provided that the courses are selected from the dual enrollment courses identified in the M-DCPS-FIU Agreement (the list of courses is subject to change). The dual enrollment courses offered at the High School shall be accessible to all university/college eligible students and may not be restricted to students enrolled in a specific high school academy or program and must be offered as courses accessible to the entire student population based on university eligibility. The FIU faculty/adjunct instructor will strictly adhere to the 2019-2020 Miami-Dade County Public Schools calendar and schedule, a copy of which is attached hereto as Exhibit B. The FIU faculty/adjunct instructor shall provide instruction per the established class schedule as determined by the High School or Middle School for the Fall semester, from August 19, 2019 through January 17, 2020, and for the Spring semester, from January 21, 2020 through June 3, 2020. 3. RATIFICATION. Except as amended herein, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect. In the event there is a conflict between the provisions of this Amendment and the Agreement, the provisions of this Amendment shall govern.
