pursuant to City ordinances.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA: that the City Commission hereby
accepts the recommendation of the City Manager concerning
appointment of Sam I. Silver to serve as Chief Special Master to
hear appeals from violations of Miami Beach City Code Chapters and
denials, suspensions and revocations of occupational licenses and
certificates of use and to appoint such other special masters as
may reasonably be required to conduct such hearings as a special
master may be required to conduct pursuant to City ordinances, and
that his term of office for this appointment shall coincide with
his term of appointment pursuant to Resolution No. 92-20524 .

SUBJECT: APPOINTMENT OF JUDGE SAM I. SILVER TO SERVE AS CHIEF
SPECIAL MASTER FOR ADMINISTRATIVE HEARINGS
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission accept the
appointment of Judge Sam I. Silver to serve as Chief Special Master
for administrative hearings; and, that he shall also be authorized
to appoint such other special masters as may be reasonably required
to conduct the subject hearings.
BACKGROUND:
On October 8, 1992 the City Commission of the City of Miami Beach,
Florida, adopted ordinances providing that appeals from citations
for violations of Miami Beach City Code Chapters 14A and 24 and
hearings regarding denials, suspensions and revocations of
occupational licenses and certificates of use as required by City
Code Chapters 8 and 20 be conducted by a special master appointed
by the City Commission, upon recommendation by the City Manager.
On January 9 , 1991 the City Commission appointed Sam I . Silver as
Chief Special Master to hold administrative hearings required by
Miami Beach City Code Chapter 9B, to enforce fire, and certain
other code violations, and to appoint such other special masters as
may reasonably be needed to conduct those hearings.
On June 17 , 1992 the City Commission adopted Resolution No. 92-
20524 reappointing Sam I. Silver to serve as Chief Special Master
for an additional six-month term.
ANrLYE IS:
It is felt by this Administration that the Special Master system
has worked extremely well for adjudicating issues relating to code
violations; and, this system has also been proven to be very cost
effective for the City.
• It would be beneficial and cost effective for this system to
continue to use the existing special masters. These special
masters have done outstanding work and are already thoroughly
familiar with the City of Miami Beach codes, ordinances and
procedures.

In keeping this system cost effective, the administrative hearings
would be scheduled on the same date and location of the fire code
violations hearings that the existing Special Masters are already
scheduled to be at City Hall.
CONCLUSION:
The City Commission should approve the City Manager 's
recommendation to appoint Judge Sam I. Silver as Chief Special
Master for the aforementioned hearings; and, to use the existing
special masters in order to ensure a smooth transition and for this
it
system o continue to remain cost effective.
