RESOLUTION NO. 92-20659
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH REQUIRING THE CITY
ADMINISTRATION TO PROVIDE AN ECONOMIC IMPACT
ANALYSIS FOR ANY LEGISLATION HAVING FINANCIAL
IMPLICATIONS WHICH IS TO BE ENACTED BY THE
MAYOR AND CITY COMMISSION.
WHEREAS, many matters of legislation enacted by the Mayor and
City Commission have significant economic impact, both on the
public and the private sector; and
WHEREAS, prior to enacting any legislation, the Mayor and City
Commission should be apprised of the full economic impact of such
measures.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF MIAMI BEACH, FLORIDA:
Section 1.
That prior to the adoption of any legislation, except that
relating to Zoning or Comprehensive Plan Amendments, the City
Administration shall prepare an economic impact analysis, without
utilizing outside consultants, in the form of a written report
setting forth, when applicable, the following information
concerning the proposed measure:
a. the economic impact of the legislation on the City' s
budget;
b. the economic impact of the legislation on the private
sector;
c. the effect of the legislation on public or private
employment;
d. the costs and benefits, both direct and indirect, of
establishing and maintaining the program set forth in the
legislation;
e. whether the legislation is necessary to enable the City
to obtain local, state or federal grants or other
financing;
f. any other concern the Administration deems necessary to
advise the Commission of in order to fully appreciate the
economic effects of the measure.
Section 2 .
The provisions of this Resolution may be waived by a 5/7 vote
of the City Commission.
Section 3.
The failure of the Administration to prepare the required
written report or the failure of the Mayor and City Commission to
consider such report shall not affect the validity of any
legislation otherwise validly enacted.
