A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE LEASE AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND JEFFERSON NATIONAL BANK FOR THE USE OF THREE
(3) PARKING SPACES LOCATED IN THE CITY'S MUNICIPAL PARKING
LOT 24-B AT 71ST STREET AND RUE VENDOME, BETWEEN THE
HOURS OF 8:00 A.M. AND 5:00 P.M., MONDAY THROUGH FRIDAY.
WHEREAS, Jefferson National Bank has requested the City to enter into an Agreement for three off-
street parking spaces for a one-year period; and
WHEREAS, the Agreement provides Jefferson National Bank the use of these off-street parking
spaces in the City's 24-B parking lot located at 71st Street and Rue Vendome; and
WHEREAS, the City of Miami Beach has entered into agreements for these spaces with other related
financial institutions since December, 1978; and
WHEREAS, the demand for this type of public-private arrangement benefits both the City and the
private sector while maintaining access for general public parking; and
WHEREAS, Jefferson National Bank has agreed to the terms and conditions as set forth in the
attached agreement at a rate of$30.00 per space per month plus tax, payable in full for the entire term, on
the first day of the agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk are hereby authorized and directed to execute
the attached Agreement between the City and Jefferson National Bank for the use of three (3) off-street
parking spaces in the 24-B Parking Lot located at 71st Street and Rue Vendome.
BE IT ALSO RESOLVED, that Jefferson National Bank agrees to compensate the City of Miami
Beach, Florida an advance fee of$1,150.20 for the use of these spaces for the one year period commencing
January 1, 1993.
PASSED and ADOPTED this 2nd day of December, 1992.

CONCLUSION:
The Administration recommends that the City Commission adopt the attached resolution which directs the
Mayor and City Clerk to execute the lease agreement between the City and Jefferson National Bank for three
(3) parking spaces In the City's 24-B parking lot located at 71st Street and Rue Vendome for a one-year
period beginning January 1, 1993.
BACKGROUND:
The attached letter from Jacqueline H. Chiodo, Senior Vice President of Jefferson National Bank, requests
that the City enter into a lease agreement for the use of three parking spaces in the 24-B surface lot at 71%
Street and Rue Vendome. This parking lot is a 22-space off-street surface lot which services the Normandy
isle area. The City has an agreement with Great Western Bank for twelve spaces since 1978. The use of
this lot is low and the primary users are patrons of either of the two banking offices.
ANALYSIS:
In reviewing the revenue and user streams In the lot,the Parking Department has determined that the banks
have the greatest impact on the lot. Current earnings in the lot, adjusted for the lease agreements Is
approximately $0.11 per meter per day. Lease agreements only enhance the parking fund's ability to
improve the appearance of the area; therefore, create a lease for Jefferson National will Improve service
delivery in the area as well as improve the revenue stream from the facility to the parking system.
CONCLUSION:
In reviewing the needs of the community as well as improving the financial condition of the Parking Fund,
we believe that a lease agreement with Jefferson National Bank, similar to the existing agreement between
the City and Great Western Bank, is beneficial to all involved parties: We also believe that a rate of$30.00
per space per month plus all applicable sales taxes, Is a fair and equitable fee for the service. Accordingly,
the cost for three spaces will be$1,150.20 annually.

LEASE AGREEMENT
This lease agreement is entered into this 1st day of
January , 1993 , by and between the CITY OF MIAMI BEACH, FLORIDA, as
Lessor (hereafter referred to as "Lessor" or "City") and JEFFERSON
NATIONAL BANK (hereafter referred to as "Lessee" or "Bank") .

representatives have expressed a desirous interest to enter into a
lease agreement for parking spaces; and,
WHEREAS, the City owns the specific parking facility from
which parking is requested; and,
WHEREAS, the City has previously entered into similar
arrangements with other financial institutions in the area.
NOW, THEREFORE, in consideration of the premises, terms and
for other good and valuable consideration, the Lessor and Lessee
hereby agree as follows:
1. Lessor leases to Lessee the following parking spaces:
Three (3) parking spaces in the 24-B Parking Lot
917-929 Normandy Drive
first three spaces located along the walk
perpendicular to the west entrance of Jefferson National Bank
solely
2 . The spaces shall be used mei( for and by patrons of the
Bank during the hours of 8 : 00 A.M. and 5: 00 P.M. , Monday through
Friday, holidays excluded. Lessee or lessee 's agents shall cause
to be affixed upon the poles, permanent and appropriate signs
advising the public of the hours for which the spaces are duly
reserved.
3. The lease rate for these parking spaces shall be $30. 00
per space per month plus all applicable sales taxes. This amounts
to $1. 150. 20 for the three spaces, including 6. 5% Florida Sales Tax
payable in advance of the commencement of the agreement.
4. Lease payment shall be made to the City of Miami Beach -
Parking Department, 1837 Bay Road, Miami Beach, Florida 33139 .
5. Lessee shall procure and maintain during the term of this
lease, liability coverage including Bodily Injury and Property
Damage, in an amount no less than $500, 000 per person per
occurrence and shall include contractual liability coverage (to
cover the below indemnification) . Said insurance shall provide
primary coverage of the leased property and shall name Lessor as an

Additional Insured. This coverage primary to all other coverage
which the City holds, shall be insured by an insurance company duly
authorized to do business in the State of Florida and rated A:X or
better per A.M. Best' s Key Rating Guide (latest edition) . Lessee
shall furnish Lessor with a certificate disclosing the type and
amount of insurance obtained and providing that the policy may not
be cancelled or materially altered except upon ten (10) days '
written notice to Lessor. This certificate must be reviewed and
approved by the Lessor' s Risk Manager.
7 . Lessee agrees to indemnify and save harmless the City of
Miami Beach, its officials and employees and for and on account of
the City to make defense against any and all claims, actions,
demands, suits, liabilities, damages and payments, in tort or in
contract, including without limitation, accidents, liability or
loss for injuries to or deaths of persons or damages to property
caused by any act or failure to act of Lessee or its employees,
servants, agents, members, invites, or guests to the extent and limits
covered by the policy provided in paragraph 6 above.
8. This lease shall be subject to cancellation by either
party upon fifteen (15) days written noticed by certified mail or
hand delivery as follows:

9. This lease shall not be assignable without the prior
written consent of both parties hereto. However, if cancellation
occurs, Lessee shall receive a prorated refund for the portion of
the lease cancelled.
10. The term of this lease agreement shall be for the one-
year period beginning January 1, 1993 . The lease shall be
renewable upon written request from Lessee with all rates and
applicable terms and conditions to be reviewed annually.
11. The exercise of rights of cancellation under this lease
may be with or without cause for either party.
