A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE MAYOR AND THE CITY CLERK
TO EXECUTE AN AGREEMENT FOR MODIFICATION TO EXTEND THE
TERM AND RESTRUCTURE THE RENTAL RATE UNDER THE LEASE
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE STATE
OF FLORIDA DEPARTMENT OF HIGHWAY SAFETY AND MOTOR
VEHICLES FOR THE USE OF THE ENTIRE BUILDING AND PARKING
LOT LOCATED AT 8720 COLLINS AVENUE.
WHEREAS, pursuant to Resolution No. 89-19800, the City of
Miami Beach and the State of Florida Department of Highway Safety
and Motor Vehicles (the "Department") entered into a Lease
Agreement on January 3 , 1990 for the use of the City-owned facility
and municipal parking lot located at 8720 Collins Avenue, Miami
Beach, as a Drivers ' License Examining Station; and
WHEREAS, the Lease expires on December 31, 1992 and the
Department has requested the Lease be extended on a month to month
basis, not to exceed 11 months (November 30, 1993) , and the square
footage rental rate be increased from $10. 43 to $10. 84 per square
foot; and
WHEREAS, the City Manager recommends the Agreement to extend
the term and restructure the rental rate and the City Attorney has
approved it as to form.
NOW, THEREFORE, be it duly resolved by the City Commission of
the City of Miami Beach, Florida, that the Mayor and the City Clerk
are hereby authorized to execute the Agreement for modification to
extend the term on a month-to-month basis and restructure the
rental rate under the Lease Agreement between the City of Miami
Beach and the State of Florida Department of Highway Safety and
Motor Vehicles for the use of the entire building and parking lot
located at 8720 Collins Avenue.

EXTENSION OF LEASE AGREEMENT WITH THE STATE OF FLORIDA
SUBJECT: FOR THE FACILITY LOCATED AT 8720 COLLINS AVENUE, FOR USE
AS A DRIVERS LICENSE EXAMINATION STATION
ADMINISTRATION RECOMMENDATION:
It is recommended that the City Commission approve a Resolution
authorizing the proposed lease agreement extension with the State
of Florida, Department of Highway Safety and Motor Vehicles for use
of the City owned facility and municipal parking lot located at
8720 Collins Avenue for use as a drivers license examination
station.
BACKGROUND:
Pursuant to City Commission Resolution No. 89-19800, the City of
Miami Beach and the State of Florida Department of Highway Safety
and Motor Vehicles entered into a Lease Agreement on January 3 ,
1990 for the use of the City-owned facility and municipal parking
lot located at 8720 Collins Avenue, Miami Beach, as a Drivers '
License Examining Station.
The Lease expires on December 31, 1992 and the State of Florida has
requested the Lease be extended on a month to month basis, not to
exceed 11 months (November 30, 1993) , and the square footage rental
rate shall be increased from $10. 43 to 10. 84 per square foot.
ANALYSIS:
Under the proposed month-to-month agreement, the State of Florida
will make rental payments to the City as follows;

CONCLUSION:
Since the City does not have current plans for this City owned
facility and municipal parking lot, and the Lease amended to extend
the term on a month-to-month basis includes a cancellation clause
of 30 days upon written notice, the City Commission should endorse
a Resolution approving the proposed extension of lease agreement
with the State of Florida, Department of Highway Safety and Motor
Vehicles.

Lessee, has previously entered into Lease Number 760:0253 , on
January 3 , 1990 , A.D. , for a term commencing January 1 ,
19 90 , A.D. , which now terminates the 31st. day of December
19 92 , A.D. , ; the current Lessor being City of Miami Beach ,

WHEREAS, both the Lessor and the Lessee wish to amend and
modify said lease so as to extend the term and restructure the
rental rate of the lease;
NOW, THEREFORE, in consideration of the mutual promises and
covenants herein contained, the parties hereto hereby agree as
follows:

2 . The covenants and conditions contained in the original
State of Florida, Department of General Services' Lease Agreement
No. 760:0253_ , as amended by the above modification, are
readopted and include the restructured rental rate incorporated
herein.
